Union-Employer Health and Safety Committee. (a) A Health and Safety Committee shall be established which is composed of an equal number of Union and Employer representatives, but with a minimum of two (2) Union and two (2) Employers members. The Health and Safety Committee shall hold meetings at least once per month. (b) In accordance with the Workers' Compensation Act, no employee shall be disciplined for refusal to work on a job, or to operate any equipment, which is unsafe.

Union-Employer Health and Safety Committee. A Joint Health and Safety Committee shall meet every two months for the purpose of: (a) assisting in maintaining the overall objective of a safe working environment within the Employer; and (b) providing a means of communication between existing local safety committees; and (c) recommending action on items unresolved at local safety committees. Membership of the Committee shall be one (1) Union representative from each Local and one (1) management representative from each of Operations and Maintenance. The Committee shall be chaired by a representative of the Employer's Loss Prevention Department, who shall not have voting privileges. The Secretary will be one of the Committee representatives from the Union. The Chair will ensure the typing and distribution of the minutes and other pertinent information in a timely fashion. It is agreed that both Parties will endeavour to ensure that Committee membership remains consistent and that alternative Committee members will only be used when regular members are not available. It is understood that the agenda for each meeting shall be fixed two weeks prior to the meeting and will be based on submissions to the Chair from Committee members. Non agenda items must be approved by a majority of the Committee members in order to be discussed at a meeting. Union Committee members will be compensated for a day's wages at regular rates for attending at such meetings, and will not be expected to perform regular job duties on meeting days.

The parties can mutually agree to add a seventh representative if deemed advantageous. If a full second shift is put in place, each side will increase their representatives to eight (8). The Health and Safety Committee shall hold meetings as requested by the Union or by the Employer for jointly considering, monitoring, inspecting, investigating and reviewing health and safety conditions and practices, and to improve existing health and safety conditions and practices. Minutes shall be taken of all meetings and copies shall be sent to the Employer and the Union. A Union Health and Safety Representative shall have the right to participate in the monitoring of the work place and to accompany government safety inspectors on inspection tours.
