Use Covenants. This section shall | shall not apply to this Grant: For Subject Property that is owned by Grantee upon execution of this Grant, Grantee shall record a Use Covenant substantially equivalent to Exhibit F with the county in which the property resides as soon as reasonably practicable after execution of this Grant. For Subject Property acquired by Grantee using Grant Funds, Grantee shall record a Use Covenant substantially equivalent to Exhibit F with the county in which the property resides as soon as reasonably practicable after acquisition of such property.
Use Covenants. Participant covenants and agrees for itself, its successors, assigns, and every successor in interest to the Site or any part thereof, that the Participant shall devote the Site to the uses specified in and shall operate in conformity with this Agreement, the City Deed and the CC&Rs. All uses conducted on the Site, including, without limitation, all activities undertaken by the Participant pursuant to this Agreement, shall conform to all applicable provisions of the City Municipal Code and, to the extent applicable, the Redevelopment Plan.
Use Covenants. 5.1 The Grantor covenants in respect of the Servient Land:
(a) not to use any Residential Lot or permit the same to be used for any use other than residential purposes and not to use any Residential Lot or permit the same to be used for any trading, industrial or commercial purposes, provided however that it is acknowledged that the use of a residential dwelling for a home enterprise use as permitted by the District Plan, use as a bed and breakfast, or the use of a Residential Lot as a sales office by Bridesdale Farm will not be in breach of the provisions of this Instrument;
(b) not to use any Garden Allotment or permit the same to be used as a residential dwelling, granny flat, boarding house or other accommodation or permit the same to be used for commercial or trade purposes other than horticulture, craft and/or home office practices subject to any necessary consents required from the Council, any territorial authority or any third party;
(c) that once construction of a Dwelling on a Residential Lot has commenced, it shall:
(i) complete construction of the Dwelling (including all exterior cladding and painting) to a standard commensurate with the standard of a new single residential dwelling within 12 months of the commencement of construction; and
(ii) complete the landscaping (in accordance with and as required by the Design Guidelines or approval from the Design Guidelines) of the Residential Lot within 2 months after the date of completion of construction of the Dwelling;
(d) that once construction of a Garden Allotment Shed on a Garden Allotment has commenced, it shall complete construction of the Garden Allotment Shed (including all exterior cladding and painting) to a standard commensurate with the standard of a new shed within 6 months of the commencement of construction;
(e) that all Buildings, fences and landscaped areas on the Servient Land must be constructed and finished in a good and workmanlike fashion;
(f) not to erect more than one Dwelling on any Residential Lot;
(g) not to erect or place, or permit to be erected or placed any caravan, mobile home, hut, boat or any structure capable of providing temporary accommodation or other vehicles on the Residential Lot or Garden Allotment, provided that the storage of mobile homes, caravans, cars, tractors, boats and other such items is permitted on the Residential Lots or inside Garden Allotment Sheds once that Dwelling or Garden Allotment Shed has been constructed and completed;

Use Covenants. Developer covenants and agrees for itself, its successors, its assigns, and every successor in interest to the Site or any part thereof, that upon the acquisition of the Site and during the development and operation of the Project thereafter, Developer shall devote the Site solely to the uses specified in, and otherwise comply with the terms and conditions of, this Agreement and, the Authority Declaration. All uses conducted on the Site, including, without limitation, all activities undertaken by the Developer pursuant to this Agreement, shall conform to all applicable provisions of the Riverside Municipal Code.
Use Covenants. (a) Tenant and Landlord agree that Tenant shall construct or rehabilitate multifamily residential housing for low-income, family, elderly, disabled, special needs or other population and uses acceptable to the County on the Land after HUD’s approval of Landlord’s disposition application and/or all applicable RAD or mixed-finance agreements and documents.
(b) Tenant covenants, promises and agrees that during the Term of this Lease it shall not devote the Premises or any part thereof to uses other than those consistent with this Lease and the requirements of all applicable documents to be executed between Landlord and Tenant (collectively, the “Landlord/Tenant Documents”). Without limiting the generality of the foregoing sentence, or the duration of the use restrictions applicable during the Term, Tenant covenants, promises and agrees that:
(i) 50% of the units in the Premises will be set aside for occupancy by residents earning from 60% to 80% or less of the Area Median Income (AMI).
(ii) 50% of the units in the Premises will be RAD-funded PBV units, established via HUD’s 40/60 RAD Blend, set aside for occupancy by residents earning the incomes required to comply with the RAD PBVs and non-RAD Section 18 PBVs.
(iii) It will (a) enter into the RAD HAP Contract when the same is presented by Landlord; (b) apply to Landlord for renewal of the RAD HAP Contract not later than ninety

Borrower covenants and agrees for itself, its successors, its assigns, and every successor in interest to the Project or any part thereof, that the Project shall be used, maintained and operated in compliance with the City Regulatory Agreement. Borrower further covenants and agrees for itself and its successors and assigns that the Affordable Units shall be continuously occupied or held vacant and made available to Qualified Tenants at an Affordable Rent during the Restricted Period. All uses conducted on the Project, including, without limitation, all activities undertaken by Borrower pursuant to this Agreement, shall conform to all applicable provisions of the Santa Xxxxx City Code.
Use Covenants. As set forth in the City Loan Agreement, Developer covenants and agrees for itself, its successors, its assigns, and every successor in interest to the Affordable Project or any part thereof, that the Affordable Project shall be used, maintained and operated in compliance with the City Regulatory Agreement. Developer further covenants and agrees for itself and its successors and assigns that the Affordable Units shall be continuously occupied or held vacant and made available to Qualified Tenants at an Affordable Rent during the Affordability Period. All uses conducted on the Affordable Project, including, without limitation, all activities undertaken by Developer pursuant to this Agreement, shall conform to all applicable provisions of the Santa Xxxxx City Code.
Use Covenants. Developer covenants that each Project it proposes to undertake using Agency Funding will be used strictly in accordance with the provisions of the Redevelopment Plan, and such other covenants as may be required in the applicable Future Agreement.
