Bargaining Unit Positions. 8 The Employer recognizes the National Union of Healthcare Workers (NUHW) as the exclusive bargaining agent for all non-supervisory staff Neuropsychologists, Psychologists, Licensed Clinical Social Workers, Marriage and Family Therapists, Licensed Professional Clinical Counselors and Chemical Dependency Counselors I & II, Unlicensed Case Managers, Psychiatric Social Worker Assistants, Marriage and Family Therapist Assistants, Psychological Assistants and Professional Clinical Counselor Assistants who perform clinical work and provide patient care in the Northern California Region. Excluded are Psychologists, Chemical Dependency Counselors, Licensed Clinical Social Workers, Marriage and Family Therapists and Licensed Professional Clinical Counselors who work in supervisory, administrative and/or research capacities or function as Chiefs, Division Chiefs, Coordinators, Sub- Regional Chiefs/Coordinators, students and volunteers.
Bargaining Unit Positions. Appointments to positions within the bargaining unit shall be categorized according to the duration of the position (continuing, recurring, or term) and by the duration of the work assignment required each week (full-time or part-time) as follows: 100% normal work week Continuing, Full-time Recurring, Full-time Term Full-Time > 40% normal work week but < 100% Continuing, Part-time Recurring, Part-Time Term Part-Time
Bargaining Unit Positions. (a) Recognized vacant positions within the bargaining unit that have not been declared redundant will not be absorbed on a permanent basis by positions outside the bargaining unit.
(b) Recognized vacant positions in the bargaining unit created as a result of secondment or temporary transfer of a bargaining unit employee will not be absorbed by management personnel.

Bargaining Unit Positions. An employee temporarily assigned to a position classification in an equal or lower paygrade than his/her permanent position classification shall be paid his/her proper permanent position classification rate. If the employee is temporarily assigned to a position classification having a higher pay grade than his/her permanent position classification, the employee shall be paid as if he/she had received permanent position classification, the employee shall be paid as if he/she received a promotion into such higher pay grade. The Employer shall pay the employee the higher rate for the full time of such assignment.
Bargaining Unit Positions. Any work performed by any position recognized by the District in Article I, Section 1 of this agreement shall only be performed by bargaining unit members unless the District is unable to hire qualified candidates to fill positions. Nothing herein shall be construed to prevent the District from hiring per diem substitute teachers or individuals to perform bargaining unit work on an intermittent basis which does not require the hiring of a regular full-time or part-time employee; nor shall this be construed to prevent the development of an Alternate Learning program governed by suitable alternate contractual provisions mutually agreed to by the District and the Union. Such suitable alternate contractual provisions are expected to include, but are not limited to, the length of the school day, parent-teacher contact, unassigned time, and student case load. It is the expectation of the parties that such alternate learning program in grade 7 – 12 may be staffed through posting and will take effect starting in September, 2011. Displaced teachers shall have the option to refuse placement in the alternate learning program. In that event, the teacher remains on the recall list.
Bargaining Unit Positions. Bargaining unit positions may be regular, cyclic or project positions.
