Payment on Termination for Leave not Taken. Where the employment of an Employee is terminated other than by death and the Employee has an entitlement to long service leave, the Employee shall be deemed to have entered upon and taken the leave from the date of such termination and the employer shall forthwith pay to the Employee in full ordinary pay for such leave.

In this example (10 x 0.867) + (26 x .0167) = 9.1035 weeks, less any leave taken. Xxx commenced employment with Clipsal on 1 January 1990. On 30 June 2006 Xxx resigns. Xxxxxxx will paid Xxx xxxx service leave calculated as 13 weeks in respect of his first 15 years’ service, plus .867 weeks per completed year of service over since his first entitlement. In this example (13 weeks) + (1 x 0.867) = 13.867 weeks, less any leave taken or forfeited in exchange for payment in lieu.
