SEPERATION OF EMPLOYEMENT. 9.1 Upon involuntary separation of employment for any reason all regular full-time and regular part-time employees shall receive severance pay for: 9.1.1 Accrued and unpaid vacation leave up to two hundred forty (240) hours 9.1.2 Overtime for which pay was authorized 9.1.3 Any Compensatory time on the books at the time of termination shall be taken as paid leave as the employee’s regular work days would normally occur prior to the termination date. 9.1.4 No sick leave shall be paid in the event of involuntary separation for disciplinary termination. 9.2 Upon separation of employment, other than retirement, the employee’s lump sum pay out shall be limited to three hundred (360) hours of vacation leave. Any time in excess of three hundred sixty (360) hours shall be paid in lieu of time worked as the work days would normally occur. An employee whose separation is due to retirement shall be limited to three hundred sixty (360) hours, as of his termination date of employment. Provided, that from April 1st, 2014 until December 30th, 2016 vacation cash out during those dates shall be two- hundred and forty (240) hours to assist the City in switching accounting systems. Effective on December 31st, 2016 this vacation cash out shall return to three-hundred and sixty (360) hours as provided for in this section. Upon separation of employment, employees shall receive a lump sum payment equal to twenty-five (25%) percent of their accrued but unused sick leave. In the event that an employee dies while employed but prior to retirement, the City shall pay the employees spouse or estate twenty-five (25%) of the employees accrued but unused sick leave. In Addition, employees who voluntary separate from service shall receive all unpaid overtime and all accrued but unused compensatory time. 9.3 In case of death of an employee, such compensation shall be made to the next of kin of the deceased in accordance with state statute (Title 11 RCW). 9.4 A lapse in service of an employee for a period of time longer than thirty (30) working days by reason of resignation or discharge shall serve to eliminate the accumulated length of service of such employee for sick leave and annual leave benefits and compensation. Such employee thereafter reentering the service of the Employer shall be considered a new employee.

  • Location of Employment The Executive's principal place of business shall continue to be at the Company's headquarters to be located within thirty (30) miles of Doylestown, Pennsylvania; provided, that the Executive acknowledges and agrees that the performance by the Executive of his duties shall require frequent travel including, without limitation, overseas travel from time to time.

  • Separation of Employment (a) If an employee is discharged he shall be paid in full for all monies owing him on the date of his discharge. If an employee quits the Employer may withhold payment for five (5) calendar days.   • Compensation of Employee Employer shall pay Employee, and Employee shall accept from Employer, in full payment for Employee's services hereunder, compensation as follows:

  • Duration of Employment 5.1 A seafarer shall be engaged for the period specified in Appendix 1 to this Agreement and such period may be extended or reduced by the amount shown in Appendix 1 for operational convenience.   • Termination of Employment Executive's employment hereunder may be terminated under the following circumstances:

  • Compensation of Employees Compensate its employees for services rendered at an hourly rate at least equal to the minimum hourly rate prescribed by any applicable federal or state law or regulation.

  • Termination of Employees Agent may in its discretion stop using any Retained Employee at any time during the Sale, subject to the conditions provided for herein. In the event that Agent desires to cease using any Retained Employee, Agent shall notify Merchant at least seven (7) days prior thereto, so that Merchant may coordinate the termination of such employee; provided, however, that, in the event that Agent determines to cease using an employee “for cause” (which shall consist of dishonesty, fraud or breach of employee duties), the seven (7) day notice period shall not apply, provided further, however, that Agent shall immediately notify Merchant of the basis for such “cause” so that Merchant can arrange for termination of such employee. From and after the date of this Agreement and until the Sale Termination Date, Merchant shall not transfer or dismiss Retained Employees except “for cause” without Agent’s prior consent. Notwithstanding the foregoing, Agent shall not have the right to terminate the actual employment of any Retained Employee, but rather may only cease using such employee in the Sale and paying any Expenses with respect to such employee.

  • Voluntary Termination of Employment If during the Employment Term, Executive terminates his employment under circumstances other than those specified elsewhere in this Section 8, Executive shall be entitled to the payments and benefits specified in Section 8(a).
