POS Equipment. If Merchant chooses to rent or lease POS Equipment from Processor or utilizes software provided by Processor for use in processing Transactions, Merchant agrees to pay Processor: (a) a pre-determined monthly rental fee; (b) any initial upfront costs as required; and (c) all applicable taxes for such POS Equipment or software utilization.

POS Equipment. If Merchant chooses to rent or lease POS Equipment from ISO or utilizes software provided by ISO for use in processing Transactions, Xxxxxxxx agrees to pay ISO: (a) a pre-determined monthly rental fee; (b) any initial upfront costs as required; and (c) all applicable taxes for such POS Equipment or software utilization.
POS Equipment. BUYER is required to lease P.O.S. equipment provided by SELLER in order to accept credit cards and dispense fuel. Current monthly lease is $ 375.00 per month. The rental amount is subject to review periodically based on actual expenses which may increase or decrease the monthly amount. BUYER shall be responsible for imprinters lent to it. In the event an imprinter is lost, stolen or damaged beyond repair, BUYER shall reimburse SELLER in full for the cost thereof. BUYER understands and agrees that it has no right, title, or ownership interest in such software or firmware and agrees that it will not attempt to reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of such software or firmware.
POS Equipment. Contractor and Licensor shall cooperate in the selection of the POS Equipment to be used by Contractor for all of Contractor's retail Facilities where Refreshments are sold to the public. The POS Equipment will be designed to support the high levels of customer service desired hereunder. Licensor and Contractor shall use best reasonable commercial efforts to mutually agree on Licensor's final selection of the POS Equipment, subject to the approval of the Team. Licensor shall be responsible for all costs and expenses associated with its installation and implementation pursuant to Section 4.1.1.
POS Equipment. If applicable, you may elect to purchase POS Equipment from Shopify that will allow you to accept CP Transactions and Keyed Transactions. POS hardware may be purchased on the Shopify hardware store located here: xxx.xxxxxxx.xxx/xxx/xxxxxxxx (the “POS Equipment Store”). POS software may be downloaded for iOS devices from the Apple App Store under the title “Shopify POS” or “Shopify”. Your use of the Shopify POS hardware and software is subject to the applicable sections of the Shopify Platform Terms of Service.

POS Equipment. The Contractor shall provide PCI-certified POS equipment and equipment software in accordance with section ii., below, for purchase, or for rent on a short-term basis. POS equipment rentals will not exceed six (6) months. All POS equipment offered by the Contractor must be EMV-capable. The Contractor must also provide POS equipment options that are Contactless-capable. The Contractor shall provide equipment software upgrades to the Participants’ POS equipment, along with installation support to ensure each Participant’s POS equipment functions properly, at no additional charge to the Participants.

  • Leased Equipment The risk of loss or damage to leased equipment, goods or property shall not transfer to the University except as provided in §680.219, Florida Statutes. Any security interest in the leased equipment, goods or property granted to the Contractor contrary to AGO 79-72 and AGO 80-9 is null and void. Limitations of remedies provisions, which are unconscionable under applicable Florida law, are void. MATERIAL SAFETY DATA SHEET (MSDS). In compliance with Florida Statutes, Ch. 442, a Material Safety Data Sheet (MSDS) must accompany any applicable item delivered under this Agreement.

  • Equipment The Fund shall obtain and maintain at its own cost and expense all equipment and services, including but not limited to communications services, necessary for it to utilize the Software and obtain access to the System, and Custodian shall not be responsible for the reliability or availability of any such equipment or services.

  • LEASE OF EQUIPMENT Subject to the terms of this Agreement, Xxxxxx agrees to provide the Acquisition Amount to acquire the Equipment. Lessor hereby demises, leases, transfers and lets to Lessee, and Lessee hereby acquires, rents and leases from Lessor, the Equipment. The Lease Term may be continued, solely at the option of Lessee, at the end of the Original Term or any Renewal Term for the next succeeding Renewal Term up to the maximum Lease Term as set forth in the Payment Schedule. At the end of the Original Term and at the end of each Renewal Term until the maximum Lease Term has been completed, Lessee shall be deemed to have exercised its option to continue this Agreement for the next Renewal Term unless Lessee shall have terminated this Agreement pursuant to Section 3.03 or Section 10.01. The terms and conditions during any Renewal Term shall be the same as the terms and conditions during the Original Term, except that the Rental Payments shall be as provided in the Payment Schedule.

  • Location of Equipment The Customer shall not remove the Equipment from the location shown herein as the place of use of the equipment, without prior written approval of the Company. The Customer shall inform the Company by email upon demand of the exact location of the Equipment while it is in the Customer’s possession.
