Promotion Requiring Higher Qualifications. Where there is no qualified applicant for a posted position, consideration for promotion will be given to the senior applicant who does not possess the required qualifications, but who is preparing for qualification prior to the filling of the vacancy. If such Employee is promoted, he/she will be given an opportunity to qualify within a reasonable length of time and if he/she fails to qualify he/she shall revert to his/her former position and wage rate.

Transfers Whenever an Employee voluntarily transfers to another classification that has a wage range equivalent to, or lower than the current wage rate, and if has not been in the position in the last two (2) years, shall start at the starting rate of that classification. Management will review the performance of the Employee after two (2) calendar months (320 working hours for part-time) and if the Employee is qualified to perform the work in the new classification and is performing satisfactorily, the Employee will be placed at the same step in the wage range of the new classification to which had progressed in the wage range of the previous classification. Office and Clerical Employees, see Schedule When an employee is temporarily assigned or transferred in excess of hours, to perform the duties of a classification in the Bargaining Unit with a higher rate of pay, the Employee shall be paid at the appropriate rate of pay in the new classification for the duration of the time worked. When an Employee is temporarily assigned or transferred in excess of hours, to perform the duties of a classification in the Bargaining Unit with a lower rate of pay, the Employee shall be paid their regular rate of pay.

(b) The Trustee as agent for any REMIC hereby agrees to adopt and sign such a plan of complete liquidation upon the written request of the Master Servicer, and the receipt of the Opinion of Counsel referred to in Section 9.03(a)(1) and to take such other action in connection therewith as may be reasonably requested by the Master Servicer. (c) By their acceptance of the Certificates, the Holders thereof hereby authorize the Master Servicer to prepare and the Trustee to adopt and sign a plan of complete liquidation.
