QUALITY AND MEASUREMENT. All Gas delivered by Seller shall meet the pressure, quality and heat content requirements of the Receiving Transporter. The unit of quantity measurement for purposes of this Contract shall be one MMBtu dry. Measurement of Gas quantities hereunder shall be in accordance with the established procedures of the Receiving Transporter.
QUALITY AND MEASUREMENT. 6.1 Gas supplied shall comply with the same standards of pressure and quality as applied to the supply of Gas by Transporter under the Gas Act 1986 and any applicable Statutes and Regulations in force from time to time.
6.2 Crown Gas & Power shall ensure that Transporter or Installer is responsible for the installation, operation and maintenance of each Meter.
6.3 If an AMR Device is installed (which shall be at the Installer’s discretion whether or not there is an AMR Device already on Site) at any time during the Supply Period the Customer shall permit the Installer such access required to install the AMR Device. Such installation shall be at the Installer’s cost. If the Customer requires any data from the AMR Device the Installer reserves the right to charge an additional amount for such information.
6.4 Crown Gas & Power shall, if an AMR Device is installed by them, only rely upon data from their own AMR Device.
6.5 Meter Reading shall be done by Transporter or another person appointed by Crown Gas & Power to take Meter Readings at least once each Contract Year unless where an AMR Device is fitted, in which circumstances a reading may be taken if required.
6.6 If in any Contract Month the Meter is not read or a Meter Reading is not made available promptly to Crown Gas & Power by the Meter Reader or otherwise, by the Customer when no reading has been taken (and there is no AMR Device, or the AMR Device installed is not working either at all or properly), the quantity of Gas taken by the Customer for such Contract Month shall be estimated by Crown Gas & Power based on historical trends. If an invoice covers a period of more or less than one calendar month, then Crown Gas & Power reserves the right to adjust the monthly invoice to reflect such period to coincide with the period and the payment method.
6.7 Customer may request that the Meter be verified for accuracy. Where the Meter is found to register inaccurately then appropriate adjustments to payments shall be made. If the Customer requests that the accuracy of a Meter is verified and the Meter is found to be recording properly, then the Customer shall pay for the cost of the Meter verification.
6.8 The reading shown on the Meter shall be evidence of the quantity of Gas consumed.
6.9 The quantity of Gas consumed in energy terms shall be calculated by methods referred to in Crown Gas & Power’s licence, available on request.
QUALITY AND MEASUREMENT. 5.1. All Product delivered under this Contract shall meet the specification for that Product, if any, set forth in the applicable Confirmation or the Product specification attached thereto. If no Product specification is set forth, all Product delivered under this Contract shall meet the latest GPA specifications for that Product and contain no deleterious substances or concentrations of any contaminants that may make it or its components commercially unacceptable in general industry application.
5.2. All Product delivered shall be measured in the manner customarily utilized and available at the Delivery Location in accordance with one of the alternatives appropriate for the type of transportation as listed below (in order of preference). All measurements and calibrations shall be made in accordance with industry standards.
(i) For deliveries via rail cars, the quantity shall be determined by (a) custody meters, (b) gauging of the rail cars and calculations using official rail car capacity tables, or (c) weighing.
(ii) For deliveries via tank truck, the quantity shall be determined by (a) custody meters, (b) weighing, or (c) slip tube or rotary gauging device and calculations using applicable tank capacity tables.
(iii) For deliveries via pipelines or storage facilities, the quantity shall be determined by calibrated custody transfer meter(s) in accordance with the Carrier’s applicable tariff or governing documents.
(iv) For deliveries via ships or barges, the quantity shall be determined by (a) custody meters, (b) gauging of static shore tanks and calculations using official tank capacity tables, or (c) hand gauging of ships or barges and calculations using official capacity tables by a mutually acceptable independent inspector. Each party shall pay one-half of the independent inspector's fees and charges.
(v) For deliveries via Tank-to-Tank Transfers, the quantity shall be determined by (a) custody meter readings taken at the time of delivery at the storage facility where transfer of title occurs pursuant to Section 8.1 or (b) hand gauging of static tanks and calculations using official capacity tables by a mutually acceptable independent inspector. Each party shall pay one-half of the independent inspector’s fees and charges. QUALITY AND MEASUREMENT. Seller warrants that gas delivered under this Agreement shall meet the quality and measurement standards established by interstate pipeline and/or local distribution companies receiving gas from Seller for Buyer's account at the Point(s) of Delivery.
QUALITY AND MEASUREMENT. Seller warrants that all crude oil purchased ------------------------- hereunder shall be of merchantable quality (that is, unaltered and uncontaminated by any foreign substances or chemicals not normally associated with oil) and suitability shall be determined within the Buyer's exclusive, good faith opinion. Quantities of oil delivered hereunder shall be determined by a method of measurement generally accepted within the industry including, but not limited to, the use of automatic measuring equipment, tank gauges on 100% tank table basis, and certified truck gauges and meters. Meters shall be proven in accordance with the latest American Petroleum Institute standards. Volume shall be measured in barrels of forty-two (42) U.S. Gallons as adjusted for temperature to 60 degrees Fahrenheit, less deductions for basic sediment and water and other impurities determined according to applicable API practices. Oil containing basic sediment and water in excess of the quantity permitted by the carrier's tariff shall be treated by Seller to render it merchantable. Tests for quality shall be made at regular intervals by Buyer or Buyer's Agent in accordance with recognized procedures. Each party shall have the right to have a representative present to witness all tests and measurements but in the absence of either party's representative, the results of the tests and measurements performed by the Buyer shall be deemed to be conclusive.

Deliveries of Gas by Seller to Buyer at the Delivery Point(s) pursuant to this Agreement shall meet the pressure, quality and heat content requirements of the Principal Pipelines as established by the FERC Gas Tariffs for such pipelines, as may be in effect from time to time (“Gas Quality Standard”).
1. It is the obligation of Seller to notify Buyer if Gas to be delivered by Seller to Buyer will not meet the Gas Quality Standard or if Seller has reason to believe that the Gas will not meet the Gas Quality Standard.
2. Buyer shall have no obligation to accept, purchase and pay for Gas that does not meet the Gas Quality Standard. If Buyer knowingly accepts Gas that Seller notifies Buyer in writing fails to meet the Gas Quality Standard, Buyer shall be obligated to pay for such Gas, Seller shall have no liability for Claims arising from such Gas and as to such Gas, Buyer hereby waives all rights under the New York Uniform Commercial Code for acceptance of non-conforming goods.
