User's Warranties. In using the Service you warrant that (a) you are at least 18 years of age and if you represent or are employed by a Person that you are authorized by that Person to use the Service and access that Person's accounts; (b) you will provide when you enroll, and maintain by updates as you use the Service, accurate, current and complete information about yourself and, if requested, all other authorized users of the Service; (c) you will only enroll for the Service for yourself and not for any other person; (d) unless approved otherwise by the Financial Institution, accounts linked to the Service are consumer accounts used for consumer purposes only and not business purposes; (e) you will not reproduce, decompile, reverse engineer, disassemble to derive the source code of, modify, unbundle, make verbal or media translations or create derivative works of the Service. If you provide inaccurate, incomplete or untruthful information or the Service reasonably suspects the information you have provided is inaccurate, incomplete or untruthful your Services may be suspended or terminated without notice at the Service's discretion. In addition with each check image transmitted you warrant that (a) only cash items drawn on financial institutions within the United States, excluding its territories, are being deposited; (b) no foreign items are being deposited; (c) you are not depositing a check that has previously been deposited whether via the Service or at an ATM or at another location and no duplicate files or items are being deposited; (d) the original check will not be deposited; (e) all items are made payable to you, all signatures on each check are authentic and authorized and that each check has not been altered; (f) each check image being deposited is an accurate representation of all information on the front and back of the original check at the time the original check was converted to a check image and the check image contains all endorsements from the original check; (g) each check image being deposited contains a record of all MICR line information required for a Substitute Check and otherwise satisfies all of the requirements of Check 21 and Regulation CC for the creation and/or transferring of a Substitute Check (as defined in Regulation CC) created from that check image; (h) you have complied with all rules, regulations and laws concerning the deposit; (i) your Financial Institution and the Service will not sustain a loss as a result of your deposit of a ch...

User's Warranties. 4.6.1 The User warrants and represents that: (a) it is authorised to contract with the Terminal Operator on the terms of these Standard Conditions in respect of the Container Ship, the Cargo and the Containers, and that it is accepting these Standard Conditions not only for itself, but also as agent for and on behalf of the owners of the Container Ship (if it is chartered by the User), Cargo and Containers or any other person who is or may become interested in the Cargo; (b) all the documentation and information provided by the User or its representatives in relation to any Cargo and/or Containers is full and accurate. 4.6.2 In respect of all Cargo and Containers, the User warrants and represents that they: (a) are properly and sufficiently prepared, packed, stowed, labelled and/or marked, and that the preparation, packing, stowage, labelling and marking are appropriate to any operations or transactions affecting the Cargo and the Containers; (b) are liable to give off any injurious dust, gas, fumes, liquid or radiation; (c) are not infested, verminous, rotten or subject to fungal attack and not liable to become so while at the Container Terminal; (d) are not over-heated or under-heated or liable to become so while at the Container Terminal; (e) will not contaminate or cause danger, injury or pollution or damage to any person, the Container Terminal, any other cargo, equipment or ship or the environment adjacent thereto or generally; (f) require for their safekeeping no special protection (other than as may be agreed in writing between the parties) arising from vulnerability to heat, cold, moisture, salt, pilferage or proximity to other cargo or from inflammability but will remain safe if left standing in the open or in covered accommodation at the Container Terminal if agreed in writing with the Terminal Operator; (g) contain no drugs, prohibited or stolen goods, contraband, pornographic or other illegal matter; and (h) are fit for their intended purpose and in a fit and proper condition to be handled or otherwise dealt with by the Terminal Operator.

User's Warranties. 7.1 The User warrants he or she will not, nor enter into any arrangement or agreement which would allow any third party to, alter or modify the information supplied in ShareScope/SharePad or in any way affect or infringe the User's and its Information Supplier's or their supplier's copyright in ShareScope/SharePad except as permitted under this Agreement. 7.2 The User warrants he or she is a "private investor" within the definitions contained elsewhere in this licence and in any supplementary online agreements signed or made in the course of using ShareScope/SharePad and indemnifies Ionic against all fines and charges that it may incur through the users false declaration of private investor status.
