Resumption of Services. The EMC will authorise resumption of the suspended Contracted Ancillary Services once the cause giving rise to the suspension has been remedied to the satisfaction of the EMC and the PSO, including (as applicable) satisfaction of the requirements of section 4.12 of Chapter 5 of the Market Rules.
Resumption of Services. The Plan provides that, in the event of a Disaster, Metavante will be able to resume the Services in accordance therewith within the time periods specified in the Plan. In the event Metavante is unable to resume the Services to Customer within the time periods specified in the Plan, Customer shall have the right to terminate this Agreement without payment of the Termination Fee upon written notice to Metavante delivered within forty-five (45) days after declaration of such Disaster.
Resumption of Services. The Plan provides that, in the event of a Disaster, M&I will be able to resume the Services in accordance therewith within the time periods specified in the Plan. In the event M&I is unable to resume the Services to Customer within the time periods specified in the Plan, Customer shall have the right to terminate this Agreement without payment of the Termination Fee upon written notice to M&I delivered within forty-five (45) days after declaration of such Disaster.
Resumption of Services. After a Step-In, unless Company has terminated the relevant Services pursuant to the terms of this Agreement or any Order, Company shall allow Provider to resume the provision of the Services that are the subject of the Step-In as soon as reasonably practicable after both of the following are satisfied:
(i) The relevant Service Disruption has ceased; and
(ii) Provider has demonstrated through the submission and execution of a corrective action plan to Company’s reasonable satisfaction that it will be able to meet the relevant Service Levels (if applicable) and otherwise provide the relevant Services in accordance with the relevant Order and this Agreement if it resumes provision of those Services. Provider shall use diligent, commercially reasonably efforts to resume Services subject to a Step-In as soon as reasonably possible.
Resumption of Services. Shire may, at its reasonable discretion, end the partial or complete suspension, in whole or in part, at any time by providing written notice to Centogene. Upon receipt of Shire’s written notice, Centogene shall re-establish the suspended Services as soon as reasonably practicable and Shire shall then resume the originally agreed Minimum Financial Commitment payments.
Resumption of Services. Upon receipt of a written notice from the Company to resume the Services, the Supplier must resume performance of the Services as specified in such notice.
Resumption of Services. In the case of any suspension under this ----------------------- Article X, the dates set forth in this Agreement and in the Project Schedule and other dates for performance by WFI hereunder shall be equitably extended for the Suspension Period, any WFI rights or obligations under the Agreement affected by the suspension shall be equitably adjusted and the Project Cost shall be increased to reflect substantiated increases in the cost of performance of the Services and any additional costs incurred by WFI arising from the suspension.
Resumption of Services. 12.1 In circumstances where the Customer wishes to resume Services after an interruption in coverage (for example, due to termination for failure to make a payment or following a suspension by the Company), the Customer may reinstate the provision of the Services with 90 days written notice to the Company only if the Customer pays the Company the Fees which would have been payable over the intervening period had the Customer not cancelled the provision of Services, and the Customer installs (at its own cost) all Updates and Releases of the Software released over the intervening period, as supplied by the Company. An additional Fee may be payable as the Company requires.
12.2 The Company reserves the right to undertake a review of the Customer's system to ascertain if any changes have been made that may be material to the supportability of the system. A review of the Customer's system may include an on-site visit by a Company engineer and the compilation of a report describing the configuration of the system plus any pertinent diagnostics, which must be rectified prior to the resumption or non- suspension of Services.
12.3 A review of the Customer's system is a fixed price professional service at applicable Standard Rates.
Resumption of Services. (a) Any employee or former employee who has been off the County's active payroll or on a leave of absence for a period of six (6) months or more, or for a period shorter than six (6) months if the Employer believes such medical examination may be necessary, may be required by the County, before or upon resumption of services to undergo such medical examination as the County may determine.
(b) The County may also designate the physician or physicians to conduct such medical examination, or (in the County's discretion) may allow the employee to obtain medical examination by a qualified physician or physicians of the employee's choosing.
(c) The County shall pay the full cost of the medical examinations required by it pursuant to this Section.
Resumption of Services. In the event that one parent does not pay his/her share of the deposit, fees, and/or costs, the other parent may pay the full amount requested and bring a motion to the court seeking reimbursement for the non-complying parent’s share of the deposit, fees, and/or costs.
