Transfers Defined. A transfer shall be defined as the movement of one employee from one work site or one similar classification to another.

Transfer is defined as any permanent reassignment of an employ- ee from a covered position which has been eliminated to a covered vacant or newly-created covered position for which the employee has not applied. The following events shall be deemed to be a sale, assignment or other transfer of the Agreement requiring compliance with this Section: (i) the sale, assignment or other transfer of all or a majority of Company's assets to another Person; (ii) the sale, assignment or other transfer of capital stock or partnership, membership or other equity interests in Company by one or more of its existing shareholders, partners, members or other equity owners so as to create a new controlling interest in Company; (iii) the issuance of additional capital stock or partnership, membership or other equity interest by Company so as to create a new controlling interest in Company; and (iv) the entry by Company into an agreement with respect to the management or operation of Company or its Telecommunications System or Open Video System. The term "Controlling Interest" as used herein means majority equity ownership of Company.

Transfers Defined. A. Transfers shall be defined as re-assignment to a job in another classification. The Employer shall have the right to transfer an eTJployee for a period not to exceed forty (40) work days. Notice of transfer shall be given in writing to the employee and to the Association. After forty (40) days the employee shall have the right to renuest return to his former classification. Such request shall be slbmitted at least ten (10) calendar days before the expiration 0: the forty (40) day transfer.
