Dismissal of Tenured academic employees and the dismissal of Probationary, Pro-Rata, and Full-Time Annual Contract academic employees during the term of their appointment shall be governed by the remaining sections of this Article and Article XI (Formal Procedures Relating to the Dismissal of an Academic Employee) and are not subject to Article XVI (Grievance Procedure). 2. Dismissals of other academic employees during the terms of their appointments are exempt from the provisions of this Article but subject to the Grievance Procedure. Decisions relating to granting of subsequent employment are vested exclusively with the Employer. SECTION C. Reasons for Dismissal of an Academic Employee/Faculty Member‌ A Full-Time academic employee shall not be dismissed from their appointment except for sufficient cause, nor shall an academic employee who holds a Probationary appointment be dismissed prior to the written terms of the appointment except for sufficient cause. Corrective action pursuant to Article XIII (Fact-Finding, Progressive Corrective Action) shall be utilized prior to dismissal as appropriate to the specific facts of the case involved. Sufficient cause shall mean any of the following: 1. Incompetence in the performance of professional duties. 2. Serious neglect of duty.

It is agreed that this Appendix provides a means for resolving disputes regarding terminations and that such disputes shall not be subject to the grievance procedure of the Agreement.

  • EMPLOYEE CATEGORIES All employees fall into one or the other of four principal categories as outlined below.

  • Employment Categories (a) Employees under this Agreement will be employed in one of the following categories: (i) full-time; (ii) part time; or (iii) casual. (b) At the time of engagement an employer will inform each employee whether they are employed on a full-time, part time or casual basis. An employer may direct an employee to carry out such duties that are within the limits of the employee’s skill, competence and training, consistent with the respective classification.

  • CONTRACT EMPLOYEES Contained in Annexure D.

  • FOREIGN EMPLOYEES 1B VISA costs shall not be passed through to the Authorized User under this Contract. Although Authorized Users will not affirm employment for immigration purposes, an Authorized User may be asked to confirm Contractor’s statement of the individual’s employment for immigration purposes. Based on RFQ security requirements the Authorized User may require that all staff must be citizens of the United States, and if so, Authorized User will indicate in the RFQ.

  • CATEGORIES OF EMPLOYEES The following categories of employees may apply for benefits under this policy: Category 1: Employees who have acquired eighty-five KPERS retirement points (a combination of age and KPERS service that adds to 85) and who have completed by June 30 of the retirement year fifteen (15) years of service in USD 434 that could include service given through the employment of the Three Lakes Cooperative. Category 2: Employee who qualifies for retirement under the basic provisions of KPERS. These employees must have attained the age of 62 and have 10 years of vested service in KPERS but have not acquired eighty-five retirement points at the time of retirement and who have completed by June 30 of the retirement year fifteen (15) years of service in USD 434 that could include service given through the employment of the Three Lakes Cooperative.

  • Excluded Employees Employees excluded from the bargaining unit who work for an Employer signatory to this Agreement may participate in any of the foregoing benefits under rules and regulations established by the Trustees. The trustees shall determine the contributions required for such benefits.

  • Shift Employees Employees who work rotating shift patterns or those who work qualifying shifts shall be entitled, on completion of 12 months employment on shift work, to up to an additional 5 days annual leave, based on the number of qualifying shifts worked. The entitlement will be calculated on the annual leave anniversary date. Qualifying shifts are defined as a shift which involves at least 2 hours work performed outside the hours of 8.00am to 5.00pm, excluding overtime.   • Other Employees Except as may be required in the performance of Employee’s duties hereunder, Employee shall not cause or induce, or attempt to cause or induce, any person now or hereafter employed by the Company or any of its affiliates to terminate such employment. This obligation shall remain in effect while Employee is employed by the Company and for a period of one (1) year thereafter.

  • Displaced Employees In the event of a reduction in the work force, regular employees shall be laid-off in reverse order of seniority, provided that there are available employees with greater seniority who are qualified and willing to do the work of the employees laid-off. An employee who is qualified and yet unwilling to do the work shall be laid-off.

  • Former Employees All Employees terminating service with the Employer during the Plan Year and who have satisfied the eligibility requirements based on the terms of the Employer's accumulated benefits plans checked below (select all that apply; leave blank if no exclusions): a. [ ] The Former Employee must be at least age (e.g., 55) b. [ ] The value of the sick and/or vacation leave must be at least $ (e.g., $2,000) c.
