Transfers to Non-Bargaining Unit Position. Any employee covered by this Agreement who is transferred from a classification covered by this Agreement to a supervisory or other position within the County's employ which is not included within this Agreement shall accrue no further seniority as of the date of the transfer. However, said employee shall be entitled to retain the previous seniority which he accrued in the bargaining unit prior to said transfer.

Transfers to Non-Bargaining Unit Position. Any employee covered by this Agreement who is transferred from a classification covered by this Agreement to a supervisory or other position within the County’s employ which is not included within this Agreement shall accrue no further seniority as of the date of the transfer. However, said employee shall be entitled to retain the previous seniority that he accrued in the bargaining unit prior to said transfer. Upon completion of any probationary period required of a person promoted out of the unit, he/she shall have no right to voluntarily transfer back into the bargaining unit. However, if said employee does not successfully complete any probationary period required of a person promoted out of the unit, he/she shall have the right to transfer voluntarily back into the bargaining unit to fill a vacancy which occurs within one (1) year from the date of promotion. No supervisor shall be involuntarily returned to a position within the unit for improper conduct or other reason unless a vacancy exists to which the employee may return.
Transfers to Non-Bargaining Unit Position. Employees who accept permanent employment in a non-scope position may elect to continue to accrue seniority for sixty (60) working days, and if the employee so elects to accrue seniority, the employee shall continue to pay Union dues for that period. If the employee subsequently returns to the Bargaining Unit, the employee shall be placed on the seniority list as of the latest date of return. While outside the bargaining unit and accruing seniority under this clause, the employee will not be covered by any other provisions of this Agreement.

The Sheriff retains the right to determine all working conditions for employees outside the collective bargaining unit and the right to determine whether an employee transferred outside the bargaining unit shall be permitted to return to the bargaining unit, except an employee so transferred shall have the right, if he so elects, to return to the bargaining unit: (1) whenever his position is eliminated; (2) if he is laid off from his position; or (3) if he occupies the position of either Jail Administrator or Undersheriff, upon the election or appointment of a new Sheriff. Upon return to the collective bargaining unit, the employee shall be returned to the classification and seniority he held prior to his promotion or transfer and, seniority permitting, shall have the right to displace a less senior employee in the bargaining unit.

  • Non-Bargaining Unit Personnel It is understood and agreed that there are times when non-bargaining unit employees may be required to perform work customarily performed by bargaining unit employees. It is also understood that Supervisors and others will be required to work with tools only to meet requirements under the conditions listed below. Therefore, the Company shall have the right to utilize non-bargaining unit employees under one or more of the following conditions:

If such an employee later returns to the bargaining unit, the employee shall be placed in a job consistent with the employee's seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.

  • Protection of Bargaining Unit Work The Employer shall not assign work normally performed by members of this bargaining unit to persons outside the bargaining unit, to the point that it directly results in the termination, layoff or reduction in normal hours of any bargaining unit member The Employer shall not enter into any agreement that restricts or purports to restrict in any way the employment of and assignment of work to Nurses covered by this Collective Agreement without prior consultation and discussion with the Union’s Labour Relations Officer for the life of this Agreement. In the event of a fundamental change in the work normally performed by members of the bargaining unit, it is agreed that the parties shall meet to discuss these changes.

  • Bargaining Unit Members hired before July 1, 1995 Those Bargaining Unit Members whose current regular assigned work shift ends after 5:00 p.m. or commences before 7:30 a.m. or after 5:00 p.m. and who are currently receiving a shift differential pay of five percent (5%) for time worked after 5:00 p.m. or before 7:30 a.m. shall continue to receive said differential.

  • Transfer and Seniority Outside the Bargaining Unit (a) It is understood that an employee shall not be transferred by the Hospital to a position outside the bargaining unit without his consent except in the case of temporary assignments not exceeding six (6) months. Such employees on temporary assignments shall remain members of the bargaining unit.

  • Bargaining Unit Information The Employer agrees to provide the Union such information relating to Employees in the bargaining unit as may be required by the Union for the purpose of collective bargaining.

  • Bargaining Unit Member Rights 1. When an employee is to be interviewed or questioned concerning a complaint or allegation of misconduct, the employee will be informed of, prior to the interview, the nature of the investigation and whether the employee is the subject of the investigation or a witness in the investigation. If the employee is the subject of investigation, the employee will also be informed of the specifics of each complaint or allegation against him/her.

  • Positions outside the Bargaining Unit (a) An employee may substitute temporarily in a position outside the bargaining unit for up to fifteen (15) months from the date of the assignment. Bargaining unit employees shall be given the first opportunity to fill the resulting vacancy. The employee shall have the right to return to her or his bargaining unit position prior to the expiry of the fifteen (15) month period by giving the Employer six (6) weeks’ notice. Where an employee is backfilling outside of the bargaining unit for purposes of pregnancy and/or parental leave, the period of time will be extended up to nineteen (19) months from the date of the assignment. An employee who remains outside of the bargaining unit beyond the period covered by this article shall lose all seniority. When the employee returns to the bargaining unit, all other employee(s) shall revert to their previous positions. An employee must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer unless the parties agree otherwise.

  • Bargaining Unit Description Except where otherwise expressly provided in this Agreement, the bargaining unit shall comprise all employees included in the bargaining unit as in the Certification issued by the Labour Relations Board of British Columbia on November 27, 1973 as well as those employees not covered by the certification of the Canadian Office and Professional Employees' Union, Local No. 378, or excluded from either union certification under the provisions of the Labour Relations Code. The College recognizes the Union as the sole bargaining agent for all such employees.
