Seniority List for EC/FE teachers. On or before December 1 of each year, the Employer will prepare and deliver to the Union one copy of a separate seniority list for individuals on the roster of eligible EC/FE teachers who have completed a probationary period of three consecutive full school years with the Edina School District. Seniority will be based upon continuous and unbroken employment with the Employer as an EC/FE teacher during consecutive school years and shall be measured from the first day of actual service in the bargaining unit under the most recent period of continuous employment. Teachers with identical seniority dates shall have seniority based on the date and listing order in which their individual contract was approved by the school board. All individual signed contracts will be time-stamped upon receipt by the office of the Director of Human Resources, and listed on the seniority list in the order in which their signed contracts were received. In the event that the contracts of teachers with identical seniority dates have not been time-stamped as stated above, seniority shall be based on file folder number, the lowest number listed on their teaching license issued by the Minnesota Department of Education, Personnel Licensing Department receiving the more favorable seniority position. For purposes of this Article, an EC/FE teacher shall be deemed to have had continuous and unbroken employment for a school year only if such EC/FE teacher actually performed services as a bargaining unit member for the Employer on at least 90 duty days in a school year. Any EC/FE teacher may challenge the correctness of the information contained in the seniority list. In the absence of a grievance filed within 30 calendar days from the date of mailing to the Union, the seniority list shall be deemed to be conclusively correct. Long-term substitutes and other hourly-paid teachers will not be placed on the EC/FE seniority list.
