Ownership, Operation and Maintenance. Upon completion of this project, the City will own the Pedestrian Crosswalk Flasher System. The City will operate and maintain the Pedestrian Crosswalk Flasher System, perform all Gopher State One Call locating, and be responsible for future system replacement, all at the City's cost and expense. The maintenance includes, but is not limited to: snow, ice, and debris removal of the pedestrian landings and ramps, associated signing, crosswalk pavement markings, and lighting without cost or expense to the State. The City will perform all system maintenance in a timely manner.
Ownership, Operation and Maintenance. 4.1 Idaho Power will own, operate and maintain the Requested Facilities constructed pursuant to this Agreement. Hoku recognizes that the Requested Facilities will become part of Idaho Power’s integrated electrical transmission and distribution system and will be used by Idaho Power to provide electric service to other existing, and future, customers.

6.2 The Parties acknowledge and agree that the Network Operator retains the right to shut-off, reduce or curtail all or part of the Network Entry Facility and the Network Operator’s Site for maintenance, repair or replacement works (“Maintenance Works”) which may have an impact on the availability of the Entry Capacity.
6.3 The Network Operator shall not be liable to any Party for any period of unavailability of the Network Entry Facility at the time irrespective of the reason for such unavailability

By entering into this Agreement, the County is not assuming any maintenance, ownership, or operation for the improvements contemplated by the Project once completed. It is anticipated that District will continue to maintain the improvements contemplated by the Project.
Ownership, Operation and Maintenance. 12.1 Upon acceptance of the Project as provided in Section 7, the LOCAL AGENCY shall be the sole owner of that portion of the Project located within the LOCAL AGENCY’s right of way, and the LOCAL AGENCY shall be solely responsible for all future operation and maintenance of the Project located within the LOCAL AGENCY’s right of way at its sole cost, without expense or cost to WSDOT, except for any improvements made pursuant to Section 9.3.
12.2 Upon acceptance of the Project as provided in Section 7, WSDOT shall be the sole owner of that portion of the Project located within state-owned right of way, and WSDOT shall be solely responsible for all future operation and maintenance of the Project located within state-owned right of way at its sole cost, without expense or cost to the LOCAL AGENCY. However, if the LOCAL AGENCY has obtained or is required to obtain an air space lease, cooperative agreement, or maintenance agreement from WSDOT to own, operate, or maintain a portion of the Project located within WSDOT-owned right of way, the terms of the air space lease, cooperative agreement, or maintenance agreement will control for those specified portions of the Project.
12.3 Section 12 shall survive the termination of this Agreement.

Customer shall own, operate and maintain all Delivery Facilities, except Delivery Point metering equipment, on Customer’s side of the Delivery Points, unless otherwise mutually agreed. Dominion shall own, operate and maintain all Delivery Facilities on Dominion’s side of the Delivery Points, unless otherwise mutually agreed.

(a) BPA shall, at BPA’s expense own, operate, and maintain the Badger Canyon- Reata No 1 115 kV poles, jumpers, insulators, metering equipment, and all associated equipment installed by BPA as referenced in Section 1(a), above. BPA shall reserve all BPA line capacity rights through the loop-in interconnection at Xxxxxx Road Substation at no cost to BPA.
(b) Richland shall, at Richland’s expense own, operate, and maintain the loop-in line, Xxxxxx Road Substation and all equipment referenced in Section 1(b) and 1(c), above.

After the Bannockburn Retail Sewage Collection Facilities, or any portion of such Facilities, have been conveyed to, and accepted and placed in service by, the County pursuant to Article III of this Agreement, the County shall be the sole owner of, and shall have the duty to operate and maintain, the Bannockburn Retail Sewage Collection Facilities or such portion thereof, as part of, the County Southeast Sewerage System. Nothing in this Agreement shall be construed to give the Village, or any other person or entity, except the County, any ownership or other interest in any part of the County Southeast Sewerage System.

Bluewater Power Distribution Corporation as the Town’s agent, is responsible for the operation and maintenance of the street lighting infrastructure.
Ownership, Operation and Maintenance. 9.1 Upon acceptance of the Work as provided in Section 5, the Agency shall be the sole owner of that portion of the Work located within the Agency’s right of way, and the Agency shall be solely responsible for ownership and all future operation and maintenance of the Work at its sole cost, without expense, cost, or liability to WSDOT.
9.2 WSDOT facilities constructed on Agency right of way, if any, as identified in Section 7.2 shall be owned by WSDOT, and WSDOT shall be responsible for the operation and maintenance of such facilities at WSDOT’s sole cost, until removed. The terms of this Section shall survive the termination of this Agreement.
