Settlement Website Notice. 9.2.1 The Claims Administrator shall create an Internet website for this Action, where settlement information and claim submission will be made available (“Settlement Website”). The Settlement Website will: (a) inform Class Members of the basis of the claims raised in the Action and the payment under this settlement; (b) advise Class Members about how to submit opt out/exclusion notices from the settlement and the deadlines for Class Members to submit requests for exclusion/opt-out or objections to the proposed settlement (“Opt-Out and Objection Deadline”); (c) instruct that Class Members should direct questions about the Action or proposed settlement to Class Counsel; and (d) inform Class Members to their right to appear in the Action through their own attorney. This notice will be in a question and answer format and will contain a full copy of the release (the “Q & A Notice”) and will be substantially in the form of Exhibit B attached hereto.

Settlement Website Notice. Within fourteen (14) calendar days of Preliminary Approval, the Settlement Administrator shall launch a Settlement Website, which will include, inter alia, links to the Long Form Notice, the Summary Notice, this Settlement Agreement and Exhibits, the Claim Form, the list of examples of Godiva Chocolate Products, relevant filings and orders, and information relating to filing a claim, objecting to the Settlement, opting out of the Settlement, other deadlines relating to the Settlement, and instructions on how to access the case docket via PACER or in person at any of the Court’s locations. The Settlement Website will also provide Class Members with the ability to submit Claim Forms and Requests for Exclusion and to obtain information contained without the Claim Form. The Settlement Website shall be compliant with the Americans with Disabilities Act of 1990.
Settlement Website Notice. The Settlement Administrator shall, promptly after entry of a Preliminary Approval Order, establish the Settlement Website containing key information and documents pertaining to the Settlement and the relief to be provided herein. The Website will include (among other documents and information) a long-form notice in a format to be agreed upon by the Parties and to be presented to the Court for approval. A copy of the proposed long-form notice is attached as Exhibit B. The Website shall also provide a web-based version of the Claim Form which eligible Settlement Class Members can use to submit the Claim Form electronically. The Website will remain live through the completion of the Settlement process, and from time to time will be updated to reflect important events in the Settlement process.

At a minimum, such documents must include the Settlement Agreement and Exhibits, the Notice, the Q & A Notice Form, the Preliminary Approval Order, a downloadable Claim Form for anyone wanting to print a hard copy and mail in the Claim Form, Plaintiff’s then-operative pleading, and when filed, the Final Approval Order.

The Settlement Website will also provide, free of charge, viewable, printable, and downloadable copies of each of the following documents in PDF file format: this Agreement; the Court’s order preliminarily approving the Settlement and certifying the Settlement Class; proof of claim forms (“Claim Forms”), which will be used to determine class membership and will be in a form approved by the Court; and the full class action settlement notice (“Full Notice”), which will be in a form approved by the Court.

Settlement Website Notice. As soon as practicable but starting no later than fifteen (15) days after entry of the Preliminary Approval Order, the Settlement Administrator shall establish the Settlement Website and post the Detailed Notice, this Settlement Agreement, and the Preliminary Approval Order, as well as the additional information set forth in Section 4.3 below.
Settlement Website Notice. Beginning no later than 20 days after the Court's preliminary approval of the Settlement and continuing at least through the last day on which Settlement Class members may submit a Claim Form, the Settlement Administrator will provide a viewable and printable on-line long-form notice ("Full Notice"), which will be in the form attached hereto as Exhibit D, via a Settlement Website containing a description of the Settlement terms. After preliminary approval of the Settlement is granted by the Court, the Settlement Administrator shall cause Exhibit D to be translated by a court certified translator and thereupon provide the translated version of Exhibit D to the Parties. The Settlement Website shall also have an option where viewers can click to view in Spanish, which translation shall be effectuated by the Settlement Administrator using a court certified translator. All costs for the Settlement Website shall be paid from the Cash Fund.
