Work Done by Contractors. If it becomes necessary to consider contracting out work covered by Article 1.01, the Company will make every reasonable effort to advise the Union of the particulars at the earliest possible time, and in any event the Company will provide the Union with semi- annual updates of such particulars. The Union will be invited to provide input to and/or review all stages of the contracting out process. (a) The Company and the Union agree to a joint process to review potential contracting out proposals. The Company and the Union will appoint 2 representatives. It will be the COPE 378 representative’s responsibility to investigate all contracting out proposals prior to the contract being awarded. The COPE 378 representative will investigate items such as:  the type and nature of work to be performed;  the reason for contracting out, including reasons why the work (all or in part) cannot be performed internally by COPE members;  the union status of the proposed contractor; and  whether the contractor has exhibited previous problems or is in good standing at FortisBC. Managers will be notified in writing by COPE378, with a copy to the appropriate Director, of safety or job quality concerns regarding current contractors. In case of an emergency, the Company reserves the right to review the process with the COPE378 representative after the fact. (b) Early consideration, following the COPE 378 representative’s input, will be given to having the work performed by employees within the bargaining unit before contracting out such work. If the Company decides to contract out work, the work will be performed by an independent contractor.

Work Done by Contractors. Where the Company utilizes non-union technicians and/or engineers as a condition of warrantee work and/or supply contract on substation or generation equipment and apparatus, the Company will endeavour to have a bargaining unit employee perform the work. The non-union technician or engineer will confirm the work and a unionized contractor or bargaining unit employee will perform the work in accordance with instructions provided by the engineer or technician. Where this is not possible, a bargaining unit employee will accompany the non-union technician or engineer while he performs the work.

The 20.02 If the Company decides to contract out traditional/core work, this work shall be performed on a "closed shop" basis utilizing unionized contractors whose unions are recognized by the British Columbia Federation of Labour unless mutual agreement is reached to do otherwise. 20.03 The Company agrees that it will not contract out any work at any of its operations if, as a direct result, an employee will be demoted or laid off.
Work Done by Contractors. The Company and the Union agree to establish a joint Union/Company committee which will monitor the implementation of the contracting out provisions of Article 20. An interpretation guideline has been established and will serve to amplify and clarify the intent of this Article. The Joint Contracting Out Policy Committee will revise these guidelines as future situations dictate. Intitially, this committee will consist of the members of the Company and the Union bargaining teams from the 1994/1995 negotations.

  • Sub-Contractors Transfer Agent may, without further consent on the part of Customer, subcontract with other subcontractors for telephone and mailing services as may be required from time to time; provided, however, that the Transfer Agent shall be as fully responsible to the Customer for the acts and omissions of any subcontractor as it is for its own acts and omissions.

  • By Contractor Should the Contractor be liable for any payments to the State hereunder, interest, late payment charges and collection fee charges will be determined and assessed pursuant to Section 18 of the State Finance Law.

  • Claim by Contractor After receipt of the Notice of Termination from the state, the Contractor shall submit any claim for additional costs not covered herein or elsewhere in the Contract within 60 days of the effective termination date, and not thereafter. Should the Contractor fail to submit a claim within the 60-day period, the State may, at its sole discretion, based on information available to it, determine what, if any, compensation is due the Contractor and pay the Contractor the determined amount.

  • Subcontractors The Contractor will not subcontract any work under the Contract without prior written consent of the Department. The Contractor is fully responsible for satisfactory completion of all its subcontracted work. The Department supports diversity in its procurements and contracts, and requests that the Contractor offer subcontracting opportunities to certified woman-, veteran-, and minority-owned small businesses. The Contractor may contact the OSD at xxxxxxx@xxx.xxxxxxxxx.xxx for information on certified small business enterprises available for subcontracting opportunities.

  • Vendor’s Subcontractors TIPS recognizes that many vendors operate in the open market through the use of subcontractors. For that reason, TIPS permits Vendor to utilize subcontractors as authorized and permitted by the TIPS Member Customer. However, all purchase documents must include: (1) Vendor’s Name, as known to TIPS, and; (2) Vendor’s TIPS Contract Name and Number under which it is making the TIPS Sale. Vendor must report the sale pursuant to the terms herein and Vendor agrees that it is legally responsible for all reporting and fee payment as described herein for TIPS Sales even when subcontractors are utilized. The TIPS Administration Fee is assessed on the amount paid by the TIPS Member to Vendor. The Parties intend that Vendor shall be responsible and for actions of subcontractors during a TIPS Sale. Vendor agrees that it is voluntarily authorizing subcontractors and in doing so, Xxxxxx agrees that it is doing so at its own risk and agrees to protect, indemnify, and hold TIPS harmless in accordance with Sections 14-17 above related to subcontractor TIPS Sales made pursuant to this Agreement or purporting to be made pursuant to this Agreement that may be asserted against Vendor whether rightfully brought or otherwise. The Parties further agree that it is no defense to Vendor’s breach of this Agreement that a subcontractor caused Vendor of breach this Agreement.

  • Third Party Contractors Tenant shall obtain and deliver to Landlord, Third Party Contractor’s certificates of insurance and applicable endorsements at least seven (7) business days prior to the commencement of work in or about the Premises by any vendor or any other third-party contractor (collectively, a “Third Party Contractor”). All such insurance shall (a) name Landlord as an additional insured under such party’s liability policies as required by Section 10.3.1 above and this Section 10.6, (b) provide a waiver of subrogation in favor of Landlord under such Third Party Contractor’s commercial general liability insurance, (c) be primary and any insurance carried by Landlord shall be excess and non-contributing, and (d) comply with Landlord’s minimum insurance requirements.

  • Performance by Contractor The Contractor, at the Contractor's own expense, shall, except as herein otherwise specifically provided, furnish and provide all and every kind of labour and superintendence, services, tools, implements, machinery, plant materials, articles and whatsoever is necessary for the due execution of the work. The Contractor shall fully construct and erect the work in the most thorough, professional and substantial manner, in every respect to the satisfaction and approval of the Engineer. The Contractor shall complete the work within the time specified herein and deliver it to the Minister in the manner and upon the terms and conditions of the Contract.

  • CONTRACTOR's Agents and Subcontractors To impose the same restrictions and conditions set forth in this Personal Information and Security Contract on any subcontractors or other agents with whom CONTRACTOR subcontracts any activities under the Agreement that involve the disclosure of DHCS PI or PII to such subcontractors or other agents.

  • HIRING CONTRACTORS The Owner hereby gives power to the Agent to contract, hire, supervise and/or discharge firms and persons, including utilities, required for the operation and maintenance of the Property. The Agent may perform any of the Agent’s duties through attorneys, agents, employees, or independent contractors and, except for persons working in the Agent’s firm, shall not be responsible for their acts, omissions, defaults, negligence and/or costs of same.
