Owner’s Right to Suspend. Owner may, with or without cause, furnish Contractor with a written order to suspend the Work in whole or in part for such period of time as Owner may determine in its sole discretion, but not to exceed [ninety (90)] Days. Upon receipt of such an order to suspend, Contractor shall promptly cease all Work, except to the extent Owner’s order also requires Contractor to protect completed and partially-completed Work or to maintain during the period of suspension the Work protection of the Work, maintenance of access, protection of stored Materials, maintenance of temporary facilities, and general cleaning. If Owner’s suspension of the Work exceeds [ninety (90)] Days, and Owner re-engages Contractor to commence the Work once again with written notice, Contractor shall be entitled to an equitable adjustment to the Contract Sum for the length of time exceeding [ninety (90)] days. No such suspension of the Work will be the basis of a Claim except for Cost of the Work directly relating to maintenance of the Site during such suspension.

Owner’s Right to Suspend. If the Owner determines that postponement or delay of the Project is in the Owner’s best interest, the Owner may suspend performance of the Agreement upon written notice to the Architect. Upon receipt of such notice the Architect shall immediately suspend all services under the Agreement pending request by the Owner to resume them. Resumption of services may require accommodation of the Architect’s workload and staff assignments.

Owner’s Right to Suspend. Subject to Section 19C(1) of these General Conditions, Owner reserves the right at any stage of the Work, to suspend operations thereon, or upon any parts thereof, on one or more occasions, either for a time named or indefinitely, by giving the Construction Manager written notice. . When under suspension, the Work shall be put in proper and satisfactory condition, and properly protected, including as directed by Owner. Construction Manager recognizes that many events, known and unknown, including without limitation, legal challenges, administrative or political issues affecting the Project, delays in off site public improvements, could result in a determination by Owner to suspend work on the Project, and Construction Manager accepts such risk, subject to the provisions of this Section 16D. In all cases of suspension ordered by the Owner, the Work shall not again be resumed until permitted by written order of Owner.

Owner’s Right to Suspend. The Owner may, in its discretion, suspend all or any part of the construction of the Project, work under a Trade Contract or CM's services hereunder; provided, however, that if the Owner shall suspend construction of the Project, work under a Trade Contract or CM's services hereunder for a period of sixty (60) consecutive calendar days, or such other time deem appropriate by the nature of the project, and such suspension is not caused by CM or the acts or omissions of CM, upon recession of such suspension, the Contract Price hereunder will be subject to adjustment to provide for actual costs and expenses incurred by CM as a direct result of the suspension and resumption of Project construction or construction under a Trade Contract or CM's services hereunder.
