POLICY DIRECTIVES AND REQUIRED PROCEDURES. 303.3.1 Policy Directives Effective Date: 12/26/2014 2 CFR 200, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, establishes the requirements that the federal government agencies must follow when administering grants and cooperative agreements to U.S. non-governmental organizations. 2 CFR 700 is the Agency’s regulatory implementation and supplement to 2 CFR 200. 2 CFR 200 and 2 CFR 700 do not directly apply to foreign organizations (non-U.S. non-governmental organizations). However, USAID applies some of these regulations to non-U.S. non-governmental organizations through this ADS chapter and ADS 303mab, Standard Provisions for Non-U.S. Non-governmental Organizations. 303.3.2 Required Procedures Effective Date: 12/26/2014 USAID executes all assistance awards in accordance with 2 CFR 200 and 2 CFR 700. Additionally, Agency policies on specific topics can be found in other sections of the Code of Federal Regulations (CFRs) and the ADS 300 Series. When it is necessary to implement timely changes prior to a formal revision of Agency assistance regulations and policy, the Director, M/OAA will issue Acquisition and Assistance Policy Documents (AAPDs). M/OAA uses Procurement Executive Bulletins (PEBs) to issue guidance, best practices, reminders, and answers to frequently asked questions.

This chapter primarily covers grants from USAID to Bilateral Donors (See Section 351.3.3, Accepting Grants from Bilateral Donors, for information regarding grants from Bilateral Donors to USAID). The term "grant" as used in this chapter is considered to include grants, contributions, donations, gifts and other types of assistance provided to or received from Bilateral Donors. This chapter is authorized by Section 635(b) of the Foreign Assistance Act of 1961, as amended (FAA), which states “the President [or USAID Administrator as designee] may make loans, advances and grants to, make and perform agreements and contracts with, or enter into other transactions with…any friendly government or government agency…in furtherance of the purposes and within the limitations of this Act.” This chapter highlights the Agency’s commitment to donor coordination and collaboration, consistent with and in furtherance of the spirit of the Paris Declaration on Aid Effectiveness, the Accra Agenda for Action, the Busan Partnership Agreement, the Presidential Policy Directive on Global Development, and the Quadrennial Development and Diplomacy Review. POLICY DIRECTIVES AND REQUIRED PROCEDURES. 351.3.1 Grants to Bilateral Donors‌ Effective Date: 07/31/2012 Where an Operating Unit has determined that a grant to a Bilateral Donor is an efficient way of fulfilling an Agency objective, USAID may make a grant to a Bilateral Donor in accordance with the provisions of this ADS Chapter 351.
POLICY DIRECTIVES AND REQUIRED PROCEDURES. 308.3.1 Public International Organizations (PIOs)‌ Effective Date: 12/04/2020 A PIO is typically an organization composed of multiple member states (i.e., sovereign countries). After GC or RFS (as appropriate) determines whether an organization is a PIO for the purposes of this ADS chapter, PPL/DC will include the organization in ADS 308maa, List of Public International Organizations, and assign the PIO as belonging to one of the categories described in section 308.3.1.2.‌‌‌ As a result of their intergovernmental composition, PIOs are not generally subject to U.S. laws or business standards. Therefore, the due diligence described in this ADS chapter, including the Organizational Capacity Review (OCR) process described in section 308.3.2.1, is vitally important, as are the terms and conditions of any agreement with a PIO. The United States is a Member State of many PIOs. Therefore, the OCR and other due diligence requirements outlined in this chapter can also help inform the Agency’s contribution to the United States’ role in the institutional oversight of such PIOs. 308.3.1.1 Designating an Organization as a PIO‌ Effective Date: 12/04/2020 If an Operating Unit wishes to provide assistance to an international organization that is not in ADS 308maa, List of Public International Organizations, it must prepare a PIO Designation Memorandum stating the basis for the organization to be designated as a PIO. The Operating Unit must submit the PIO Designation Memorandum to GC (for all organizations other than IARCs) or the AtA for RFS (for IARCs), for PIO designation approval. The Operating Unit must make submissions to GC through its GC/W backstop attorney or RLO, as applicable, and the cognizant Assistant General Counsel (AGC) will determine whether to grant approval in their discretion. If the designation of the organization is approved, the cognizant AGC or AtA/RFS will notify PPL/DC, which will add the organization to ADS 308maa, List of Public International Organizations.‌‌‌‌‌ PPL/DC will assign PIOs added to the List of Public International Organizations in accordance with the procedures above to Category 2 by default.
