Responsibility for End Users. You agree to be responsible for all billing and collection from end users and that you will pay us on a timely basis, regardless of whether you collect payment from end users. You agree to be responsible for all communications to and business relations with end users. You shall be responsible for providing all technical and business support related to DiaLinx Service access for end users, including but not limited to responding to inquiries and questions, hot-line support, problem resolution, providing system configuration, installation and support, as applicable and other such services and shall maintain an organization which is highly trained and qualified to provide such support. You are responsible for authenticating and authorizing access by your end users to DiaLinx Service. Unless you have purchased optional RADIUS hosting services from us, you shall install, operate, and maintain a dedicated RADIUS server meeting the RADIUS specifications published in Internet RFC 2138 and 2139 and all published derivative RFSs. Our RADIUS server will prompt each end user for the end user's identification and password, and poll your RADIUS server for access information. Unless otherwise provided for in the Quotation, we will support only one authentication realm (e.g. xxxxxxxxxxx.xxx).
Responsibility for End Users. Some Cloud Products require users to be designated by Administrators; You are responsible for understanding the settings and controls for each Cloud Product you use and for controlling whom you allow to become an End User. Please note that you are responsible for the activities of all your End Users, especially how End Users use Your Data, even if those End Users are not from your organization or domain.
Responsibility for End Users. Customer shall be responsible for the activities of End Users. Customer shall enter into agreements with End Users with respect to the access of the Services on Customer Properties and provide all applicable privacy notices and disclosures to End Users as required by Applicable Law. Qualified may investigate any complaints or activities that come to its attention with respect to an End User’s violation of Applicable Law or harmful or offensive conduct and may take any action that it believes is appropriate, including, but not limited to issuing warnings, removing inappropriate content, or terminating End User profiles. Where commercially reasonable, Qualified will provide Customer with 72 hours prior written notice and an opportunity to cure before taking of any proposed action under this Section 3.6.
Responsibility for End Users. Where agreed in Customer's contract with Virtustream, Customers may extend access to the Virtustream Infrastructure and Services to their end users. Where this is done, it is the Customer's responsibility to ensure that all of its end users comply with this AUP.
Responsibility for End Users. You shall be solely responsible for providing your services, technical support, pricing and service plans, billing and collections, and any and all other services to your end-users, and Rogers shall have no obligations or liability whatsoever to End-users in relation to the Colocation Services.

If You become aware of any violation of this Agreement in connection with use of the Services by any person, please contact Fluency, Inc. at xxxxxxx@xxxxxxxxxx.xxx Fluency, Inc. may investigate any complaints and violations that come to its attention and may take any (or no) action that it believes is appropriate, including, but not limited to issuing warnings, removing the content or terminating accounts and/or User profiles. Under no circumstances will Fluency, Inc. be liable in any way for any data or other content viewed while using the Services, including, but not limited to, any errors or omissions in any such data or content, or any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to any data or content.
Responsibility for End Users. You are responsible for the activities of end users who access or use the Services through your account. Kyron may investigate any complaints or activities that come to its attention and may take any (or no) action that it believes is appropriate, including, but not limited to issuing warnings, removing content, or terminating accounts and/or end user profiles. Where commercially reasonable, Kyron will provide Customer with 24 hours prior written notice and an opportunity to cure before taking of any proposed action under this Section 3.3. Under no circumstances will Kyron be liable in any way for any video or other content viewed while using the Services.
Responsibility for End Users. Customer shall implement sufficient policies, procedures or agreements to ensure compliance with Customer’s obligations in this agreement by all persons who have access to Products as a result of this agreement. Customer shall promptly notify Orbita in writing upon its discovery of any unauthorized use of the Products or infringement of Orbita’s proprietary rights therein.

FLUENCY, INC. OBLIGATIONS FOR CONTENT. Fluency, Inc. will maintain reasonable physical and technical safeguards to prevent unauthorized disclosure of or access to Content, in accordance with industry standards. Fluency, Inc. will notify You if it becomes aware of unauthorized access to Content. Fluency, Inc. will not access, view or process Content except (a) as provided for in this Agreement and in Fluency, Inc.’s P rivacy Statement; (b) as authorized or instructed by You, (c) as required to perform its obligations under this Agreement; or (d) as required by Law. Fluency, Inc. has no other obligations with respect to Content.
