RESIDENT SAFETY AND PROPERTY LOSS. You and all occupants and guests must exercise due care for your own and others' safety and security, especially in the use of smoke detectors, keyed deadbolt locks, keyless bolting devices, window latches, and other safety or security devices. You agree to make every effort to follow the Security Guidelines on page 6. SMOKE DETECTORS: We will furnish smoke detectors as required by statute, and we will test them and provide working batteries when you first take possession. After that, you must pay for and replace batteries as needed, unless the law provides otherwise. We may replace dead or missing batteries at your expense, without prior notice to you. You must immediately report smoke-detector malfunctions to us. Neither you nor others may disable smoke detectors. If you damage or disable the smoke detector or remove a battery without replacing it with a working battery, you may be liable to us under state statute for $100 plus one month's rent, actual damages, and attorney's fees. If you disable or damage the smoke detector, or fail to replace a dead battery or report malfunctions to us, you will be liable to us and others for any loss, damage, or fines from fire, smoke, or water. CASUALTY LOSS: We are not liable to any resident, guest, or occupant for personal injury or damage or loss of personal property from any cause, including but not limited to: fire, smoke, rain, flood, water and pipe leaks, hail, ice, snow, lightning, wind, explosions, earthquake, interruption of utilities, theft, or vandalism unless otherwise required by law. We have no duty to remove any ice, water, sleet, or snow but may remove any amount with or without notice. Unless we instruct otherwise, you must--for 24 hours a day during freezing weather--(1) keep the apartment heated to at least 50 degrees; (2) keep cabinet and closet doors open; and (3) drip hot and cold water faucets. You will be liable for damage to our and others' property if damage is caused by broken water pipes due to your violating these requirements. If you ask our representatives to perform services not contemplated in this Lease Contract, you will indemnify us and hold us harmless from all liability for those services. Resident agrees to make every eOort to abide by the rules and guidelines in this Lease Contract. Resident is responsible for all damage caused to the premises as a result of the negligence of Resident, its guests and invitees, including but not limited to Pre and glass breakage, and shall be responsible for repair and replacement of any damage caused thereby, regardless of whether the breakage or damage was caused voluntarily, involuntarily, or from vandalism.

If in Landlord’s opinion, the Premises or Property are so damaged as to be unfit for occupancy, and Landlord elects to make such repairs, the rent provided for herein shall xxxxx during the period of time the Premises are not occupied by Resident, but in all other respects the terms and provisions hereof shall continue in full force and effect. In the event that the Premises or the Property are so damaged or destroyed as to be, in the sole opinion of Landlord, incapable of being satisfactorily repaired, then this Agreement shall terminate and Resident shall immediately vacate. In such case, Resident shall pay rent up to the day Resident vacates the Premises. Smoke and Carbon Monoxide Detectors It is the responsibility of Resident to maintain all smoke and carbon monoxide detection devices, including replacement of any batteries. Resident shall not tamper with, remove batteries, or otherwise disable any detection devices. Resident agrees that the smoke & carbon monoxide detectors are functioning at time of move in. Any Resident failing to comply can be fined up to $200.00 in accordance with RCW 48.40.140/WAC 212.10.050. With apartments and condominiums, it is the Resident’s responsibility to investigate whether the building has a fire alarm system, fire sprinkler system, emergency notification plan, emergency relocation plan, or emergency evacuation plan. Resident agrees to read “Security Guidelines for Residents” on page 5 of the lease. Detection Devices – Owner is responsible for furnishing smoke detectors only as required by law. Smoke detectors that are provided at the time of move in are tested and furnished with working batteries. After the possession of the apartment by the resident, resident shall be responsible for replacement of batteries, as needed. Smoke detector malfunctions must be reported to the office.
