Streetscape Improvements. Redeveloper shall, at its cost and expense, restore the sidewalk along the north and east faces of the building to the same or substantially similar condition, at a minimum, as existed prior to commencement of construction of the New Building and replace any trees or landscaping damaged during construction of the New Building. To the extent that Redeveloper adds to the existing features in the right-of-way, including but not limited to additional landscaping areas, bioswales, and relocation of curbs (“Redeveloper Streetscape Improvements”) consistent with the Streetscape Plan included in Exhibit C, such Redeveloper Streetscape Improvements shall be constructed through the City’s Executive Order Construction process. In addition, Redeveloper agrees that it is a precondition of being reimbursed for the Redeveloper Streetscape Improvements from TIF Bond Proceeds that the contractor(s) for the Redeveloper Streetscape Improvements be selected through a public bidding process conducted by the City’s Purchasing Division. Redeveloper may be reimbursed for the cost of such improvements from the TIF Bond Proceeds as described below. In addition to the Redeveloper Streetscape Improvements, the City shall design and construct improvements to the streetscape, including but not limited to sidewalks, landscaping areas, benches, and other features for the benefit of the public throughout the Project Area including the west side of 00xx Xxxxxx between the alley and M Street and the north side of M Street between S. 13th Street and S. 14th Street (“City Streetscape Improvements”). The City’s obligation to design and construct said The City Streetscape Improvements is limited to the amount of work that can be accomplished with a total budget of Four Hundred Thousand and No/100 Dollars ($400,000.00) to be funded from the TIF Bond Proceeds described below.
Streetscape Improvements. The DDA agrees to meet the following responsibilities concerning streetscape improvements within the boundaries of the DDA.
A. Upon completion and acceptance of streetscape improvements, except those noted in item 2.C. below, the City will accept ownership, liability and maintenance.
B. The DDA will be responsible for routine maintenance and for all streetscape improvements owned or maintained by the DDA located within the DDA boundaries.
C. The streetscape improvements that fall under this section of Article I are inclusive of, but not limited to, planters, kiosks and string lighting, and contribute to the replacement of address blocks as needed, when placed in the sidewalk.
D. The DDA will periodically review the condition of streetscape improvements it owns or maintains to find any potential repairs that may be needed.
E. The DDA will budget each year an adequate amount of money for streetscape improvements and repairs as they are needed.
F. The DDA will provide liability insurance coverage for streetscape improvements within the DDA boundaries.
G. The DDA’s maintenance responsibilities on streetscape improvements it has purchased and placed within the DDA boundaries include, but are not limited to, repair and replacement of broken, damaged, or unsightly improvements.
H. The DDA will budget for emergency tree trimming services within the DDA district that impacts property owners or pedestrian safety.
I. The DDA will designate 25% of the Tax Increment Financing (TIF) generated by City taxes to be used for replacement of streetscape infrastructure assets within the DDA.
Streetscape Improvements. The Company covenants and agrees to cause to be 184 performed the Construction and completion of the Streetscape Improvements as described 185 herein. In consideration for the Minimum Private Investment by the Company and the 186 completion of the Streetscape Improvements by the Company, the City shall pay the Company 187 the Guaranteed Maximum Streetscape Price pursuant to the terms of this Agreement, as payment 188 for the costs of the Construction and completion of Streetscape Improvements. 189
Streetscape Improvements. Overall conceptual plans and drawings (“Streetscape Drawings”) for Streetscape Improvements on the public streets which directly front the Project Site shall be prepared by the Redeveloper. The Streetscape Improvements shall include but not be limited to decorative hardscape, landscaping, and other streetscape features and amenities. The Streetscape Drawings shall be submitted to the City’s Urban Development Department for review and submittal of a recommendation to the Mayor. Upon receipt of the Urban Development Department’s recommendation, the Mayor shall approve or reject the Streetscape Drawings within fourteen (14) days after receipt. Upon approval of the Streetscape Drawings, the Redeveloper shall prepare or cause to be prepared final Streetscape Construction Documents in accordance with City Design Standards and Standard Specifications which shall be submitted to the Mayor for review and approval as provided above. The Streetscape Improvements shall be competitively bid through the City’s Purchasing Division or by the Redeveloper pursuant to the Redeveloper Bidding Procedures attached hereto as Exhibit E.
Streetscape Improvements. (1) The Developer shall design and construct the Streetscape Improvements as described more particularly on Exhibit E or similar improvements, all such improvements to be approved by the City Plan Commission in connection with the Site Plan Review of the 000 Xxxxxxx Xxxxxx Parcel.
(2) In accordance with its standard obligations, the City agrees to maintain, repair and replace the Streetscape Improvements as approved by the City Plan Commission as part of its Site Plan Review. The Developer will grant the City such access to the 000 Xxxxxxx Xxxxxx Parcel as may be reasonably required to maintain, repair and replace such Streetscape Improvements.
Streetscape Improvements. The sidewalk improvements will include granite curbs, cast concrete or stone sidewalk pavers, street lighting, and street trees. With regard to street trees, Developer agrees to protect or replace the two (2) existing street trees at the Property and plant a third street tree following construction of the Project.

Streetscape Improvements. All costs for streetscape improvements that are shown on the approved Site Plan are the responsibility of Redeveloper. This includes landscaping, lighting, public furniture and all other on-site Improvements located between the curb and the Improvements.
Streetscape Improvements. SRL and City have agreed that City shall be responsible for the construction and installation of all the sidewalks and streetscape (consistent with the conceptual design drawings referenced in subsections (i) and (ii) below) in the areas identified on the site plan attached hereto as Exhibit C (the “Sidewalk and Streetscape Site Plan”). Except as otherwise provided herein, all other sidewalks and streetscape shown on the SRL Master Plan shall be installed by (x) Residential Developer on the Residential Land, and (y) by SRL on the remainder of the Property. Sidewalks will be constructed within the rights-of-way and the width of sidewalks will be determined on a case by case basis upon the mutual consent of the parties, it being understood and agreed that sidewalks may vary in width throughout the Project. SRL and/or Residential Developer may reserve certain rights in the dedication of said sidewalks to City, including but not limited to the right to encroach into said sidewalks for items such as foundations and above ground improvements, awnings, door swings, building lighting and signage, outdoor tables and seating, all as mutually agreed by the parties and with customary indemnification provisions in favor of City. Notwithstanding the foregoing, in all events sidewalks within the Residential Land shall be at least five (5) feet in width and sidewalks within the remainder of the Project shall be at least eight (8) feet in width, except in locations where the trees are installed in tree xxxxx surrounded by pavement, in which case the width of the sidewalks shall measure at least five feet from the inside edge of the tree xxxxx to the line of the sidewalk furthest from the street. All such sidewalks shall be dedicated to City in order to be available for public access at all times.
Streetscape Improvements. The Developer, at its sole cost and expense, shall provide all streetscape improvements around such portion of the perimeter of the Project as required by the DDA. All streetscape improvements shall be consistent with the typical streetscape design, including, but not limited to, decorative lighting, concrete pavers, street trees, benches, trash receptacles and irrigation. A copy of the typical specifications is attached as Exhibit 6.14. The Developer acknowledges that compliance with this Section 6.14 and the construction of other public improvements in connection with the Project shall require performance guarantees, bonds, letters of credit and other assurances for completion as required by City Ordinances.
