Advanced Parts Replacement. A3.1.1 Mi Support keeps an extensive inventory of new or functionally-equivalent-to- new spare equipment for our Advance Parts Replacement service. Standard parts replacement and shipping costs are included for all Mi Support Maintenance Service levels. If requested, the vNOC Helpdesk can organise special handling or expedited delivery for an additional fee. A3.1.2 Most manufacturers offer a 90-day warranty on software and a 365-day warranty on hardware. Manufacturer warranty generally requires customers to return the faulty equipment (prepaid, insured and packaged appropriately). Once the returned item is received, the manufacturer will return the repaired or replaced item to the customer. A3.1.3 Unlike a manufacturer warranty, Mi Support Maintenance Services replaces faulty parts in advance of receiving the defective equipment. In the event of equipment malfunction or failure, the vNOC Helpdesk will despatch replacement parts to Mi Support Assurance customers no later than the next business day and provide instructions for the return of the faulty parts. For Mi Support Onsite and Onsite+ customers, the vNOC Helpdesk will co-ordinate Mi Support accredited field engineers to install replacement parts. A3.1.4 Title in all replacement parts for the equipment provided by Mi Support in performing the services will pass to the customer upon installation. Upon removal of any replaced parts from the equipment in the course of services title to those replaced parts will pass on removal to Mi Support. All parts supplied by Mi Support under this Agreement shall be new or functionally-equivalent-to- new. A3.1.5 In the case where the customer requests that parts are replaced for no reason other than due to wear and tear but serve no risk to the use of the equipment, an additional charge will be payable by the customer and the replaced part(s) remain under ownership of the customer. All equipment covered under a Mi Support maintenance service is eligible to receive the latest software updates and upgrades. For Mi Support Onsite and Onsite+ customers, software updates or upgrades will be installed to address a fault however, Mi Support does not provide for the installation of the software updates based on new features. Advanced Parts Replacement. The type of support and supported products will be designated on the applicable order or associated quote sheet and support will commence on the in-service date of the Supported Product. The coverage described in this document is limited to Supported Products. It is important to understand how hardware support is different from your warranty coverage. Warranty under your commercial contract generally provides that the hardware will work in accordance with the product’s specifications. In the event that the product does not operate in accordance with specifications, customer will contact manufacturer who will repair or replace the affected product. Remote support includes remote telephone support, remote diagnostics, troubleshooting, problem resolution and firmware updates/fixes; none of which are included under warranty. Reach’s remote support options are standardized and generally available throughout the world. On-site and advance parts replacement services specifics, however, may vary from place to place. Therefore, if you are purchasing on-site services, it is important for you to read the on-site and advance parts service which describes where advanced parts and on-site services are available and the limitations associated with these services.

  • REPAIRED OR REPLACED PARTS / COMPONENTS Where the Contractor is required to repair, replace or substitute Product or parts or components of the Product under the Contract, the repaired, replaced or substituted Products shall be subject to all terms and conditions for new parts and components set forth in the Contract including Warranties, as set forth in the Additional Warranties Clause herein. Replaced or repaired Product or parts and components of such Product shall be new and shall, if available, be replaced by the original manufacturer’s component or part. Remanufactured parts or components meeting new Product standards may be permitted by the Commissioner or Authorized User. Before installation, all proposed substitutes for the original manufacturer’s installed parts or components must be approved by the Authorized User. The part or component shall be equal to or of better quality than the original part or component being replaced.

  • Replacement Parts Replacement parts for goods purchased by Buyer are for the purpose of this Section defined as “Parts” (and are also considered “goods” under this Order). Unless specified otherwise by Buyer in writing, Supplier shall provide Parts (or upon Buyer’s written consent, an alternative replacement part that provides the same form, fit and function as the Part(s)) for a period of twenty (20) years after production of the goods (into which the applicable Parts are incorporated) ceases. Supplier shall continue to supply such Parts past the twenty (20) year period if Buyer orders at least twenty (20) Parts per year during such twenty-year period. The prices for any Parts purchased in the first two (2) years of the twenty-year period shall not exceed those prices in effect at the time production of the goods ceases, and no set up charges shall be permitted by Supplier or paid by Xxxxx during this two-year period. Thereafter, the prices for Parts shall be negotiated based on Supplier’s actual cost of production of such Parts plus any special packaging costs. No minimum order requirements shall apply unless the parties mutually agree in advance. After the end of the twenty-year period, Supplier shall continue to maintain in good working condition all Supplier-owned tooling required to produce the Parts and shall not dispose of such tooling without offering Buyer the right of first refusal to purchase such tooling.

  • Selection of Subcontractors, Procurement of Materials and Leasing of Equipment The contractor shall not discriminate on the grounds of race, color, religion, sex, national origin, age or disability in the selection and retention of subcontractors, including procurement of materials and leases of equipment. The contractor shall take all necessary and reasonable steps to ensure nondiscrimination in the administration of this contract. a. The contractor shall notify all potential subcontractors and suppliers and lessors of their EEO obligations under this contract. b. The contractor will use good faith efforts to ensure subcontractor compliance with their EEO obligations.

  • Repair and Replacement Company shall be responsible to Lessor for reasonable replacement costs, or reasonable repair costs of all Equipment which is lost, stolen, or damaged while in the care, custody and control of Company as a result of Company's sole negligence in accordance with paragraph 2 above, reasonable wear and tear excepted, using the Actual Cash Value of the Equipment at the time of such loss. Prior to repairing the Equipment, Lessor shall submit to Company at least three estimates, including at least one estimate from a repair facility designated by Company. In the event the Equipment is lost or stolen, Company shall file a police report.

  • Installation, Maintenance, Testing and Repair Unless otherwise agreed in writing by the Parties, to the extent required by Applicable Law, Interconnection provided by a Party shall be equal in quality to that provided by such Party to itself, any subsidiary, affiliates or third party. If either Party is unable to fulfill its obligations under this Section 14.2, it shall notify the other Party of its inability to do so and will negotiate alternative intervals in good faith. The Parties agree that to the extent required by Applicable Law, the standards to be used by a Party for isolating and clearing any disconnections and/or other outages or troubles shall be at parity with standards used by such Party with respect to itself, any subsidiary, affiliate or third party.

  • Tool Replacement Personal tools worn out and/or broken on the job will be replaced on a like- for-like basis by the Employer, provided the tool is turned in to the Employer and the Employer had knowledge the tool was being used on the job. If an employee has his/her tools stolen from a state vehicle, the Employer will replace those tools, as long as no employee negligence has occurred.

  • Outage Repair Standard In the event of an outage or trouble in any Service being provided by a Party hereunder, the Providing Party will follow Verizon’s standard procedures for isolating and clearing the outage or trouble.

  • Default – Reprocurement Costs In case of Contract breach by Contractor, resulting in termination by the County, the County may procure the goods and/or services from other sources. If the cost for those goods and/or services is higher than under the terms of the existing Contract, Contractor will be responsible for paying the County the difference between the Contract cost and the price paid, and the County may deduct this cost from any unpaid balance due the Contractor. The price paid by the County shall be the prevailing market price at the time such purchase is made. This is in addition to any other remedies available under this Contract and under law.
