TEACHER RESIGNATIONS. 28.01 A teacher may resign from employment at any time on mutual consent or effective on the last day of a semester or school year provided notice in writing has been delivered to the Superintendent of Human Resources or designate at least thirty (30) days in advance.

The Board and the Association agree that teacher resignations submitted during the school year or in late summer may jeopardize the educational program because of the problem of obtaining suitable replacements. Therefore, in accordance with the tenure law, teachers may terminate their services with the Board only by mutual consent unless written notice is received by the Board at least sixty (60) days prior to September 1st of any given school year.

The Association encourages all teachers in the District to notify the Board as soon as possible of impending resignations in order to provide the Board with information necessary to plan for staffing the District for the ensuing school year and in order to implement Article VII, Section B(1), and Article XIII of this Agreement.

If a teacher resigns during the school term (i.e., student year) for other than extenuating circumstances beyond the teacher’s control, the teacher shall owe the District three percent (3%) of his/her salary to offset the expense of immediate replacement. If a non-tenured teacher resigns during August, the affected teacher shall reimburse the District an amount equivalent to that paid by the District for the health insurance benefit for August. The affected teacher shall continue to receive insurance coverage for the entire month of August.

After August 1 of any year, if an employee resigns from his/her employment by the School District without the written permission of the School Board, and thereby fails to work for the School District for the entire school year required by his/her employment contract, the employee shall pay the School District the sum of $1,000 as reasonable liquidated damages to compensate the School District for expenses incurred by reason of the employee’s resignation. The employee shall also be liable for the School District’s costs of collecting the liquidated damages, including reasonable attorneys’ fees. The employee may submit information to the School Board in support of his/her request for the School Board’s permission to resign and waiver of liquidated damages. This provision shall be included in each employee’s individual employment contract.

Given the challenging nature of the employment market, the Association recognizes the need for appropriate notice given when a teaching staff member resigns from their teaching position. Every effort will be made to give at least sixty (60) days notice prior to the beginning of the school year of their resignation. The district reserves the right to withhold a teaching certificate in the event they are unable to find a suitable replacement.
