Subject to 6. 5.6, the deputy head shall pay to each employee who is asked to remain until the relocation of the work unit and who offers a resignation from the core public administration to take effect on the relocation date, a sum equivalent to six (6) months’ pay payable on the day on which the departmental or organizational operation relocates, provided the employee has not separated prematurely.

Subject to 6. 4.1, the administrator shall appoint a mediator agreed to by the parties to a dispute or, in the absence of agreement, from the roster or under 6.3.3, upon receiving a request from a party to a dispute in respect of (a) any matter which the Agreement stipulates shall or may be resolved in accordance with this chapter; (b) a dispute between government and the Tåîchô Government concerning the interpretation or application of the Agreement; or (c) any matter which an agreement between government and the Tåîchô Government stipulates shall or may be resolved in accordance with this chapter or shall or may be dealt with under 6.4.
Subject to 6. 2 below, Executive’s employment hereunder and the Period of Employment may be terminated without any breach of this Agreement at any time and for any reason by either Executive or Employer without the provision of notice. Employer and Executive intend for Executive to be an “employee at will,” and the Period of Employment specified in Section 2 shall not be construed under any circumstances to alter such “at will” employment relationship. In addition to any benefits under Section 4.2 and 4.3, upon any termination of Executive’s employment hereunder, Executive shall be entitled to payment of his accrued and unpaid Base Salary through the date of Executive’s termination of employment. If Executive’s employment is terminated during the Period of Employment by Employer without Cause or by Executive for Good Reason, the receipt of any compensation and benefits under Section 4.2 and Section 4.3 shall be conditioned upon Executive signing a general release of claims in a form and manner satisfactory to Executive and Employer within twenty-one days following such termination and Executive not revoking such release.
Subject to 6. 1.3 of this Agreement, each Party shall be responsible for deviations made by it from the Scheduled Generation and for any resultant liabilities on account of charges for deviation as per the applicable regulations.

Subject to 6. 6.7.1 hereof, any request for personal leave will be automatically authorised. 6.6.7.1. Where the number of personal leave days in a calendar year exceeds five and concerns exist about the nature of personal leave taken, direct managers will have discretion to request a medical certificate in accordance with provisions set out within the Award. In doing so supervisors are also expected to refer to procedures on the intranet for managing illness and absence. 6.6.7.2. In the case of carers leave, the Employee when requested will produce a medical certificate of the person being cared for or provide a statutory declaration. 6.6.7.3. In the case of sick leave, Employees will not be required to produce a medical certificate where the circumstances would make it unreasonable for them to do so. In these circumstances, when certification has been requested, the Employee will provide the Employer with a statutory declaration that sets out the reason for the absence and why he/she could not obtain a medical certificate. 6.6.7.4. Failure to provide either a medical certificate or statutory declaration proof, once requested by the employer, may result in non-authorisation and non-payment of personal leave.
