RESPONSIBILITIES OF THE TOWN. 8.1 With respect to each RFP and Project authorized by Task Order under this Agreement, TOWN shall: 8.1.1 When it requires FIRM’s Services hereunder, provide an RFP to FIRM. 8.1.2 Provide information to FIRM as to its requirements for Project to enable the FIRM to develop a detailed written Task Order for each requested RFP. 8.1.3 Provide to the FIRM all readily available maps, reports, etc. that may be used in support of the preparation of the Task Order by the FIRM. FIRM shall be responsible for determining the applicability and reliability of all such information and documents. 8.1.4 Provide prompt reviews of the FIRM’s Preliminary Services and other work and will direct changes to reporting as may be deemed necessary by the TOWN. 8.1.5 Designate in writing one or more persons to act as TOWN representative to coordinate the work of each Project with FIRM.

RESPONSIBILITIES OF THE TOWN. A. STAFF SUPPORT OF GPEC EFFORTS: The Town shall provide staff support to GPEC's economic development efforts as follows: 1. The Town shall respond to leads or prospects referred by GPEC in a professional manner within the time frame specified by the lead or prospect if the Town desires to compete and if the lead is appropriate for the Town. When available, the Town agrees to provide its response in the format developed jointly by EDDT and GPEC; 2. The Town shall provide appropriate local hospitality, tours and briefings for prospects visiting sites in the Town; 3. The Town shall provide an official economic development representative to represent the Town on the EDDT, which advises GPEC’s President and CEO; 4. The Town shall cooperate in the implementation of GPEC/EDDT process improvement recommendations including the use of common presentation formats, exchange of information on prospects with GPEC's staff, the use of shared data systems, land and building data bases and private sector real estate industry interfaces; 5. The Town shall use its best efforts to respond to special requests by GPEC for particularized information about the Town within three business days after the receipt of such request; 6. In order to enable GPEC to be more sensitive to the Town's requirements, the Town may, at its sole option, deliver to GPEC copies of any Town approved economic development strategies, work plan, programs and evaluation criteria. GPEC shall not disclose the same to the other participants in GPEC or their representatives; 7. The Town shall utilize its best good faith efforts to cause an economic development professional representing the Town to attend all marketing events and other functions to which the Town has committed itself; and 8. The Town agrees to work with GPEC to improve the Town’s Competitiveness and market readiness to support the growth and expansion of the targeted industries as identified for the Town in Exhibit C (“Targeted Industries). B. RECOGNITION OF GPEC: The Town agrees to recognize GPEC as the Town's officially designated regional economic development organization for marketing the Greater Phoenix region.
RESPONSIBILITIES OF THE TOWN. 8.1 With respect to the SERVICES authorized under this Agreement, TOWN shall: 8.1.1 Provide to the FIRM the conceptual utility layout design prepared by Duke Energy Progress dated July 12, 2017 and North Carolina Department of Transportation as-built drawings of Village Road. 8.1.2 Provide prompt reviews of the FIRM’s SERVICES and direct changes to reporting as may be deemed necessary by the TOWN.
RESPONSIBILITIES OF THE TOWN. Under this agreement, the Town agrees to pay the Commission for costs related to the services specified in Section III at an hourly rate of $50.00.

The Town will use reasonable care when handling and displaying the Work. c. The Town will promptly report evidence of damage to the Work observed by the Town that occurs while the Work is on display, regardless of cause, to the Artist/Lender. d. The Town will not alter, repair, or restore the Work without the written authorization of the Artist/Lender. e. The Town may make emergency repairs to the Work and/or temporarily or permanently remove the Work when the Town, in its sole discretion, finds it necessary to do so to preserve the public health, safety and welfare.

RESPONSIBILITIES OF THE TOWN. (1) The Town shall be responsible for the calculation and collection of the school development impact fee within its jurisdiction from all new residential development, in accordance with the Act, Ordinance No. 2021/ , and the impact fee procedures in Section 82-21 et seq. of the County Code. DRAFT (2) The amount of the school development impact fee shall be based upon the fee in effect at the time of building permit issuance, as established in Ordinance No. 2021/ . (3) No building permit for new residential development shall be issued unless the school development impact fees are paid in full by the applicant, unless the developer has properly asserted and received one or more Developer Rights pursuant to the impact fee procedures in Section 82-21 et seq. of the County Code. (4) The Town shall forward any request made for an exemption or waiver of the development impact fees to the County Director of Planning who shall forward the request to County Council for approval or denial. The Town shall then collect or exempt or waive the fee based on the direction of County Council. (5) Upon the collection of a school development impact fee, the Town shall deposit such fees in a segregated, interest-bearing trust account which is subject to appropriate accounting controls. All interest earned and accruing to the account shall become funds of the account, subject to the same limitations and restrictions on use and expenditure of funds that are applicable to school development impact fee funds. (6) The Town shall transfer to the County the school development impact fees that have been collected by November 1 of each year. (7) Annually or, if deemed advisable, more frequently, the Town shall prepare an annual report in accordance with the impact fee procedures in Section 82-21 et seq. of the County Code. (8) All school development impact fee funds collected by the Town shall be restricted in their appropriation and use in accordance with the Act, Ordinance No. 2021/ , the impact fee procedures in Section 82-21 et seq. of the County Code, the intergovernmental agreement between the County and School Board dated , 2021, and this Agreement. (9) All school development impact fee funds returned to the Town from the School Board due to the School Board’s failure to expend the fees within the time limits established by state law and the impact fee procedures in Section 82-21 et seq. of the County Code, shall be refunded to the appropriate feepayers. RESPONSIBILITIES OF THE TOWN. The Town shall be responsible for the design, any needed right of way/easement acquisition and construction of the Off-Site Road Improvements, to be completed in a commercially reasonably time, no later than five years from the date hereof. The Town furthermore agrees to be responsible for all remaining costs for the Off-Site Road Improvements in excess of the Contribution.
