Payment on Termination for Leave not Taken. 5.6.1 Where the employment of an employee is terminated otherwise than by his/her death and any long service leave:
(a) to which the employee was entitled has not been taken; or
Payment on Termination for Leave not Taken. 7.1 Where the employment of an employee is terminated other than by the employee's death, and either long service leave -
7.1.1 to which the employee was entitled has not been taken, or
7.1.2 occurs to the employee on termination
7.2 Where the employee dies and either long service leave -
7.2.1 to which the employee was entitled has not been taken, or
7.2.2 occurs to the employee because of the employee's death,
Payment on Termination for Leave not Taken. Where the employment of an Employee is terminated other than by death and the Employee has an entitlement to long service leave, the Employee shall be deemed to have entered upon and taken the leave from the date of such termination and the employer shall forthwith pay to the Employee in full ordinary pay for such leave.
Payment on Termination for Leave not Taken. (a) Where the employment of an employee is terminated otherwise than by his/her death and any long service leave:
(i) to which the employee was entitled has not been taken; or
(ii) accrues to the employee upon such termination, the Company shall forthwith pay to the employee in full the amount in respect of such leave calculated as at the date of the termination in the manner set out in clause 31.4(a) hereof less any amount already paid to the employee in respect of that leave.
(b) Where an employee dies and any long service leave:
(i) to which the employee was entitled has not been taken; or
(ii) accrues upon termination of the employment by reason of his/her death, the Company shall upon request by the employee's personal representative pay to the employee's personal representative in full the amount in respect of such leave calculated as at the date of the death of the employee in the manner set out in clause 31.4(a) hereof less any amount already paid to the employee in respect of that leave.
Payment on Termination for Leave not Taken. Where the employment of an employee is terminated and the employee has at least 10 years continuous service, the employee will be paid a pro-rata long service payment.
Payment on Termination for Leave not Taken. 7.1 Where the employment of an employee is terminated other than by the employee's death, and either long service leave -
(a) to which the employee was entitled has not been taken, or
(b) occurs to the employee on termination the Employer must immediately pay to the employee the amount of the leave calculated as at the date of the termination less any amount already paid to the employee for that leave.
7.2 Where the employee dies and either long service leave -
(a) to which the employee was entitled has not been taken, or
(b) occurs to the employee because of the employee's death, the Employer must on the request of the employee's personal representative pay the amount due for that leave calculated as at the date of the death of the employee, less any amount already paid to the employee for that leave.
Payment on Termination for Leave not Taken. In conjunction with clause 33.1 (amount of leave), where the employment of an employee is terminated or the employee dies and any long service leave to which the employee was entitled has not been taken, and any long service leave becomes payable upon such termination, Clipsal will pay to the employee the full amount calculated as at the date of the termination in the manner set out in clause 33.3 (payment for periods of long service leave), less any amount already paid to the employee in respect of that leave. In the case of the death of an employee, leave will be paid to the employee's personal representative in accordance with the preceding paragraph. An employee with 10 years or more completed service as at the effective date of his or her termination, will be deemed to have accrued long service leave in respect of completed weeks of service only. Xxxx commenced employment with Clipsal on 1 January 1996. On 30 June 2006 Xxxx resigns. Clipsal will pay Xxxx pro-rata long service leave calculated as .867 weeks per completed year of service, plus .0167 weeks for each completed week of service thereafter. In this example (10 x 0.867) + (26 x .0167) = 9.1035 weeks, less any leave taken. Xxx commenced employment with Clipsal on 1 January 1990. On 30 June 2006 Xxx resigns. Xxxxxxx will paid Xxx xxxx service leave calculated as 13 weeks in respect of his first 15 years’ service, plus .867 weeks per completed year of service over since his first entitlement. In this example (13 weeks) + (1 x 0.867) = 13.867 weeks, less any leave taken or forfeited in exchange for payment in lieu.
Payment on Termination for Leave not Taken. (a) Where the employment of the Employee is terminated other than by the Employee's death, and either long service leave -
(i) to which the Employee was entitled has not been taken, or
(ii) accrues to the Employee on termination; the Employer must immediately pay to the Employee the amount of the leave calculated as at the date of the termination less any amount already paid to the Employee for that leave.
(b) Where the Employee dies and either long service leave -
(i) to which the Employee was entitled has not been taken, or
(ii) occurs to the Employee because of the employee's death, the Employer must on the request of the Employee's personal representative pay the amount due for that leave calculated as at the date of the death of the Employee, less any amount already paid to the Employee for that leave.
Payment on Termination for Leave not Taken. (a) Where the employment of an Employee is terminated otherwise than by their death and any Long Service Leave:
(i) To which the Employee was entitled has not been taken; or
(ii) Accrues to the Employee upon such termination.
(b) The Company shall forthwith pay to the Employee in full the amount in respect of such leave calculated as at the date of termination in the manner set out in sub-clause 27.3.4 less any amount already paid to the Employee in respect of the leave.
(c) Where an Employee dies and any Long Service Leave:
(i) To which the Employee was entitled has not been taken; or
(ii) Accrues upon termination of the employment by reason of their death.
(d) The Company shall upon request by the Employee’s personal representative pay to the Employee’s personal representative in full the amount in respect of such leave calculated as at the date of death of the Employee in the manner set out in sub-clause
Payment on Termination for Leave not Taken. (a) Where the employment of an Employee is terminated otherwise than by their death and any Long Service Leave:
(i) To which the Employee was entitled has not been taken; or
(ii) Accrues to the Employee upon such termination.
(b) The Employer shall forthwith pay to the Employee in full the amount in respect of such leave calculated as at the date of termination in the manner set out in sub-clause 28.2.4 less any amount already paid to the Employee in respect of the leave.
(c) Where an Employee dies and any Long Service Leave:
(i) to which the Employee was entitled has not been taken; or
(ii) accrues upon termination of the employment by reason of their death.
