Project Site Conditions. 12.3.1 It is recorded that SANParks has made available to the Private Party for its information, prior to the Signature Date, all relevant data in SANParks’ possession on the conditions at the Spa Facility, including Environmental aspects. SANParks shall similarly make available to the Private Party all such similar information which comes into SANParks’ possession after the Signature Date. The Private Party shall be responsible for interpreting all such data.
12.3.2 Notwithstanding the provisions of Clause 12.3, the Private Party shall be deemed at the Signature Date to have obtained all necessary information as to risks, contingencies and other circumstances which may influence or affect the execution of the Project Deliverables. To the same extent, the Private Party shall be deemed as at the Signature Date to have inspected and examined the Spa Facility, its surroundings, the above data and other available information. To this end, the climatic, hydrological, hydrogeological, ecological, Environmental, geotechnical, geological, palaeontological and archaeological conditions of the Spa Facility ("Project Site Conditions") shall be the sole responsibility of the Private Party. Accordingly, without limiting any other obligations of the Private Party that are included in the Project Deliverables, the Private Party shall be deemed as at the Signature Date to have –
12.3.2.1 carried out an investigation of all Project Site Conditions and of any extraneous material in the Spa Facility including its surface, sub-soil, ground water and flood line;
12.3.2.2 for the purpose of such investigation in Clause 12.3.2, inspected and examined the Spa Facility and surroundings thereof;
12.3.2.3 satisfied itself as to the nature of the Project Site Conditions, the form and nature of the Spa Facility, the risk of damage to property affecting the Spa Facility, the nature of the materials (whether natural or otherwise) to be excavated, if any, and the nature of the design, works and material necessary for the execution of the Project Deliverables and the remedying of any defects; and
12.3.2.4 satisfied itself as to the adequacy of –
12.3.2.4.1 its right of passage over, access to and through the Spa Facility; and
12.3.2.4.2 any accommodation it may require for the purposes of fulfilling any of its obligations included in the Project Deliverables, such as any additional land or buildings located outside the Spa Facility;
12.3.2.5 satisfied itself as to the possibility of inter...
Project Site Conditions.
3.3.1 The physical and the ambient conditions including climatic, hydrological, hydro geological, ecological, environmental, geotechnical, geological, paleontological and archaeological conditions of the Project Site (the “Project Site Conditions”) shall be the sole responsibility of the Concessionaire. Accordingly, without limiting any other obligations of the Concessionaire that are included in the Project Deliverables, the Concessionaire shall be deemed as at the Signature Date to have:
(i) carried out an investigation of all Project Site Conditions and of any extraneous material in or under the Project Site including its surface, sub-soil and groundwater to enable the Facilities to be designed and constructed and the Works to be carried out with due regard for the Project Site Conditions and the seismic activity (if any) in the region of the Project Site;
(ii) for the purpose of such investigation in Section 3.4.1(i), inspect and examine the Project Site and surroundings;
(iii) satisfied itself as to the nature of the Project Site Conditions, the surface, sub-soil and ground water of the Project Site, the form and nature of the Project Site, the load-bearing and other relevant properties of the Project Site, the risk of damage to property affecting the Project Site, the nature of the materials (whether natural or otherwise) to be excavated and the nature of the design, works and material necessary for the execution of the Works;
(iv) satisfied itself as to the adequacy of its right of passage over, access to and through the Project Site and any accommodation it may require for the purposes of fulfilling any of its obligations included in the Project Deliverables, such as any additional land or buildings located outside the Project Site;
(v) satisfied itself as to the possibility of interference by persons with rights- of-way across, access to or use of the Project Site with particular regard to the owners and users of any land adjacent to the Project Site; and
(vi) satisfied itself as to the precautions, times and methods of working necessary to prevent or minimize nuisance or interference being caused to any third parties.
3.3.2 To avoid doubt, the Concessionaire accepts full responsibility for all matters in Section 3.4.1 and the Concessionaire shall:
Project Site Conditions. The Municipality has conducted studies or caused studies to be conducted on their behalf at the Project Site, the results of which have been made available to the Private Party.
Project Site Conditions. A. Environmental Requirements: Weather conditions: Do not proceed with installation of firestop materials when temperatures (including substrate) exceed the manufacturer’s recommended limitations for installation.
B. Existing Conditions: Verify existing conditions and substrates before starting work. Correct unsatisfactory conditions before proceeding.
Project Site Conditions. Developer shall have the sole responsibility of satisfying itself concerning the nature and location of Construction Work and the general and local conditions applicable to the land, including, without limitation, with respect to the following: (i) those affecting transportation, access, disposal, handling and storage of materials;
Project Site Conditions. The DBOM Contractor shall make all further soil test borings and conduct analyses of subsurface conditions, inspections and applicable site history reviews of the Project Site (including those required by Section 6.2 (Project Site Suitability Confirmation)) and in each case as reasonably necessary under Good Engineering and Construction Practice to prepare for excavation and construction hereunder in accordance with Applicable Law.
Project Site Conditions. 1 Work at site will involve working in and around open water:
Project Site Conditions. A. Verify location and coordinate installation of utility poles and other structures to include but not limited to: existing planting and pathways, signs, utility boxes, manholes, and equipment block-outs and pads, prior to commencement of work in this Section.
B. Existing pathway subgrade condition unknown. If no aggregate base exists – only fill uneven sections with aggregate base to provide smooth grade conditions and compact according to execution instructions.
Project Site Conditions. The Project Site is an old landfill operated in the mid-1970’s. Solid wastes disposed of in at the Project Site may include asbestos, sludge, concrete, steel and biodegradable solid wastes. Many of these wastes generate methane and hydrogen sulfide gasses which can be explosive, corrosive or toxic in certain concentrations. The Contractor shall address these anticipated conditions in a Project health and safety plan, and shall provide appropriate ambient air monitoring, confined space entry procedures, ventilation and construction equipment depending on the site conditions encountered during site investigations and construction. The Project health and safety plan shall be submitted within thirty (30) days of the issuance of the Notice to Proceed.
Project Site Conditions. A. The xxxxx are located at individual well sites along, or just off of Goodlette-Frank Road. Some of these xxxxx may be located within the medians of the road. Due to the high traffic flow, alternate means/methods such as working during non-peak hours or coordinating the closing of traffic lanes, may be required to manage the work area. Work of this type may require Collier County Right of Way Permits and MOT Plans. All documentation and costs related to ROW Permits shall be the responsibility of the Contractor. The Contractor shall take all necessary precautions to prevent discharge water from undermining the foundations of the well pads and washing onto paved streets. The detailed plan of action must take all localized factors into consideration. The discharge water shall be neutralized if it has been acidized or chlorinated. Sodium thyosulfate is an approved neutralizing chemical. The site must be kept well-maintained and clean throughout the project due to the public locations.
