Site Suitability. A. Prompt access to nearby handwashing and restroom facilities should be no more than 500 feet from the mobile blood drive.
B. Proper room clearing of tables/chairs/furniture should be done prior to the arrival of mobile staff. Staff shall not be required to remove, move or re-set furniture outside of the furniture (i.e., tables and chairs, etc.) required for the blood drive, or a deminimus amount of sponsor furniture. If Staff encounter a situation where the removal of additional sponsor furniture is needed, the staff should immediately contact local management who will attempt to resolve.
C. There should be at least two (2) or more fans, as determined by local agreement, (based on space constraints and fan size) on a truck/Promaster for blood mobile operations during warmer months based on geography. Donor Recruitment and Mobile Collections should work with labor management partnership to identify and evaluate drives where ambient room temperature creates a potential hazard (i.e., due to lack of air conditioning) in efforts to work with the sponsor to address the situation.
D. Mobile Collections should work with labor management partnership towards eliminating steps at any drives by evaluating stairs and reported hazards due to stairs. The TPC will meet with management within three (3) months of ratification.
Site Suitability. Buyer's determination that the Property is feasible in all respects for Buyer's intended use, including but not limited to, the following: determining that Buyer's selected building configuration plan can be satisfactorily adapted to the site; that Buyer's proposed parking plan, on site vehicle and pedestrian circulation plan and street access plan for the Property all meet or exceed Buyer's minimum criteria; that the applicable local governmental requirements for landscaping, open area, building to land ratio, set-backs and parking can be satisfied within Buyer's plans as shown on Exhibit A; and that all utilities are available of adequate capacity to serve Buyer's needs.
Site Suitability. 3.1 The Owner warrants to the Contractor that the Land is suitable for the siting and construction of a Pool and that the Owner is entitled to construct the Pool on the Land. The Owner indemnifies the Contractor against all claims, actions, proceedings, demands, costs and expenses which may be made or brought by any person for any reason whatsoever. This shall include any person claiming to be the rightful owner of the property and/or which may be brought by any person in respect of any alleged encroachment of the Pool or Pool accessories upon any adjoining property.
3.2 The Contractor shall not be liable for:
3.2.1 any damage to the Work caused by subsidence of the site or mishap or subsidence on adjoining Land.
3.2.2 any damage to the Land, to the Work or to any improvements on the Land caused by the construction of the Work by the Contractor unless such damage has been caused by a negligent act or omission on the part of the Contractor or its subcontractors or agents.
3.2.3 any damage or any additional costs of the Work resulting from the absence of information which results in foundation defects or difficulties in the construction of the Work which were not discoverable by the Contractor on a reasonable inspection of the site.
3.2.4 any damage or deterioration to the Work or any part of the Work or the Land caused by or resulting from inadequacy of earth fill or negligent earth fill unless such damage or deterioration is due to a negligent act or omission to carry out specific work by the Contractor or its subcontractors or agents.
3.2.5 any additional costs or delays occasioned as a result of any underground conditions, rock or other hazards discovered during the course of construction and not discoverable by the Contractor on a reasonable inspection of the site prior to determination of the Contract Price and commencement of the Work. The Owner shall be liable for the costs of any engineering reports, additional excavation, rock blasting or other work required and any alteration to the Plans and Specifications caused as a result of the discovery of any such hazard. Such additional costs will be an extra and variation to the Contract Price and shall be dealt under clause 6.
3.3 The Owner indemnifies the Contractor against all additional costs and expenses incurred for engineering reports, other professional services or claims against the Contractor by any person whatsoever for damage or expenses incurred by reason of any of the hazards referred to cla...
Site Suitability. COUNTY shall be solely responsible for determining the suitability of the Property for the uses defined herein.
Site Suitability. Lessee shall ensure that a level compact, truck accessible site is available for placement and removal of the Equipment and warrants that the Site will have safe access, free from obstacles, obstructions, and encumbrances, a level pad with no more than 3 inches of variance in 30 feet, and adequate soil bearing pressure of not less than 2,500 psf. Lessee is responsible for securing all necessary Site related permits, utility hookups, and all other Site preparation (unless otherwise expressly stated in Lessor’s Proposal). Lessee shall have express legal authorization to locate the Equipment upon the site. If Lessee fails to provide such a Site, then Lessee shall pay for any resulting *Includes any applicable taxes

Site Suitability. Lessor shall deliver Equipment to the project site provided by Lessee (the “Site”). Lessee shall ensure that a level compact, truck accessible site is available for placement of the Equipment. Tires used to deliver the Equipment will be removed and returned to Lessor. Lessee warrants that the Site will have safe access, free from obstacles, obstructions, and encumbrances, a level pad with no more than 3 inches of variance in 30 feet, and adequate soil bearing pressure of not less than 2,500 psf. Lessee is responsible for securing all necessary Site related permits, utility hookups, and all other Site preparation (unless otherwise stated in Lessor’s scope of work). Lessee shall own and/or have express legal authorization to locate the Equipment upon the site. If Lessee fails to provide such a site, then Lessee shall pay for any resulting additional delivery, installation, and knockdown and return charges, including, but not limited to, storage related charges attributable to delayed delivery and/or installation of the Equipment required and/or requested by Lessee. Lessee shall not alter the manner of installation or location of the Equipment without written consent of Lessor. Lessor shall have the right to enter the premises and inspect the Equipment during normal business hours during the Term of this Agreement and any Extension Period. Lessor does not recommend or support the stacking of Equipment. Do not stack Equipment unless you have the approval of qualified engineering professionals, comply with all occupational safety laws, and obtain all zoning, building, and occupancy permits. Notwithstanding any express terms to the contrary, Lessor disclaims all warranties, express or implied, if the Lessee stacks Equipment.
Site Suitability. On or prior to the Date of Closing, Buyer shall determine whether the Property is suitable for Buyer’s intended use, which may include construction of new improvements on the Property. Buyer, their agents and contractors, shall have the right to perform such physical inspections, drillings and investigations as they deem advisable, provided that Buyer shall indemnify and hold Seller harmless from and against any damages, losses, liens (including mechanic’s liens), fines, penalties, or claims arising out of or relating to the inspection activities of Buyer, their agents and contactors, and Buyer shall promptly repair, at Buyer’s cost, any damages to the Property occasioned by any such inspection activities. Buyer warrants that in entering the Property for purposes of evaluation as set forth under this paragraph, Buyer shall comply with all applicable laws and regulations, including but not limited to laws and regulations relating to health and safety.
Site Suitability. Prior to the commencement of construction, Belectric must first approve each site, in respect of interconnection and site preparation, as Belectric will bear the costs related thereto. Belectric’s approval of each site shall not be unreasonably withheld.
