Periodic Recruitment. The State reserves the right to add new Contractors during the term of the Centralized Contract via periodic recruitment. OGS will formally announce when the periodic recruitment Solicitation is issued. It is at the discretion of OGS when a future periodic recruitment shall commence. A periodic recruitment will be publicly announced through all standard means including, but not limited to: the NYS Contract Reporter; and OGS website. All OGS Centralized Contracts awarded under the Periodic Recruitment will commence upon OGS approval. All Contracts will co-terminate on the then current end date of the Centralized Contract or at the end of any approved extension or renewal period

Section 3.1 Minimum Qualifications is amended to insert the following language as the final paragraph of the section: Note: If Contractor is relying on operations of a parent company, subsidiary, predecessor entity, or other entity for purposes of satisfying any of the three listed above, Contractor is required to provide a full explanation describing such relationship and how it satisfies this requirement OGS will determine whether such other entity experience satisfies this requirement, and reserves the right to ask for additional information or require a contract performance guarantee and/or other assurances from such other entity(ies) or the Contractor.

If a Contractor Submission for a Lot is deemed non-responsive under any Periodic Recruitment, a Contractor cannot reapply for that Contract Lot until the next Periodic Recruitment is opened. All OGS Centralized Contracts awarded under the Periodic Recruitment will commence upon OGS approval. All Contracts will co-terminate on the then current end date of the Centralized Contract or at the end of any approved extension or renewal period. If a Contractor chooses not to provide a Submission for a Lot (during this Solicitation period or any subsequent Periodic Recruitment(s)), or was not previously approved for a specific Lot, such Contractor will be required to wait for the next Periodic Recruitment in order to provide a Submission to add any Lot to the Contractor’s Contract. For example: If the Contractor initially provided a Vendor Submission for Lot 1 and later wants to add Lot 2, the Contractor would need to wait for the next Periodic Recruitment to submit a complete Submission proposing the addition of Lot 2 to the Contractor’s Contract.

Contractor may not resubmit a Bid for future consideration for categories covered by the scope of the awarded Contract. In addition, if a Bid is deemed non-responsive during the initial Solicitation or any recruitment period, a Bidder cannot reapply for a future Contract until the next recruitment period.

Periodic Recruitment. After the initial bidding process is completed and the initial Master Contracts are awarded, the State reserves the right to accept proposals at any time determined by the State to be in its best interest. If the proposal is accepted, a Master Contract shall be awarded and the Contractor shall be placed on the list of prequalified Contractors for the remaining term of the initial agreement. These periodic recruitments are open to either new Contractors or Contractors who already hold a Master Contract and wish to bid on regions or services that they were not awarded. Once the proposal is evaluated, Master Contracts shall be awarded to all Contractors who are deemed qualified. After award, only those Contractors who hold a Master Contract for a particular region shall be allowed to bid specific projects or facilities in that region utilizing the Project Definition Template as part of the Mini-Bid process.

Additional recruitment periods will be advertised in the NYS Contract Reporter. Bids shall be evaluated under the same terms and conditions as the original Bids. Bidders shall also be required to submit necessary documentation for any additional applicable statutory requirements currently in effect at the time of the new Bid Solicitation. Once awarded a Contract, a Contractor may not resubmit a Bid for future consideration. If a Bid is deemed non-responsive during the initial Solicitation or any recruitment period, a Bidder cannot reapply for a future Contract until the next recruitment period. Any Contract(s) awarded under periodic recruitment will commence and terminate as described in Section 2.33, Contract Term.

For Contracts that are awarded under periodic recruitment, the Contract term will commence upon OGS approval in accordance with §38, Contract Creation/Execution of Appendix B and will terminate on the then current end date of the Contract or at the end of any approved extension or renewal period.

These additional proposals shall be evaluated under the same terms and conditions as the original bids and the following: • For the evaluation of the Administrative Proposal, the same process set forth in the original Solicitation shall be followed; • For the evaluation of the Technical Proposal, the same process set forth in the original Solicitation shall be followed; and • For the evaluation of the Cost Proposal, bids received under any subsequent Periodic Recruitments will be evaluated as follows:
Step 1: For each region and lot, the Bidder’s proposed fees and markup percentages will be combined via the formula below to establish an estimated total monthly price. Estimated Total Monthly Price = (MMF) + (FSTF) + (MCM) Where: MMF = Monthly Maintenance Fee FSTF = Fire Service Testing Fee. If not included in lot, then FSTF is equated to zero. MCM = Estimated Monthly Cost of Major Corrective Maintenance = (Labor Costs) + (Material Costs) = (H)/12 x [(1 + LMR/100) x ((PWR, Team) + (SB, Team))] + (M)/12 x (1 + MMR/100) = (30 hours)/12 x [(1 + LMR/100) x ((PWR, Team) + (SB, Team))] + ($3300)/12 x (1 + MMR/100) Where: H = The assumed number of hours of Major Corrective Maintenance for one elevator in one year = 30 hours PWR, Team = The prevailing wage rate for a team of two mechanics (one journeyman and one helper) LMR = Labor Markup Rate (%) SB = Supplemental Benefit for a team of two mechanics (one journeyman and one helper) M = The assumed material costs for Major Corrective Maintenance for one elevator in one year = $3300 MMR = Materials Markup Rate (%) Step 2: For each region and lot, the ‘Bidder’s Estimated Total Monthly Price’ for each bid received under periodic recruitment will be averaged with the current Contractors’ Estimated Total Monthly Price to create an “Average Estimated Monthly Price”. For the purposes of this analysis the currently awarded Contractors’ Estimated Total Monthly Price will be calculated using the above formula and the currently awarded MMF, FSTF, LMR and MMR rates for the applicable Lot and Region.
