SICK LEAVE AND INJURY ON DUTY. 21.1 Sick leave with pay shall be earned by each employee at the rate of one (1) working day for each month of service. Unused sick leave to an employee’s credit may be accumulated from year to year to a total of one hundred twenty (120) days. 21.2 Employees may use their accrued sick leave for the following: A. Illness of employee, spouse, children (of any age), sibling, parent, grandparent, grandchild, mother-in-law, father-in-law or stepparent. An employee may use sick leave for themselves or the relatives listed above as safety leave for the purpose of providing or receiving assistance because of sexual assault, domestic abuse or stalking as defined in M.S. 181.943 (as amended). The use of sick leave for safety leave or for the employee’s adult child, spouse, sibling, parent, mother-in-law, father-in-law, grandchild, grandparent or stepparent shall not exceed 160 hours in any twelve (1) month period. B. Temporary physical disability of employee causing absence from work; or C. An employee may use up to five (5) days sick in cases of death in the employee’s immediate family. Immediate family shall include, for the purposes of this section, the employee’s spouse, parents, sister, brother, children, stepchildren, father-in-law, mother-in-law, brother-in-law, sister-in-law, grandparents, and grandchildren. 21.3 Sick leave may be used for service as a color guard, or pallbearer, provided: A. Sick leave for funerals under Section 21.3 may not be used more than five(5) times in any one (1) calendar year; and B. Sick leave for funerals under Section 21.3 shall not exceed actual time required for such funeral and travel time therefore, nor one and one- half (1½) days in each instance, whichever is less. 21.4 The County Sheriff may require a doctor’s certificate showing the nature of the illness or injury whenever sick leave is requested under Section 21.1. 21.5 In order to be eligible for sick leave with pay, an employee must report promptly to the County Sheriff the reason for any absence from work. 21.6 An employee claiming sick leave when physically fit, except as permitted in this Article, will be subject to disciplinary action including, but not limited to, suspension, demotion, or discharge. 21.7 An employee, at his/her option, may cash in up to twenty (20) days of accrued sick leave each year, at a time designated by the Employer, for cash in accordance with the following: A.   • Personal Illness and Injury Leave 10.1.1 Full-time bargaining unit members shall be entitled to ten (10) days leave with full pay for each school year for purposes of personal illness or injury. Bargaining unit members who work less than full-time shall be entitled to that portion of the ten (10) days leave as the number of hours per week of scheduled duty relates to the number of hours for a full-time bargaining unit member in a comparable position. 10.1.2 After all earned leave as set forth in 10.1.1 above is exhausted, additional non-accumulated leave shall be available for a period not to exceed five (5) school months, provided that the provisions of 10.1.4 below are met. The amount deducted for leave purposes from the bargaining unit member's salary shall be the amount actually paid a substitute employee employed to fill the position during the leave, or, if no substitute is employed, the amount which would have been paid to a substitute. The five-month period shall begin on the eleventh (11) day of absence due to illness or injury. 10.1.3 If a bargaining unit member does not utilize the full amount of leave as authorized in Article 10.1.1 above in any school year, the amount not utilized shall be accumulated from year to year. 10.1.4 Upon request by District management, a bargaining unit member shall be required to present a medical doctor's certificate verifying the personal illness or injury and/or a medical authorization to return to work. If the illness or injury exceeds twenty (20) consecutive days, the District may require a certified medical specialist to visit the bargaining unit member and make all necessary inquiries in order to be fully informed as to the nature and severity of the illness or injury, and to report such findings to the Superintendent or designee. If the report concludes that the absence is not due to personal illness or injury, or that the illness is not sufficiently severe to warrant continued absence, then the Superintendent or designee, after notice to the bargaining unit member, may refuse to grant such a leave. If requested by the District management to furnish a medical doctor's authorization, bargaining unit member shall submit said authorization upon returning to work. 10.1.5 Whenever possible, a bargaining unit member must contact the designated District Office personnel as soon as the need to be absent is known, but no later than ninety (90) minutes prior to the bargaining unit member's starting time, in order to permit the employer time to secure a substitute. Failure to provide adequate notice may be grounds for denial of leave with pay. 10.1.6 A bargaining unit member who is absent for one-half day or less may have deducted one-half day from the accumulated leave; and if the absence exceeds more than one-half day, a full day may be deducted from accumulated leave. 10.1.7 A bargaining unit member may not be allowed to return to work and may be required to pay the cost of the substitute secured if the bargaining unit member fails to notify the District of the bargaining unit member's intent to return to work prior to the close of the bargaining unit member's preceding workday, and such failure results in a substitute being secured. 10.1.8 Each bargaining unit member may request notification of the accumulated leave by September 30th of each school year.

  • Vacations and Sick Leave The Executive shall be entitled to paid annual vacation leave in accordance with the policies as established from time to time by the Board of Directors, which shall in no event be less than four weeks per annum. The Executive shall also be entitled to an annual sick leave benefit as established by the Board for senior management employees of the Bank.   • Sick Leave Provisions ‌ The Employer will provide sick leave credits for the sole and exclusive purpose of protecting employees against loss of income during periods of legitimate illness. At the beginning of each fiscal year (April 1) full-time employees who have successfully completed their probationary or trial period are credited with ninety (90) hours of sick time credits to be paid at one-hundred percent (100%) of their normal earnings. New full-time employees will be allocated sick time credits pro-rated to the date they successfully complete their probationary or trial period. Sick leave credits have no value upon termination of employment and cannot be carried over from one fiscal year to the next. Any employee absenting herself on account of illness, regardless of whether she qualifies for sick leave pay under this Article, subject to extenuating circumstances, shall be required to speak directly with her supervisor or designate prior to the commencement of her shift, and in any event no later than two (2) hours prior to the normal commencement of her shift. An employee may be required to submit a medical certificate with respect to any period of time the employee is absent due to illness for more than three (3) consecutive days. It is understood that the Employer may request a medical certificate from employees to cover any absence due to illness, where a pattern of absence so warrants. In the case of longer absences, the employee must keep his/her supervisor informed at two (2) week intervals of his/her progress and expected date of return to work. Employees are expected to notify their supervisor as early as possible of their expected date of return to work. All employees returning to work after any absence due to illness or injury may be requested to present proof of fitness to return to work in the form of medical documentation from a physician or nurse practitioner. The cost of any medical certificate required will be paid by the employee. Employees are expected to participate in the Employer’s return to work program. A statutory or other declared holiday falling within the sick leave period shall not be charged against the sick leave credits. When and employee’s illness continues beyond their sick leave credits, the sequence shall be as follows: (a) The employee uses up all sick time credits; (b) The employee is placed on a Leave of Absence without pay. The employee is issued a Record of Employment and may apply for Employment Insurance Sick Benefits. While on EI, Community Living will supplement these benefits to eighty percent (80%) of the employee’s regular wages. (c) The employee makes application for long term disability coverage through the benefit plan of the Employer.

  • Errors and Omissions, Professional Liability or Malpractice Insurance Contractor may be required to carry errors and omissions, professional liability or malpractice insurance. All policies shall remain in force through the life of this Contract and shall be payable on a "per occurrence" basis unless County specifically consents to a "claims made" basis. The insurer shall supply County adequate proof of insurance and/or a certificate of insurance evidencing coverages and limits prior to commencement of work. Should any of the required insurance policies in this Contract be cancelled or non-renewed, it is the Contractor’s duty to notify the County immediately upon receipt of the notice of cancellation or non-renewal. If Contractor does not carry a required insurance coverage and/or does not meet the required limits, the coverage limits and deductibles shall be set forth on a waiver, Exhibit C, attached hereto. Failure to provide and maintain the insurance required by this Contract will constitute a material breach of this Contract. In addition to any other available remedies, County may suspend payment to the Contractor for any services provided during any time that insurance was not in effect and until such time as the Contractor provides adequate evidence that Contractor has obtained the required coverage.

  • Deductibles and Self-Insured Retention Any deductible or self-insured retention that apply to any insurance required by this Agreement must be declared and approved by COUNTY.

  • Deductibles and Self-Insured Retentions Any deductibles or self-insured retentions must be declared to, and approved by CITY's Risk Manager.
