S tep 2. If the grievance is not resolved at Step 1, it shall be submitted in writing by the Union to the Superintendent of Public Works. The grievance shall be signed by the aggrieved employee and a Union representative. It shall state the nature of the grievance, the sections of the Contract allegedly violated, and the specific remedy sought. The parties shall then schedule a meeting to discuss the grievance. Within ten (10) working days after the meeting, the Superintendent or Director shall officially respond to the grievance in writing to the Union xxxxxxx and the grievant with a copy to the WSCCCE Staff Representative. All Disciplinary or Class Action grievances shall be initially filed at Step 2. Class Action grievances shall be defined as a grievance that is filed by the Union on behalf of a “class” or group of affected employees.

S tep 2. (Executive Director) Within ten (10) days of receipt of the decision of the Director, the grievance may be advanced to Step 2 by submitting to the Executive Director or designate, a copy of the original grievance with a letter indicating that the grievance has not been resolved. Upon receipt of the grievance, a meeting, which may be arranged by either party, shall occur within ten (10) days of the date of the letter. The Employer shall render a decision, in writing, to be forwarded to the Union and the grievor within ten (10) days of the date of the meeting.

S tep 2. Within ten (10) work days after receiving an answer from the Assistant Administrator, if the grievance has not been satisfactorily resolved, the Union President or alternate, and the aggrieved Employee shall file a written appeal consisting of the original grievance, the disputed answer of Step 1, and any additional relevant documentation with the Administrator/Sheriff. The Administrator/Sheriff shall call a meeting with the parties involved to hear arguments. Such meeting shall be scheduled within ten (10) work days upon receipt of the appeal. The Administrator/Sheriff shall then render a written decision within ten (10) work days of the meeting. Copies of the written decision shall be forwarded to the Grievant and Union President.
S tep 2. If a grievance is not resolved in Step 1, it shall be reduced to writing on a mutually acceptable grievance form and must be submitted to the Employer' s Administrator/Designee within fourteen (1 4) calendar days of the action or event which precipitated the grievance. Grievances regarding wage provisions of this Agreement shall be timely if submitted within thirty (30) calendar days after the regular pay day of the period in which the alleged violation occurred. Grievances relating to disciplinary actions or discharges shall be timely if submitted to the Employer within seven (7) calendar days of notice of the disciplinary action or discharge. The Employer' s Administrator/Designee shall meet with the Union' s Representative or Designee in an attempt to resolve the grievance within fourteen (1 4) calendar days of receipt of a written grievance. The Employer or Union shall have fifteen (15) calendar days after receipt of a written grievance, to respond in writing to the grievance.

  • Step 2 (a) If the grievance is not resolved at Step 1, the grievant or designated representative may submit the grievance in writing on a grievance form as contained in Appendix B of this Agreement, to the Agency Head or designated representative within 15 days following receipt of the decision at Step 1. The grievance form must contain the same information as the grievance filed at Step 1. The grievance shall include a copy of the grievance form submitted at Step 1, together with the written response and documents in support of the grievance. (b) The Agency Head or designated representative shall communicate a decision in writing to the grievant and the PBA Grievance Representative, if any, within 15 days following receipt of the written grievance. If the Agency Head fails to respond within the time limit, it shall be deemed a denial. (c) If a grievance, alleging that a disciplinary action (reduction in base pay, demotion, involuntary transfer of more than 50 miles by highway, suspension, or dismissal) was taken without cause, is not resolved at Step 2, the PBA representative, or the grievant or grievant’s representative, if not represented by PBA, may appeal the grievance to arbitration as provided in Article 6, Section 3(G)(4), below, within 15 days after receipt of the Step 2 decision.

  • Contract Distribution The Employer will provide all current and new employees with a link to the new Agreement. Each department or unit will maintain a paper copy of the contract accessible to all employees.

  • Distribution Upgrades The Connecting Transmission Owner shall design, procure, construct, install, and own the Distribution Upgrades described in Attachment 6 of this Agreement. If the Connecting Transmission Owner and the Interconnection Customer agree, the Interconnection Customer may construct Distribution Upgrades. The actual cost of the Distribution Upgrades, including overheads, shall be directly assigned to the Interconnection Customer. The Interconnection Customer shall be responsible for its share of all reasonable expenses, including overheads, associated with owning, operating, maintaining, repairing, and replacing the Distribution Upgrades, as set forth in Attachment 6 to this Agreement.
