Unplanned Cessation of Parental Leave. (a) If parental leave has commenced, or has been approved but not commenced, and:
(i) in the case of maternity leave, the pregnancy of the employee terminates other than by the birth of a living child, or the employee’s child dies during the period that the staff member is on leave; or
(ii) in the case of adoption leave, the child dies during the period that the employee is on leave; the employee will be entitled to sick leave and bereavement leave in addition to any entitlement to such leave set out elsewhere in this Agreement to a maximum of 14 weeks from the date or expected date of birth or placement of the child.
(b) A medical certificate will be required to support any period of leave pursuant to subclause 38.10(a) above.
Unplanned Cessation of Parental Leave. (a) If parental leave has commenced, or has been approved but not commenced:
(i) in the case of maternity leave, the pregnancy of the employee terminates other than by the birth of a living child, or the employee’s child dies during the period that the staff member is on leave; or
(ii) in the case of adoption leave, the child dies during the period that the employee is on such leave.
(b) In each of the circumstances referred to at subclauses 39.5.6(a)(i) and (a)(ii), parental leave will cease on the date of the death of the child or the date of the unplanned cessation. Commencing the following day, an employee will be entitled to be absent from duty on special maternity/adoption leave for a period of up to 14 weeks payable at their base rate of pay. Unless an earlier date is agreed between the employee and the University, the employee will return to duty at the completion of this period.
(c) In addition to the 14 weeks of paid leave provided for in subclause 39.5.6(b), an employee may apply for and be granted further leave such as sick leave, compassionate leave, annual leave, or long service leave as prescribed in this Agreement.
(d) Documentation will be required to support any period of leave pursuant to subclause 39.5.6 (a) above.
Unplanned Cessation of Parental Leave. Should it be necessary to alter Parental Leave applied for and commenced, due to miscarriage or the death of a child, the following leave will be made available: MaternityBirth/Adoption 12 weeks paid leave and up to 14 weeks unpaid Leave for PartnersPaternity 3 weeks paid leave and up to 14 weeks unpaid Extended Parental LeaveChild Rearing 14 weeks leave without pay

i) in the case of maternity leave, the pregnancy of the employee terminates other than by the birth of a living child, or the employee’s child dies during the period that the employee is on leave; or
ii) in the case of adoption leave, the child dies during the period that the employee is on leave;
52.9.2 A medical certificate will be required to support any period of leave pursuant to sub-clause 52.9.1 above.

Unplanned Cessation of Parental Leave. 38.10.1 If parental leave has commenced, or has been applied for but not commenced, and:
(a) in the case of maternity leave, the pregnancy of the employee terminates other than by the birth of a living child, or the employee’s child dies during the period that the staff member is on leave; or
(b) in the case of adoption leave, the child dies during the period that the employee is on leave; the employee shall be entitled to fourteen weeks paid leave, and unpaid leave up to a period of twelve weeks or such longer period as may be certified by a Medical Practitioner up to a maximum of 52 weeks.
38.10.2 Where partner leave has commenced and the child dies during the period that the employee is on leave, the employee shall be entitled to up to ten days unpaid leave or such longer period as may be certified by a Medical Practitioner up to a maximum of four weeks, in addition to any period of compassionate leave.
38.10.3 Where child rearing leave has commenced and the child dies during the period the employee is on child rearing leave, the employee shall be entitled to fourteen weeks unpaid leave or such longer period as may be certified by a Medical Practitioner up to a maximum of 52 weeks, in addition to any period of compassionate leave.
Unplanned Cessation of Parental Leave. If parental leave has commenced, or has been approved but not commenced, and: in the case of maternity leave, the pregnancy of the employee terminates other than by the birth of a living child, or the employee’s child dies during the period that the employee is on leave; or in the case of adoption leave, the child dies during the period that the employee is on leave; the employee will be entitled to a combination of paid sick leave and bereavement leave in addition to any entitlement to such leave set out elsewhere in this Agreement to a maximum of 14 weeks from the date or expected date of birth or placement of the child. A medical certificate will be required to support any period of leave pursuant to subclause 5.10(a) above.
Unplanned Cessation of Parental Leave. 52.12.1 If parental leave has commenced, or has been approved but not commenced, and:
52.12.1.1 where a pregnancy terminates other than by the birth of a living child, or the employee’s child dies during the period that the employee is on leave; or
52.12.1.2 in the case of surrogacy, adoption or the permanent care of a child, the child dies during the period that the employee is on leave, the employee will be entitled to a maximum of 26 weeks paid leave from the date or expected date of birth or placement of the child. The employee may utilise other leave accruals and unpaid leave to take the leave period up to a maximum of 12 months.
52.12.2 Where a pregnancy terminates between 13 and 20 weeks and prior to the submission of a request for parental leave, the employee will be entitled to up to four (4) weeks of paid leave, in addition to any compassionate leave entitlement prescribed in this Agreement.
52.12.3 A statutory declaration or other supporting information may be provided to support any period of leave pursuant to sub-clause 52.9.
Unplanned Cessation of Parental Leave. Parental Leave applied for but not commenced shall be cancelled where, in the case of: • Maternity Leave, the pregnancy of an employee terminates other than by the birth of a living child; or • Adoption Leave, the placement of the child does not proceed; or • Partner Leave, the pregnancy of the employee's spouse terminates other than by the birth of a living child.
30.8.1 Should it be necessary to alter Parental Leave applied for and commenced, in the case of either: • Maternity Leave, where an employee whose pregnancy terminates by miscarriage or results in a still-born child or whose child dies during the period that the employee is on Maternity Leave; or • Adoption Leave, where the child dies during the period that the employee is on Adoption Leave; the employee shall be entitled to: • 12 weeks paid leave at the salary rate at the time of the child's death; and • unpaid leave up to a period of 14 weeks or to such longer period as may be certified by a registered medical practitioner up to a maximum of 52 weeks.
30.8.2 Should it be necessary to alter Partner Leave applied for and commenced, where the child dies during the period that the employee is on Partner Leave, the employee shall be entitled to unpaid leave of up to 10 days or to such longer period as may be certified by a registered medical practitioner up to a maximum of 4 weeks;
30.8.3 Should is be necessary to alter Child Rearing Leave applied for and commenced, where the child dies during the period that the employee is on child rearing leave, the employee shall be entitled to unpaid leave up to a period of 14 weeks or to such longer period up to a maximum of 52 weeks as may be certified by a registered medical practitioner.
Unplanned Cessation of Parental Leave. An employee whose pregnancy, having proceeded for a period of not less than twenty weeks, terminates by miscarriage or from the birth of a still-born child, shall be entitled to paid leave of up to 14 weeks provided or a pro rata amount where service is less than 12 months. Where an employee has already commenced such leave she will receive the balance of the period outstanding.
