Three-Year Review. Upon request of the Employee, the Employer agrees to remove from each employee’s official personnel file any material (other than a Performance Review) relating to discipline or unsatisfactory job performance for which there has been no recurrence for three (3) years, and they shall be returned to the employee as invalid in the future.

Three-Year Review. The Parties will review this Agreement on or before December 31, 2021 to assess the extent to which they are making progress in achieving their shared vision for comprehensive reconciliation and the other matters addressed herein including consideration of the desired outcomes identified in section 9.5.
Three-Year Review. A. From time to time after the expiration of the third year of this Agreement, the parties will review the operations of the Service Centers. Upon review: 1. The parties may mutually agree to terminate this Agreement. In such an event, DFG agrees at is sole cost, to remove the assets from each Service Center and pay Southland for the cost to restore each Store to the condition that existed prior to the installation of the Service Center, reasonable wear and tear excepted within sixty (60) days of termination subject to the limitation set forth in section 23 of this Agreement. In such event, the provisions of sections 19.B., 19.C and 19.D. will not apply. 2. Subject to section 12.C. of this Agreement, the parties may mutually agree to install and operate additional Service Centers in agreed upon Other Stores in other Southland markets. In such an event, the parties will mutually agree as to similar terms and conditions as this Agreement corresponding to the additional number of Service Centers which will be reflected in an executed Amendment to this Agreement or by a separate written Agreement. 3. Southland may decide, in its sole discretion, to operate additional Service Centers at the Other Stores internally or through a party other than DFG that provides the Services, including clerk assisted, third-party check cashing services similar to that of DFG. In the event Southland decides to operate Service Centers at the Other Stores through a third party other than DFG, and provided that DFG is otherwise complying with all terms of this Agreement, DFG may continue to operate the existing Service Centers at the Stores under this Agreement for the remainder of the Term. Three-Year Review. If IMACS provides notice of intent to seek renewal, as set forth in subsection 25.02, above, the MMSD shall conduct a mid-term review of the then-current state of IMACS in each of the following areas: A. Student Enrollment, including actual enrollment numbers to determine whether they are meeting expectations; student demographics to determine whether the race/ethnic, special education and socio-economic status of IMACS students generally reflect the overall diversity of MMSD; and student residence attendance areas. B. Financial Stability, including fundraising efforts and capital expenditures. C. Academic Outcomes, with a particular focus on IMACS’s ability to close any performance gaps between African American/Black students and white students. If, at the time of this review, IMACS fails to meet expectations in any area, they will be expected to develop and implement remediation and improvement plans for the remaining two years of this Agreement. If IMACS does not demonstrate adequate improvement in any area or areas identified as failing to meet expectations prior to the date the Board must make the renewal determination, such information shall be communicated to the Board and will result in administration making a recommendation to not renew the IMACS. The rubric set forth in the District’s Charter School Renewal Application materials shall be used by District administration for the purpose of determining whether a particular area meets expectations. Any determinations or findings by District administrators are subject to review by the Board of Education upon request by the Board. If IMACS fails to meet expectations in any area, the Board of Education may, with thirty (30) days written notice to the Council, schedule a Special Meeting to review the findings and outcomes.   • Peer Review Dental Group, after consultation with the Joint ----------- Operations Committee, shall implement, regularly review, modify as necessary or appropriate and obtain the commitment of Providers to actively participate in peer review procedures for Providers. Dental Group shall assist Manager in the production of periodic reports describing the results of such procedures. Dental Group shall provide Manager with prompt notice of any information that raises a reasonable risk to the health and safety of Group Patients or Beneficiaries. In any event, after consultation with the Joint Operations Committee, Dental Group shall take such action as may be reasonably warranted under the facts and circumstances.

  • Post Review With respect to each contract not governed by paragraph 2 of this Part, the procedures set forth in paragraph 4 of Appendix 1 to the Guidelines shall apply.

  • Quarterly Review For a period commencing on the initial effective date of the Registration Statement and ending five years from the date of the consummation of the Business Combination or until such earlier time at which the Liquidation occurs or the Common Stock and Warrants cease to be publicly traded, the Company, at its expense, shall cause its regularly engaged independent registered public accounting firm to review (but not audit) the Company’s financial statements for each of the first three fiscal quarters prior to the announcement of quarterly financial information, the filing of the Company’s Form 10-Q quarterly report and the mailing, if any, of quarterly financial information to stockholders.

  • Compensation Review The compensation of the Executive will be reviewed not less frequently than annually by the board of directors of the Company.

  • Annual Performance Review The Employee’s performance of his duties under this Agreement shall be reviewed by the Board of Directors or a committee of the Board of Directors at least annually and finalized within thirty (30) days of the receipt of the annual audited financial statements. The Board of Directors or a committee of the Board of Directors shall additionally review the base salary, bonus and benefits provided to the Employee under this Agreement and may, in their discretion, adjust the same, as outlined in Addendum B of this Agreement, provided, however, that Employee’s annual base salary shall not be less than the base salary set forth in Section 4(A) hereof.

  • Plan Year The year for the purposes of the plan shall be from September 1 of one year, to August 31, of the following year, or such other years as the parties may agree to.

  • Contract Year A twelve (12) month period during the term of the Agreement commencing on the Effective Date and each anniversary thereof.

  • Periodic Review The General Counsel shall periodically review the Procurement Integrity Procedures with OSC personnel in order to ascertain potential areas of exposure to improper influence and to adopt desirable revisions for more effective avoidance of improper influences.

  • Performance Review Where a performance review of an employee’s performance is carried out, the employee shall be given sufficient opportunity after the interview to read and review the performance review. Provision shall be made on the performance review form for an employee to sign it. The form shall provide for the employee’s signature in two (2) places, one (1) indicating that the employee has read and accepts the performance review, and the other indicating that the employee disagrees with the performance review. The employee shall sign in only one (1) of the places provided. No employee may initiate a grievance regarding the contents of a performance review unless the signature indicates disagreement. An employee shall, upon request, receive a copy of this performance review at the time of signing. An employee’s performance review shall not be changed after an employee has signed it, without the knowledge of the employee, and any such changes shall be subject to the grievance procedure of this Agreement. The employee may respond, in writing, to the performance review. Such response will be attached to the performance review.

  • Evaluation Cycle Goal Setting and Development of the Educator Plan A) Every Educator has an Educator Plan that includes, but is not limited to, one goal related to the improvement of practice; one goal for the improvement of student learning. The Plan also outlines actions the Educator must take to attain the goals established in the Plan and benchmarks to assess progress. Goals may be developed by individual Educators, by the Evaluator, or by teams, departments, or groups of Educators who have the similar roles and/or responsibilities. See Sections 15-19 for more on Educator Plans. B) To determine the goals to be included in the Educator Plan, the Evaluator reviews the goals the Educator has proposed in the Self-Assessment, using evidence of Educator performance and impact on student learning, growth and achievement based on the Educator’s self-assessment and other sources that Evaluator shares with the Educator. The process for determining the Educator’s impact on student learning, growth and achievement will be determined after ESE issues guidance on this matter. See #22, below. C) Educator Plan Development Meetings shall be conducted as follows: i) Educators in the same school may meet with the Evaluator in teams and/or individually at the end of the previous evaluation cycle or by October 15th of the next academic year to develop their Educator Plan. Educators shall not be expected to meet during the summer hiatus. ii) For those Educators new to the school, the meeting with the Evaluator to establish the Educator Plan must occur by October 15th or within six weeks of the start of their assignment in that school iii) The Evaluator shall meet individually with Educators with PTS and ratings of needs improvement or unsatisfactory to develop professional practice goal(s) that must address specific standards and indicators identified for improvement. In addition, the goals may address shared grade level or subject matter goals. D) The Evaluator completes the Educator Plan by November 1st. The Educator shall sign the Educator Plan within 5 school days of its receipt and may include a written response. The Educator’s signature indicates that the Educator received the plan in a timely fashion. The signature does not indicate agreement or disagreement with its contents. The Evaluator retains final authority over the content of the Educator’s Plan.
