TEACHER DUE PROCESS. When a teacher who has taught four (4) or more continuous years in the district is given written notice of the board's intention to not renew the teacher's contract, the teacher may request a meeting with the board by filing a written request with the clerk of the board within ten (10) days from the date of receipt of the written statement of nonrenewal of a contract. The board shall hold such meeting within ten (10) days after the filing of the teacher's request. The meeting provided for under this section shall be held in executive session and, at such meeting, the board shall specify the reason or reasons for the board's intention to not renew the teacher's contract. The teacher shall be afforded an opportunity to respond to the board. Either party shall have the right to representation. Within ten (10) days after the meeting, the board shall reconsider its reason or reasons for nonrenewal and shall make a final decision as to the matter. (2015)
TEACHER DUE PROCESS. Returning teachers who were previously employed by USD 469 will be permitted due process rights under US 469 if they had achieved such before previous separation of employment with the school district.
TEACHER DUE PROCESS. An addendum to this agreement containing Kansas statutes regarding teacher due process is available in the Education Center, each school’s office and each school’s faculty workroom.
TEACHER DUE PROCESS. A. Actions Against Teachers No teacher shall be disciplined, reprimanded, reduced in rank or compensation, or deprived of any professional advantage without just cause. No disciplinary action shall be taken against any teacher on the basis of a complaint by a parent or a student before a conference is held between the teacher and the supervisor contemplating the action. If the administrator deems that a complaint was not important enough to bring to the teacher’s attention at the time of its occurrence, it shall not permit the combining or omitting of a step in the discipline process by an administrator in the future. B. Progressive Discipline The Board and the Association recognize that progressive disciplining, suspending, terminating, or non-renewing teachers may be necessary from time to time. Progressive discipline provides a consistent and fair process for addressing disciplinary issues protecting the legal rights of teachers and administrators, by creating clear and constructive feedback through a series of increasingly formal steps. Some issues are corrected with counseling, others, depending upon the nature and severity of the issue, may subject a teacher to immediate termination. Administration must use reasonable judgment to decide what step or combination of steps should be used and will consult with the superintendent when questions arise. It is therefore agreed that any one of the following procedures may be applied. (2023) Progressive Discipline Process
TEACHER DUE PROCESS. In the event that the state general assembly repeals Article 63 (Teacher Employment Compensation, and Dismissal Act of 1990), the Association and Board of Education agree to discuss inclusion of a teacher due process in this Agreement.
TEACHER DUE PROCESS. No tenured teacher shall be disciplined, reprimanded, reduced in rank or compensation, or deprived of any professional advantage without due process as defined in the tenure codes.
