Services for Students with Disabilities. For CCAP classes offered on ACE Charter high school during the school day, ACE will continue to provide services as required by the participating student's Individualized Education Plan ("IEP"). VCCCD will make reasonable accommodations to ensure that ACE is able to implement the student's IEP in CCAP classes.
Services for Students with Disabilities. A. Services for Students with Disabilities (SSD) will provide assistance to help students receive the accommodations necessary to facilitate their learning. A variety of accommodations to meet different learning and classroom needs are available.
B. Students with disabilities who wish to request accommodations must initiate the request personally with Fresno State SSD.
C. Verification of the eligibility of Fresno State students with disabilities for accommodation and determination of appropriate is solely the responsibility of SSD.
D. SSD will give the student a copy of the California State University Board of Trustees Policy on Disability Support and Accommodations - Executive Order Number 926.
E. Communication with professors for accommodations for Fresno State students will be prepared by SSD.
Services for Students with Disabilities. 16.1. At all times during the Term of the Charter and this MOU, the Charter School shall be its own local education agency (“LEA”) as a member of a Special Education Local Plan Area (“SELPA”), or as a duly constituted SELPA approved by the State of California. As specified in Schedule A, SPA shall provide CCCOE with a copy of the Local Plan and documentation of the status of SPA as an LEA in good standing with a state- approved SELPA or as a state- approved SELPA.
16.2. SPA shall assume all responsibility, including but not limited to full financial responsibility, for the implementation of educational services under the Individuals with Disabilities Education Act and Section 504 of the Rehabilitation Act, for all students who are enrolled in SPA.
16.3. SPA may contract with any school district or other qualified organization for other services on behalf of SPA, provided that such services are at no cost to the County Board and/or CCCOE. It is further recognized that SPA may contract with a SELPA, employ its own staff and/or contract with other vendors to deliver services required by the IEPs and/or Section 504 Plans of students enrolled in SPA and as otherwise required by applicable state and federal laws.
16.4. As specified in Schedule A, SPA shall provide special education revenue and expense schedules to the CCCOE. SPA shall be responsible for any and all costs related to SPA students.
16.5. SPA agrees to fully and promptly comply with any reasonable requests for information made by the County Board and CCCOE with regard to special education services and individual students at SPA. The CCCOE may establish regular meetings with SPA special education coordinator for purposes of reviewing special education and/or Section 504 compliance. The CCCOE may also take action to monitor SPA to ensure that special education and/or Section 504 services are being provided as required by law and applicable SELPA policy.
16.6. In the event that CCCOE, County Superintendent, or the County Board is named as a party in any claim or suit against SPA, SPA agrees to indemnify, defend and to hold harmless the County Board, the County Superintendent, the Contra Costa County Office of Education, and each of their officers, directors, agents, and employees, from and against any and all costs, including attorney's fees, and/or awards related to complaints, due process hearings, mediations or any and all forms of litigation relating to special education and/or Section 504 matters ...
Services for Students with Disabilities. 2.2.1 Provided that the School becomes a member of a SELPA, the School shall be categorized as a local education agency (LEA) for the purpose of providing special education services to students of the School. As set forth in Education Code sections 47640, 47641 and 47644, the School, serving as an LEA, shall be responsible for complying with all provisions of 20 U.S.C., Chapter 33 and its regulations as they relate to LEAs.

Non-Profit shall notify COUNTY BOARD, or designated LCOE staff, of its plan for meeting its obligations to serve students with disabilities, either as a “school within the district for purposes of special education” or as a local education agency (“LEA”) within a Special Education Local Planning Area (“SELPA”). If Non-Profit chooses to be a “school within the district for purposes of special education”, it shall comply with requirements for other DISTRICT schools and shall annually pay to DISTRICT its per ADA share of the DISTRICT’S general fund contribution to special education.
16.2. If the Non-Profit chooses to act as its own local education agency (“LEA”) in a Special Education Local Planning Area (“SELPA”), or as a duly constituted SELPA approved by the State of California, the Non-Profit shall provide COUNTY BOARD, or designated LCOE staff, as specified in Schedule A [optional: and Schedule C], with a copy of the Local Plan and documentation of the status of the Charter School as an LEA in good standing with a state- approved SELPA or as a state- approved SELPA.
16.3. Non-Profit and/or the Charter School shall assume all responsibility, including but not limited to full financial responsibility, for the implementation of student plans and provision of educational services under Section 504 of the Rehabilitation Act, for all students who are enrolled in the Charter School.
16.4. Non-Profit and the Charter School agree to fully and promptly comply with any reasonable requests for information made by the COUNTY BOARD, or designated LCOE staff, with regard to special education services and individual students at the Charter School. The COUNTY BOARD, or designated LCOE staff, may establish regular meetings with Non-Profit special education coordinator for purposes of reviewing special education and/or Section 504 compliance. The COUNTY BOARD, or designated LCOE staff, may also take action to monitor the Charter School to ensure that special education and/or Section 504 services are being provided as required by law and applicable SELPA policy.
16.5. COLLEGE DISTRICT will make reasonable accommodations to ensure that SCHOOL DISTRICT is able to implement the student's IEP in CCAP classes. Students may choose to seek academic adjustments or accommodations pursuant to the American with Disabilities Act through the College's Disability Support Program and Services (''DSPS")

In order for students with disabilities to receive accommodations from ACC, students with disabilities who require accommodations must self-disclose to ACC's Student Accessibility Services (SAS) and provide current (within three years of enrollment at ACC) documentation of a disability. Documentation of a disability consists of a statement or evaluation from a recognized medical professional, or the student’s current §504 plan or records maintained by the ISD relating to eligibility for special education accommodations that exceed those applicable to ACC, if any, shall be the responsibility of ISD. Building and information technology access will be the responsibility of whichever Party is the owner/provider of that infrastructure, including access to web-based curriculummaterials.
