Rights to Use Common Facilities. Subject to Landlord’s right to change or alter any of the following in Landlord’s reasonable discretion as herein provided, Tenant shall have, as appurtenant to the Premises, the non-exclusive right to use in common with others, subject to reasonable rules of general applicability to tenants of the Building from time to time made by Landlord of which Tenant is given notice (a) the common lobbies, corridors, stairways, elevators and loading platform of the Building, and the pipes, ducts, conduits, wires and appurtenant meters and equipment serving the Premises in common with others, (b) common walkways and driveways necessary for access to the Building, and (c) if the Premises include less than the entire rentable floor area of any floor, the common restrooms, corridors and elevator lobby of such floor. Notwithstanding anything to the contrary herein, Landlord has no obligation to allow any particular telecommunication service provider to have access to the Building or to the Premises except as may be required by applicable law. If Landlord permits such access, Landlord may condition such access upon the payment to Landlord by the service provider of fees assessed by Landlord in its sole discretion. Landlord shall provide notice to Tenant in the event of any change in the providers servicing Tenant at the time of such change.

Provided the named Tenant herein is occupying and has not sublet more than 50% of the of the aggregate rentable square footage of the Phase I Premises and the Phase II Premises (other than to a Permitted Transferee), and continues to use and occupy the Phase I Premises and the Phase II Premises (or that portion thereof not subleased), Landlord shall continue to operate during the Term of this Lease (i) the café or an alternative food-service in the Building; and (ii) a fitness center in the building at 0000 Xxxxxx Xxxxxx or in the Building; provided, however, Landlord’s foregoing obligations are subject to temporary shut-downs due to Force Majeure or renovations. Notwithstanding anything to the contrary herein, Landlord has no obligation to allow any particular telecommunication service provider to have access to the Building or to the Premises except as may be required by applicable law. If Landlord permits such access, Landlord may condition such access upon the payment to Landlord by the service provider of fees assessed by Landlord in its reasonable discretion.

Rights to Use Common Facilities. Subject to the Building’s and the Office Park’s rules and regulations set forth on Exhibit F hereto, and all other applicable provisions herein, Tenant shall have, as appurtenant to the 18 Cxxxxx Premises and the 14 Cxxxxx Premises, as applicable, rights to use in common, subject to reasonable rules of general applicability, of which Tenant is given prior written notice the following (as applicable): (a) the common lobbies, corridors, stairways and elevators of the Building, and the pipes, ducts, conduits, wires and appurtenant meters and equipment serving the Premises in common with others, (b) common walkways and loading docks necessary for access and egress to and from the Building, (c) if the Premises include less than the entire rentable floor area of any floor, the common toilets, corridors and elevator lobby of such floor, (d) the parking lot, to the extent and in the location designated by Landlord herein, (e) the cafeteria located in the Office Park, so long as Landlord continues to offer Tenant use of a cafeteria at the Office Park, which offering Landlord may modify or cancel at any time at its sole discretion, and (f) subject to Section 2.2.1 below, the Fitness Center (as hereinafter defined) located in the Office Park.

Rights to Use Common Facilities. Tenant shall have, as appurtenant to the Premises, rights to use in common, subject to reasonable rules of general applicability to tenants of the Building from time to time made by Landlord of which Tenant is given notice: (a) the common lobbies, corridors, stairways, elevators and loading platform of the Building, and the pipes, ducts, conduits, wires and appurtenant meters and equipment serving the Premises in common with others, (b) common walkways and driveways necessary for access to the Building, (c) the common toilets, corridors and elevator lobbies of any floor in the Building, and (d) the common parking facilities adjacent to the Building (Tenant hereby acknowledging that (i) parking is available on a first-come, first-served basis only, (ii) Tenant, its employees, agents, contractors and invitees shall not be entitled to use at any time in excess of 2.5 parking spaces per 1,000 square feet of Rentable Square Feet of the Premises, (iii) Landlord shall have the right upon prior written notice to Tenant to designate exclusive and/or reserved parking areas, and (iv) Landlord shall have the right upon at least thirty (30) days prior written notice to Tenant to institute measures reasonably necessary to enforce the foregoing); and no other appurtenant rights or easements.
