Retail Service. Reliability (a) We will use our best endeavours to provide you with a water flow rate to meet your reasonable needs. Please note that, for some customers, the flow rate may not be sufficient for all purposes without the provision of additional on-site water infrastructure. You are responsible for arranging and covering the costs of such additional onsite water infrastructure, which must be installed by an appropriately licensed plumber. (b) We will notify you under clause 22.3 if, due to the special characteristics of your water retail service, we are unable to provide you with such a flow rate.
Retail Service. Weston WSC is the holder of a water CCN that includes portions of the area currently located within the Municipality and portions of the Property. Further, Weston WSC currently owns and operates a water supply and distribution system (the “WWSC System”) that serves a portion of the Municipality. North Collin Special Utility District (“NCSUD”) currently owns and operates a water supply and distribution system (the “NCSUD System”) to service, among other areas, a portion of the Municipality. The Parties agree that the Municipality ultimately shall be the exclusive retail water provider for all land within the Municipality (including the Property) and agree to reasonably cooperate to achieve that end. Notwithstanding the foregoing, the Parties intend that fresh water supply may initially be provided by NCSUD to that portion of the Property located north of C.R. 206 and east of F.M. 543, depicted in the attached Exhibit “N” hereto (“SE Sector”). The Parties agree to cooperate together and with NCSUD to allow NCSUD to provide water to the SE Sector until such time as the Municipality has developed the necessary infrastructure and capacity to fully serve the SE Sector. At that time, all NCSUD infrastructure and rights for the SE Sector will be transferred to the Municipality. Owner shall be responsible for all costs incurred to enable the NCSUD to serve the SE Sector.
Retail Service a) The Retail Service to commence on July 1, 2018, and continue through June 30, 2024. b) The Retail Service that Lifetime Tennis Inc., DBA Lifetime Activities Inc. will be offering at the Cupertino Sports Center will consist of the following: • Racquet restringing for tennis and racquetball racquets. • Grip- build-up service • Various accessories for tennis racquets (grips, vibration dampers, etc.) • Tennis racquet demo program and tennis racquet sales • Table tennis paddles • Pre-packaged food and beverages. c) The Retail Service will be located in the existing pro shop space located next to the lobby of the Cupertino Sports Center. d) Hours of Operation • Monday-Saturday8:00 a.m. – 9:30 p.m. • Sunday 8:00 a.m. – 8:00 p.m. Any changes to the hours of operation must be authorized by the City representative. e) Monthly Financial Statements – No later than fifteen (15) days after the end of each month Lifetime Tennis Inc., DBA Activities Inc. shall submit to the City of Cupertino a written statement for the preceding month showing the gross revenue and expenses for the Retail Service. f) Court Maintenance - Lifetime Tennis Inc., DBA Lifetime Activities Inc. is to provide at its own expense, weekly maintenance services for all 18 tennis courts at the Cupertino Sports Center. This service is to include biweekly court washing and alternating biweekly court blowing/sweeping. In addition, Lifetime Tennis Inc., DBA Lifetime Activities Inc. will provide all necessary materials to provide these maintenance services. Materials include, but are not limited to, court washing wands, industrial grade hoses, hose carrier cart, portable air blower, and toolkit.
Retail Service. Seller agrees that it will purchase solely from the District under the applicable District Rate Schedule all electrical power needed to operate it its facilities from the District, and that the entire Electrical Output of the Generator will be sold to the District pursuant to this Agreement.
Retail Service. Telecommunications services that FTC provides to end user customers as described in FTC’s General Subscriber Services Tariff.
Retail Service. (i) Weston WSC is the holder of a water CCN that includes portions of the area currently located within the Municipality and portions of the Property. Further, Weston WSC currently owns and operates water supply and distribution system (the “WWSC System”) that serves a portion of the Municipality. Further, North Collin County Water Service Corporation (“NCCWSC”) currently owns and operates a water supply and distribution system (the “NCCWSC System”) to service, among other areas, a portion of the Municipality. The Parties desire the Municipality to be the exclusive retail water provider for all of the area within the Municipality, and agree to reasonably cooperate to achieve that end through: the purchase and expansion of the WWSC System; or securing a dual certification agreement under Section 13.248, Texas Water Code, and construction of a separate water supply and distribution system to serve the Property. (ii) At such time as the Parties have mutually agreed upon a plan and process for the designation of the Municipality as the retail water provider within the area of the Municipality, the Districts shall participate with the Municipality in such effort, including funding such activities on a mutually agreeable basis pursuant to the Utility Infrastructure Agreement and the allocation of water supply capacity to the Property.
Retail Service. (i) The Municipality has applied for the Sewer CCN to provide retail sewer service to the current area within the Municipality and the Property. The Parties agree to reasonably cooperate to secure the Sewer CCN and the Municipality’s designation as the exclusive retail sewer service provider for the area within the Municipality and the Property. The Parties also agree to provide for the construction of a wastewater treatment plant (“WWTP”) with an initial phase of 300,000 gallons per day (“gpd”), and a final phase of 350,000 gpd. The WWTP is currently proposed to be located approximately 1.6 miles east of the intersection of FM 2478 and FM 170 at the intersection of FM 170 and Honey Creek. The Municipality has applied to the TCEQ for a waste discharge permit (“WWTP Permit”), and for the Sewer CCN. (ii) Pursuant to an “Agreement by and between City of Weston and Land Advisors, LTD”, dated August 10, 2004 (the “Initial Developer Funding Agreement”), as subsequently amended, the Owner has agreed to advance to the Municipality all funds necessary for, among other things, the preparation, filing, processing, and securing the issuance of the applications for the WWTP Permit and Sewer CCN. Upon the creation of the District, the Parties acknowledge and agree that such funding obligation shall be assigned to and assumed by the District. Further, the District shall assume the responsibility for the design and construction of the WWTP on behalf of the Municipality in accordance with the process and procedures set forth in Article VII hereof. Consequently, it is understood and agreed by the Owner and Municipality that within 30 days from the District Creation Date, the Owner and District shall enter into an Operating Cost and Utility and Road Construction/Acquisition Financing Agreement (“Utility Infrastructure Agreement”) substantially in the form attached hereto as Exhibit “K”. The Parties acknowledge and agree that the final form of the Utility Infrastructure Agreement will be revised to reflect the provisions of the Texas Water Code pursuant to which the Original District was formally created, its statutory authority and powers, and the facilities and improvements that it will acquire and convey to the Municipality, and County, if applicable. Retail Service. Weston Water Supply Corporation ("WWSC") is the current holder of a water CCN that includes portions of the area currently located within the Municipality and portions of the Property. North Collin Special Utility District ("NCSUD") currently owns and operates a water supply and distribution system that serves a portion of the Municipality and holds a CCN on a portion of the Property. Notwithstanding the foregoing, the parties will use reasonable best efforts to enter into an agreement with NCSUD to provide water service to the portion of the Municipality located north of County Road 206 and East of FM 543.

  • Mail Service The Union shall be permitted to use the State inter and intra-office paper mail system. This usage shall be limited to matters that involve the Union and the Employer. It is not to be used for the purpose of mass mailings to membership and/or bargaining unit employees. The Employer agrees not to open employee union mail when clearly marked as such. Where security is of concern, the mail shall be opened in the presence of the addressee. When feasible, and where equipment is currently available, Union stewards and/or officers may utilize electronic mail and/or facsimile equipment solely for contract enforcement and interpretation and grievance processing matters. Such transmissions will be primarily to expedite communication regarding such matters, will be reasonable with respect to time and volume, and limited to communications with the grievant, if any, appropriate supervisors and employee’s staff representatives. Long distance charges which may be incurred must be approved prior to transmission.

  • Universal service 1. Each Party has the right to define the kind of universal service obligations that it wishes to maintain. 2. Each Party shall administer any universal service obligation that it maintains in a transparent, non-discriminatory, and competitively neutral manner and shall ensure that its universal service obligation is not more burdensome than necessary for the kind of universal service that it has defined.

  • Verizon Retail Telecommunications Service Any Telecommunications Service that Verizon provides at retail to subscribers that are not Telecommunications Carriers. The term “Verizon Retail Telecommunications Service” does not include any Exchange Access service (as defined in Section 3(16) of the Act, 47 U.S.C. § 153(16)) provided by Verizon.

  • Electrical Service Electrical service for new construction or a renovated existing building shall be 480/277-volt, 3-phase, 4-wire or approved equal. Service shall be sized for HVAC and other mechanical system(s) loads, lighting, general building services, and dedicated computer based office equipment loads. 5 xxxxx per square foot shall be provided for lighting and general service receptacles. Size of neutral conductor of 3- phase circuits shall be twice that of phase conductor to accommodate potential harmonic currents associated with computer system electronic power supplies and fluorescent lighting fixtures electronic ballasts.

  • Our Service The services that you have selected and the charges for those services are confirmed in Section 9 - Your Consent at the end of this agreement. We agree to provide the services selected and you agree to pay us for those services. Any advice or recommendation that we offer to you, will only be given after we have assessed your needs and considered your financial objectives and attitude to any risks that may be involved. We will also take into account any restrictions that you wish to place on the type of products you would be willing to consider.

  • CLOUD SERVICE The Cloud Service offering, is described below and is specified in an Order Document for the selected entitled offerings. The Order Document will consist of the Quotation that is provided and the Proof of Entitlement (XxX) you will receive confirming the start date and term of the Cloud Services and when invoicing will commence.

  • Food Service If the Charter School offers food services on its own or through a third-party contract, the Charter School may apply directly to, and if approved, operate school nutrition programs with reimbursement from the United States Department of Agriculture, under supervision of the Tennessee Department of Education.

  • Customer Service A. PRIMARY ACCOUNT REPRESENTATIVE. Supplier will assign an Account Representative to Sourcewell for this Contract and must provide prompt notice to Sourcewell if that person is changed. The Account Representative will be responsible for: • Maintenance and management of this Contract; • Timely response to all Sourcewell and Participating Entity inquiries; and • Business reviews to Sourcewell and Participating Entities, if applicable.

  • Professional Service Consultant agrees that all services and work performed under this agreement will be accomplished in a professional manner, in accordance with the accepted standards of Contractor’s profession.

  • Verizon OSS Services Access to Verizon Operations Support Systems functions. The term “Verizon OSS Services” includes, but is not limited to: (a) Verizon’s provision of ECI Usage Information to ECI pursuant to Section 8.3 of this Attachment; and, (b) “Verizon OSS Information”, as defined in Section 8.1.4 of this Attachment.
