Reasons for RIF. The teaching staff shall not be reduced in number except for the following reasons: (1) a decrease in enrollment; (2) for financial difficulties; (3) suspension of schools; (4) regular teachers returning from a leave of absence; or (5) territorial changes affecting the district. Reduction under any circumstances shall not exceed ten (10) for the duration of this contract. Staff positions that are funded by grants will not be included in the limit.
Reasons for RIF. A. RIF may occur only for the following reasons:
1. Decline in student enrollment during the term of this Contract.
2. Return of an employee from a leave of absence.
3. Suspension of schools or territorial changes affecting the District.
4. Finances wherein the need can be demonstrated.
5. Changes in curriculum or course offerings.
Reasons for RIF. If the Board determines it is necessary due to decreased enrollment, return to duty of regular bargaining unit members after leaves of absence, or financial reasons to reduce the number of certified staff positions, the following procedure shall be followed. Prior to any recommendation based upon financial reasons, the Superintendent and Treasurer shall meet with the HEA representatives and discuss the intended recommendation.
Reasons for RIF. If the Board determines it necessary to reduce the number of bargaining unit positions for: (1) Decreased enrollment of pupils in the district;
Reasons for RIF. The School District retains the right to determine when a reduction-in-force layoff is necessary, the number of individuals whose employment must be terminated, and the areas of instruction and/or School District operations within which such reductions in force will occur. The OCEA president will be notified of any such reduction and OCEA will be given opportunity to confer and consult with the District prior to any such reduction.
Reasons for RIF. A reasonable reduction in force may occur for only the following reasons:
A. An overall decline in the enrollment in the three (3) years immediately preceding a planned reduction in force
B. Return to duty of regular teachers from a leave of absence
C. Suspension of schools
D. Territorial changes affecting the District
E. Financial reasons may be utilized under the following circumstances:
1. For any bargaining unit member hired after 6/1/90
2. If the expenditures for salaries and fringe benefits exceeds 84.5% of the year-to- date expenditures for the current fiscal year as of April 30, staff may be reduced for the upcoming fiscal year only to the point that said reduction assists in reducing salary and fringe benefit costs to the 84.5% figure. Once at that point (84.5%), no additional reductions may occur.
F. Elimination or change in program upon one year’s advance notice to the teacher and, if the teacher is not certified/licensed for another teaching assignment, positive assistance to the teacher during that year to help him/her obtain a license in a different teaching field.
Reasons for RIF. A RIF may be caused by:
a. Declining enrollment over a three-year period or persistent low enrollment in a program or discipline.
b. Declining enrollment over a two-year period or persistent low enrollment College-wide
c. Program no longer relevant or expense of program is too great, regardless of enrollment
d. Financial emergency, defined as a significant reduction in general fund revenue (a minimum of $.5 million) or an unanticipated, significant increase in expenses (a minimum of $.5 million). The Office of Institutional Research will provide the Education Association, the Xxxxxxx and Vice President of Academic Affairs, and the Academic Deans with year-end enrollment numbers by program/discipline every August. The Academic Deans will meet with the departments regarding these numbers during Fall Opening Days and discuss strategies for addressing concerns.
Reasons for RIF. A RIF may only occur for the following reasons:
1. Decline in student enrollment
a. “Decline in student enrollment” shall be defined as failure to have a minimum of fifteen (15) students in the junior year programs and a minimum of twelve (12) students in the senior year programs, and, 12 students in senior only programs.
2. Return of an employee from a leave of absence;
3. Suspension of schools or territorial changes affecting the District;
4. Financial reasons.
Reasons for RIF. Reduction in Force shall be defined as that process utilized to reduce the number of Professional Staff Members for the following reasons:
A. decreases in pupil enrollment
B. suspension of schools or territorial changes affecting the District C. return of Professional Staff Members from leaves of absence
Reasons for RIF. A RIF may occur only for the following reasons:
1. Lack of work,
2. Financial reasons,
3. Abolishment of position(s),
4. Return of an employee from a leave of absence, or being released from modified return to work or light duty,
5. Building closure, suspensions of schools, or territorial changes affecting the district. The number of employees affected by RIF shall be kept to a minimum by not employing replacements, insofar as it is practical, for employees who resign, retire, or otherwise vacate a position.
