SERVICE AND WARRANTY. When specified, the bidder/proposer shall define all warranty, service and replacements that will be provided. Bidders/Proposer must explain on the Response to what extent warranty and service facilities are available. A copy of the manufacturer’s warranty, if applicable, should be submitted with your response.
SERVICE AND WARRANTY. 10.1 NovaCare acknowledges that the Products require installation, warranty and nonwarranty service, and maintenance by skilled, trained and fully qualified Nautilus technicians (other than maintenance to be performed by the end user in accordance with Nautilus' recommended maintenance instructions). NovaCare will not, and will cause the Representatives to not, engage in any installation, service, or maintenance of the Products.
10.2 NovaCare agrees to indemnify, defend and hold harmless Nautilus for and against any claim or cause of action, including without limitation any claim for loss or damages resulting from a voided warranty, arising solely out of any violation of this subparagraph by NovaCare or any Representative.
10.3 The Nautilus new product Limited Warranty is as may be provided with the Products by Nautilus from time to time (the "Limited Warranty"). Nautilus agrees to double the normal term of the Limited Warranty applicable to each Product sold hereunder, provided that such doubling of the normal term shall apply to a particular Product only so long as it remains installed in the location in which it is first installed following sale hereunder. Nautilus reserves the right at any time to amend or modify its warranty policy, including any limitations or exclusions applicable thereto. All used or refurbished Products are sold "as is" and no Nautilus warranty shall apply thereto. THERE ARE NO OTHER WARRANTIES WHICH EXTEND BEYOND THE FACE OF THE LIMITED WARRANTY. ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND FITNESS FOR USE, ARE EXCLUDED.
SERVICE AND WARRANTY. The student is obligated to deliver the PC to IT technical personnel for necessary upgrades, repairs, and service. If the student or others tamper with the PC, the consequence will be the loss of the warranty. This may trigger liability for the student. If necessary, the school will provide the necessary equipment for the student. The student must report warranty cases continuously, and no later than June 20th of the third school year after the agreement was entered into. This also applies to damage to any loaned PC.

SERVICE AND WARRANTY. NBO will maintain and repair the Counter Unit in a good and safe working order and condition, and in accordance with manufacturer's recommended instructions and procedures and the requirements of any applicable insurance or manufacturer's warranty and of any governmental authority having jurisdiction over the Counter Unit during the Term of this Agreement. NBO will provide, at its own expense, all service, inspection, substitutions, materials and labor necessary for the proper use, repair, operation and maintenance of the Counter Unit. In addition, NBO will provide technical support, as well as training of Owner's employees, agents and contractors in all aspects of the use of the Counter Unit, at all times during the Term of this Agreement. All obligations of NBO under this Paragraph 5 shall continue during any extension of this Agreement. NBO warrants that repair and maintenance performed by NBO under this Agreement will be performed competently and in accordance with industry practices, and the Counter Unit and service parts furnished by NBO will be free of defects in material and manufacture upon installation thereof at the Center. Owner will grant to NBO personnel full and free access to the Counter Unit to provide installation, operation, maintenance, repair and training services (subject to Owner's security regulations), including, but not limited to, telephone and electrical service and all related wiring and necessary systems related thereto.
SERVICE AND WARRANTY. The standard of care for all professional engineering, consulting and related services performed or furnished by CONSULTANT and its employees under the Contract will be the care and skill ordinarily used by members of CONSULTANT’s profession. CONSULTANT makes no warranties, express or implied, under the Contract or otherwise, in connection with CONSULTANT’s services.

Distributor undertakes to provide, at its own cost, such installation, training and service as may be necessary, at the highest possible standards. Without derogating from the generality of the above, Distributor agrees that all support, maintenance and training obligations contained in any trial agreement or maintenance agreement shall be the sole responsibility of Distributor and performed at Distributor’s own cost.
6.2 Manufacturer does not warrant that the functions contained in the Manufacturer’s Products will meet the requirements of end-users or that the operation of Manufacturer’s Products will be uninterrupted or error free.
6.3 Manufacturer warrants that the Products, only if used, installed and maintained according to Manufacturer’s instructions, shall be free from defects in material and/or workmanship. The warranty shall remain in force for a period of 1 (one) year after delivery of the Products by Distributor to end-customers.Upon receiving the failed products together with a filled form stating all the relevant facts, the manufacturer agrees to replace the failed products free of xxxxxx.Xx this respect the Distributer will not bear the costs related to the product liability and warranty.
