Additional Federal and State Requirements. This Contract is subject to any additional restrictions, limitations, or conditions enacted by the federal or state governments that affect the provisions, terms, or funding of this Agreement in any manner.
Additional Federal and State Requirements. The City may purchase Good and Services under this Agreement that may be subject to Airport Improvement Program (AIP) and Federal funding requirements, Exhibit E-Contract Provision Guidelines for Obligated Sponsors and Airport Improvement Program Projects. The Contractor is expected to comply with all requirements of the sources of funding for the work under this Agreement for any work pertaining to the Airport subject to Federal and State Requirements. Consultant will provide construction management and project close out services related to the Runway 16-34 Seal Coat & Guidance Sign Reconstruction Project (Project). The Project design is complete, and bids were opened on March 3, 2022. Construction is anticipated to occur in the Summer/Fall of 2022. Design and bidding services are included as a part of a separate agreement and not included in this agreement. The project area encompasses approximately 56,650 square yards of seal coat treatment on Runway 16-34, and twelve (12) connector taxiways to both Taxiway A and Taxiway B, following full crack repair. Runway 16-34 was reconstructed in 2006. Taxiway A connector Taxiways (A1 through A6) were constructed in 2006 or 2012. Taxiway B connector Taxiways (B1 through B6) were constructed in 2010. No sponsor force account work is considered for this project, and any concurrent work conducted by the City or its Consultants will be through a separate agreement, distinct from the AIP-funded contract work, and this scope of work. Consultant will have fifty (50) calendar days to complete the work. The Consultant will perform full-time inspection during the twelve (12) calendar days that work occurs.   • Federal and State Taxes Under this Agreement, the Client shall not be responsible for: Withholding FICA, Medicare, Social Security, or any other federal or state withholding taxes from the Contractor’s payments to employees or personnel or make payments on behalf of the Contractor; Make federal or state unemployment compensation contributions on the Contractor’s behalf; and the payment of all taxes incurred related to or while performing the Services under this Agreement, including all applicable income taxes and, if the Contractor is not a corporation, all applicable self-employment taxes. Upon demand, the Contractor shall provide the Client with proof that such payments have been made.

  • Insurance Requirements Vendor agrees to maintain the following minimum insurance requirements for the duration of this Agreement. All policies held by Vendor to adhere to this term shall be written by a carrier with a financial size category of VII and at least a rating of “A‐” by A.M. Best Key Rating Guide. The coverages and limits are to be considered minimum requirements and in no way limit the liability of the Vendor(s). Any immunity available to TIPS or TIPS Members shall not be used as a defense by the contractor's insurance policy. Only deductibles applicable to property damage are acceptable, unless proof of retention funds to cover said deductibles is provided. "Claims made" policies will not be accepted. Vendor’s required minimum coverage shall not be suspended, voided, cancelled, non‐renewed or reduced in coverage or in limits unless replaced by a policy that provides the minimum required coverage except after thirty (30) days prior written notice by certified mail, return receipt requested has been given to TIPS or the TIPS Member if a project or pending delivery of an order is ongoing. Upon request, certified copies of all insurance policies shall be furnished to the TIPS or the TIPS Member. Vendor agrees that when Vendor or its subcontractors are liable for any damages or claims, Vendor’s policy, shall be primary over any other valid and collectible insurance carried by the Member or TIPS.
