Use and Trade Name. Tenant shall continuously use and occupy the Leased Premises during the Term solely for the purpose of conducting the business specifically set forth in the Data Sheet and for no other purpose or purposes. Throughout the Term hereof, Tenant shall (a) operate its business in the Leased Premises under the Trade Name specifically set forth in the Data Sheet and under no other so long as such name shall not be held to be in violation of any applicable law, (b) not change the advertised name or character of the business operated in the Leased Premises, (c) refer to the Shopping Center by name in designating the location of the Leased Premises in all newspaper and other advertising within the Shopping Center market area and in all other references to the location of the Leased Premises, and (d) during the period from the Delivery of Possession Date through sixty (60) days following the Commencement Date, include in all Tenant's newspaper advertising within the Shopping Center market area the designation that Tenant is opening for business in the Shopping Center. If any governmental license(s) or permit(s) shall be required for the proper and lawful conduct of Tenant's business or other activity carried on in the Leased Premises, or if a failure to procure such a license or permit might or would in any way, adversely affect Landlord or the Shopping Center, then Tenant, at Tenant's expense, shall duly procure and thereafter maintain such license(s) or permit(s) and submit the same for inspection by Landlord. Tenant, at Tenant's expense, shall at all times, comply with the requirements of such license(s) or permit(s). Except as provided in Section 1.3, Tenant shall open its store in the Leased Premises for business to the public on the Commencement Date, and shall thereafter diligently conduct its regular business operations in the Leased Premises as required by the terms of this Lease.

Use and Trade Name. Tenant shall use the Leased Premises solely for the Permitted Use and for no other purpose, and shall operate its business on the Leased Premises solely under the Tenant Trade name and under no other name; provided, however, Tenant may change its Trade Name without Landlord's written consent provided: (i) the use of the trade name proposed shall not violate any then existing lease or other agreement affecting the Shopping Center; (ii) the trade name proposed shall not be similar to the trade name of any other then existing tenant or occupant in the Shopping Center; (iii) the proposed trade name is the trade name used by all of the stores operated by Tenant under the current trade name; (iv) Tenant shall install new internally illuminated storefront signage with Tenant's new trade name and Tenant shall make all necessary modifications to the sign band and/or the bulkhead of the Leased Premises at its sole cost and expense and in accordance with plans, specifications and design criteria approved in advance by Landlord whose approval will not be unreasonably withheld or delayed; (v) Tenant shall reimburse Landlord the reasonable expenses incurred by Landlord in modifying any directories that reference Tenant's store to reflect the new Trade Name; and (vi) Tenant notifies Landlord of its change of Trade Name at least thirty (30) days prior to said change. On or before the thirtieth (30th) day after Tenant changes its trade name, Tenant shall submit drawings to Landlord for Landlord's review and approval prior to the installation of the sign and/or modification of the sign band and/or bulkhead.

Such use, occupancy and operation shall be solely for the Permitted Use set forth in the Data Summary and for no other purpose and shall include the entire area of the Leased Premises. Throughout the Term, Tenant shall (a) operate its business in the Leased Premises under the Permitted Trade Name specifically set forth in the Data Summary and under no other, (b) not change the advertised name or character of the business operated in the Leased Premises, and (c) refer to the Shopping Center by name and by its logo whenever designating the location of the Leased Premises in all advertising, billboards, stationery and other local media.
Use and Trade Name. (a) Tenant shall use the Premises solely for the Permitted Use (and Tenant shall use the Premises for all of the purposes specified in the Permitted Use), and for no other purpose, and shall operate its business on the Premises solely under the Trade Name and under no other name; provided, however, that Tenant may only operate its business in the Main Floor Area, and may only use other parts of the Premises for their intended purposes, as determined by Landlord. Use and Trade Name. The Demised Premises may be used and occupied only for the purpose of: OFFICE & FACTORY Tenant shall be required to use the highest standards of practice available to Tenant in connection with its conduct of business, so as to promote the reputation of the Property. No activity by Tenant or suffered by Tenant shall be permitted in the Demised Premises which would have a detrimental effect on the reputation of the Property, or would, in Landlord's reasonable discretion, injure or harm the goodwill of the Property in the eyes of the public in general, or the neighboring community in particular. The parties agree that Landlord has relied upon Tenant's occupancy and operation in accordance with the foregoing provisions. Because of the difficulty or impossibility of determining Landlord's damages which would result from Tenant's violation of such provisions, including, but not limited to, damages from Loss of rent from other tenants, and diminished salability, mortgageability, and economic value of the Demised Premises and/or the Property, Landlord shall be entitled to liquidated damages if it elects to pursue such remedy; therefore, for any day that Tenant does not fully comply with the provisions of this Section 5.1, the minimum annual rent, prorated on a daily basis, shall be increased fifty percent, (50%), such sum representing the damages which the parties agree Landlord will suffer by Tenant's noncompliance in addition to all other remedies, Landlord shall have the right to obtain specific performance by Tenant upon Tenant's failure to comply with the provisions of this Section. B. For any use or purpose in violation of the laws of the United States of America or the State of Nevada or the ordinances, regulations and requirements of the County and County wherein the demised premises are situated, Tenant further covenants and agrees that during the term hereof the demised Premises, and every part thereof, shall be kept by Tenant in a clean and wholesome condition, free of any objectionable noises, odors and nuisances, and that all health and police regulations shall, in all respects and at all times, be fully complied with by Tenant.
Use and Trade Name. Tenant agrees to: (i) operate its business in the Premises under the trade name specified in Article I, Section 1.0(r) or such other trade name approved by Landlord, which approval shall not be unreasonably withheld, delayed or conditioned and (ii) use the Premises solely for the permitted use specified in Article I, Section 1.0(s) and for no other business or purpose. Tenant further agrees not to conduct catalog sales in or from the Premises except of merchandise which Tenant is permitted to sell "over-the-counter" consistent with its permitted use. Tenant recognizes that the specific limited use prescribed herein is a material consideration to Landlord in order that the Shopping Center will maintain an appropriate tenant mix so as to produce the maximum Gross Revenue possible for all tenants and to assure the continued operation of a first-class regional enclosed mall shopping center. Notwithstanding the foregoing, Tenant's specific limited use hereunder shall not be construed to imply that Tenant has an exclusive right to conduct the use permitted by Article I, Section 1.0(s). Landlord, in its sole discretion, may permit other tenants or occupants of the Shopping Center to operate the same or similar use unless expressly stated herein to the contrary. If Tenant's business in the Premises is to be conducted pursuant to a franchise agreement, the existence and continuation of such franchise agreement is a material consideration to Landlord in entering into this Lease and if such franchise agreement is terminated, Landlord shall be entitled to treat such event as an event of default and elect any of the remedies provided in Article XXIV.
