The 'Step 4, Formal' clause outlines the requirement for formalizing an agreement or process at a specific stage. Typically, this involves documenting the terms in writing, obtaining necessary signatures, or completing official paperwork to make the arrangement legally binding. By mandating a formal step, the clause ensures that all parties have a clear, enforceable record of their commitments, reducing the risk of misunderstandings or disputes later on.
Step 4, Formal. If the grievance is not satisfactorily adjusted at Step 3, the grievant may appeal in writing to the Board of Trustees within five (5) work days of the receipt of the response from Step 3. At the grievant's request the Board will schedule an executive session or public hearing at the next regularly scheduled public meeting. Within five (5) work days after this meeting, the Board of Trustees will communicate to the grievant, in writing, its decision on the grievance. The decision of the Board will be final.
Step 4, Formal. If the grievant is not satisfied with the decision rendered in Step 3, they may appeal the decision within five (5) work days from the date of receipt of the answer in Step 3, to the superintendent- president or designee. Within five (5) work days after receipt of the appeal, the superintendent-president or their designated representative shall give an answer, in writing, to the grievant.
Step 4, Formal. If a satisfactory disposition of the grievance is not made as a result of the procedure provided for in Steps 2 (or 3 if elected) the Union shall have the right to appeal the dispute to an impartial arbitrator under and in accordance with the rules of the Federal Mediation and Conciliation Service. Such appeal must be made within ten (10) days of the receipt of the Superintendent or his/her designated representative’s response as provided in Step 2 (or within ten (10) days of conclusion of mediation if elected), by filing a notice with the statement of grievance attached thereto with the Federal Mediation and Conciliation Service, and serving a copy of the notice on the Board’s representative.
