Payment to Class Members. 4.2.1 Each Class Member shall be entitled to submit one claim per telephone number he or she used or subscribed to. 4.2.2 Adequate and customary procedures and standards will be used by the Settlement Administrator to prevent the payment of fraudulent claims and to pay only legitimate claims, including, but not limited to, verifying claimed calls with information provided by the Parties. No fraudulent claim or other claim except a claim containing all required components—including the signature of a valid Class Member and a claim ID— shall be an Approved Claim. 4.2.3 Claim Settlement Payments will be made to Class Members who timely submit a valid Claim Form by the Claims Deadline. 4.2.4 Each Class Member who makes an Approved Claim shall be entitled to a Claim Settlement Payment in an amount not to exceed Fifty-One Dollars ($51), less each Class Member's share of any Fee Award. In the event that the total amount of Claim Settlement Payments for Approved Claims would exceed the threshold at which there would be insufficient funds in the Settlement Sum to pay all Approved Claims, any Fee Award, and Settlement Administration Expenses, the amount on a per claim basis will also be reduced by each Class Member's share of Settlement Administration Expenses so that the Settlement Sum is exhausted but not exceeded. 4.2.5 Payments will be made directly to the Class Member by the Settlement Administrator.

Payment to Class Members. At the same time as the Settlement Administrator’s payment from the Maximum Settlement Fund of: (i) Administration Expenses; (ii) Attorneys’ Fees and Expenses; and (iii) the Service Award, the Settlement Administrator shall pay the Settlement Benefit to each Class Member. The Settlement Benefit shall be directly mailed to each Class Member at the address located by the Settlement Administrator pursuant to paragraph 57, infra, and shall be distributed no later than twenty-one (21) days after the deposit the Maximum Settlement Fund into the Escrow Account by Defendant. Settlement Checks shall remain negotiable for 180 days from issuance. Upon the expiration of this time, any funds remaining in the Net Settlement Fund resulting from expiration of the Settlement Check shall be paid to the Cy Pres.

Subject to the terms of Section VI and Section X, the amounts paid to Class Members will be as follows: (a) Group 1: Timely Claimants whose unrecovered Non-Materials Depreciation could be determined by comparing the Xactanalysis Data to Mid-Century’s Payment Data will receive ninety-five percent (95%) of the dollar amount of their unrecovered Non-Materials Depreciation. Timely Claimants who previously recovered the total dollar amount of their Non- Materials Depreciation will receive payment pursuant to Group 4 below. In the case of those Timely Claimants who received no payment on account of their deductible and whose estimated Non-Materials Depreciation can be determined based upon the Xactanalysis Data, they will receive ninety-five percent (95%) of the dollar amount of the estimated Non-Materials Depreciation that exceeded their deductible. Persons or entities included in Group 1 are included in the Group 1 Class Members List, as updated by the Parties through the claims administration process. (b) Group 2: Timely Claimants whose claims were paid in part or in full on an ACV-only basis and for whom (i) no Xactanalysis Data available, or
Payment to Class Members. Class Members who submit timely and valid Proof(s) of Claim will be deemed eligible to receive payment or the “Settlement Benefit” as follows: • Subclass 1: December 1, 2010 to June 5, 2014, Release of Information requests from Patients, Insurance Companies or Attorneys: o any Attorney or Insurance Company, pursuant to written authorization, or Patient who, on one or more occasions between December 1, 2010 and June 5, 2014, sought, in writing, copies of a patient’s medical records from a West Virginia medical provider serviced by Defendants and paid a per-page fee, shall obtain the difference between the per-page fee paid and the negotiated fee of $0.50 per page. For example, a Release of Information requestor that paid $0.75 per page for 1,000 pages of medical records during the subject time period, would be reimbursed $250.00 ($0.25per-page difference x 1,000 pages). • Subclass 2: June 6, 2014 to July 5, 2017, Release of Information requests from Patients: o any Patient who, on one or more occasions between June 6, 2014, and July 5, 2017, sought, in writing, copies of his/her medical records from a West Virginia medical provider serviced by Defendants and paid a per-page fee, shall obtain the difference between the per-page fee paid for their records and the negotiated fee of $0.12 per page. For example, a patient that requested copies of their records and paid $0.49 per-page for 1,000 pages of medical records during the subject time period, would be reimbursed $370.00 ($0.37 per-page difference x 1,000 pages). • Subclass 3: June 6, 2014 to July 5, 2017, Release of Information requests from Attorneys or Insurance Companies: o any Attorney or Insurance Company, pursuant to a written authorization, who, on one or more occasions between June 6, 2014, and July 5, 2017, sought, in writing, copies of a patient’s medical records from a West Virginia medical provider serviced by Defendants and paid a per-page fee, shall obtain the difference between the per- page fee paid for medical records and the negotiated fee of $0.28 per page. For example, an attorney that requested copies of medical records and paid $0.55 per page for 1,000 pages of medical records during the subject time period, would be reimbursed $270.00 ($0.27 per-page difference x 1,000 pages). • Subclass 4: June 6, 2014 to July 5, 2017, Release of Information requests from Patients, Insurance Companies or Attorneys: o any Attorney or Insurance Company, pursuant to a written authorization, or Patient...
Payment to Class Members. Class Members who do not exclude themselves from the settlement and who file valid and timely Claim Forms shall receive payments from the Settlement Fund based upon the estimated time they spent driving between clients in a work day, as determined by an expert labor economist. Settlement Payments for which individual Class Members are eligible could be as low as $25.00 or run into the thousands of dollars. The average payment to which Class Members would be eligible is, however, approximately $466.
Payment to Class Members. Within fifteen (15) days after the entry of the Final Approval Order, Defendant shall transfer the Settlement Fund to the Settlement Administrator, less the total amount calculated by the Administrator, as provided in subsection 8(d)(iv), that will be credited to Class Members by Defendant, as provided in subsection 8(d)(iv)(b)(i), below. The Settlement Fund shall be the total amount Defendant is obligated to pay under the terms of this Agreement and includes (a) Class Counsel’s fees and costs; (b) any service award payment to the Plaintiff; (c) costs associated with administering the Notice in accordance with Section 5, above; and (d) any fees paid to the Settlement Administrator for services rendered in connection with the administration process. Defendant shall not make any additional or further contributions to the Settlement Fund, even if the total amount of all alleged Retry Fees charged to the Class Members exceeds the value of the Net Settlement Fund.
Payment to Class Members. Within twenty (20) days after the Effective Date and solely for purposes of this Settlement, ACS shall provide to the Claims Administrator the Payout Amount necessary for the Claims Administrator to issue Settlement Awards to the Approved Claimants.

(b) Group 2: Timely Claimants whose claims were paid in part or in full on an ACV-only basis and for whom (i) no Xactanalysis Data is available, or (ii) Xactanalysis data is available but the dollar amount of withheld and/or recovered Non-Materials Depreciation could not be determined by comparing the Xactanalysis Data to Foremost’s Payment Data, will receive fifty-six percent (56%) of the dollar amount of their unrecovered total depreciation in their last estimate of the cost to repair or replace the damaged structure (i.e., not an estimate for mitigation expenses, contents, damage to shrubs, etc.). (c) Group 3: Untimely Claimants who did not recover any previously- withheld Non-Materials Depreciation will receive five and one-half percent (5.5%) of the total structural damage amount paid to the policyholder on the underlying claim. Untimely Claimants who recovered some but not all of any previously-withheld Non-Materials Depreciation will recover a proportional amount of 5.5% of the total structural damage amount paid to the policyholder on the underlying claim. For example, an Untimely Claimant who recovered 30% of the total recoverable depreciation would receive 3.85% (70% x 5.5% = 3.85%) of the total structural damage amount paid. In no event shall the total dollar amount paid to Group 3 Untimely Claimants exceed three hundred seventy-two thousand two hundred forty dollars and no cents ($372,240.00) (the “Group Three Maximum”).
