Notwithstanding the foregoing, nurses employed after August shall receive vacation as set out in Article Effective for the vacation time earned to December and subsequent vacation years, a regular part-time nurse who has a minimum of one (I) year of continuous service, shall be granted three (3) weeks vacation time off annually. Vacation pay on earnings to December shall be paid at four (4%)percent for the first two hundred (200) tours of work, and six (6%) percent thereafter for part- time nurses. In the year following completion of six hundred (600) tours, a nurse will be granted four (4) weeks vacation time off annually, with vacation pay at eight (8%) percent of earnings. In the year following completion of twenty-four hundred (2400) tours, a nurse will be granted five (5) weeks vacation time off annually, with vacation pay at ten percent of earnings.
After Years. In the event an employee requires time off due to the illness or injury of the employee’s child, such absence shall be treated as sick leave as set out in Article above. However such leave shall be limited to three (3) scheduled tours of duty for any one absence, with a maximum of six (6) days in any calendar year. The Company agrees to consider the provision of compassionate leave, on an individual basis, to employees who may require additional leave to care for a sick or injured child. An employee who becomes incapacitated through illness or injury during vacation period shall receive vacation time so lost at a later date, provided immediately reports the illness or injury to the Company and upon return to work, produces a doctor’s certificate showing the length and nature of such illness. Vacation time so lost shall be exclusive of Saturdays and Sundays and shall be taken at a time convenient to the Company. However, the illness or injury of an employee’s child shall not constitute reason for reinstatement of vacation time. An employee who is absent on sick leave on the working day before and after a General Holiday shall be paid sick leave for such Holiday. An employee who elects to receive treatment under the Company’s Employee Assistance Program shall be eligible for sick leave in accordance with the provisions of Article for the time spent in a treatment centre. Absence under the provisions of Article shall be reported immediately to the employee’s immediate supervisor. Xxxx leave shall be reported to the Company by the employee’s supervisor or department head on a form provided by the Company. A copy of such form shall be provided to the employee. Any sick leave absence of more than three (3) scheduled tours of duty duration must be substantiated by a medical certificate. If the duration is ten scheduled tours of duty or less, the employee shall produce the medical certificate on return to work. Should the absence be more than ten scheduled tours of duty, the Company shall contact the employee’s home and request that a medical certificate be forwarded to the Company. Failure to produce a medical certificate shall disqualify the employee for those days beyond the initiai three (3) days of any one absence. The Company shall satisfy itself that an employee is medically fit to resume work after any period of illness prior to allowing the employee to resume work.   • Calendar Year Calendar Year" for the purposes of this Agreement shall mean the twelve (12) month period from January 1st to December 31st, inclusive.

  • Tax Periods Beginning Before and Ending After the Closing Date The Company or the Purchaser shall prepare or cause to be prepared and file or cause to be filed any Returns of the Company for Tax periods that begin before the Closing Date and end after the Closing Date. To the extent such Taxes are not fully reserved for in the Company’s financial statements, the Sellers shall pay to the Company an amount equal to the unreserved portion of such Taxes that relates to the portion of the Tax period ending on the Closing Date. Such payment, if any, shall be paid by the Sellers within fifteen (15) days after receipt of written notice from the Company or the Purchaser that such Taxes were paid by the Company or the Purchaser for a period beginning prior to the Closing Date. For purposes of this Section, in the case of any Taxes that are imposed on a periodic basis and are payable for a Taxable period that includes (but does not end on) the Closing Date, the portion of such Tax that relates to the portion of such Tax period ending on the Closing Date shall (i) in the case of any Taxes other than Taxes based upon or related to income or receipts, be deemed to be the amount of such Tax for the entire Tax period multiplied by a fraction the numerator of which is the number of days in the Tax period ending on the Closing Date and the denominator of which is the number of days in the entire Tax period (the “Pro Rata Amount”), and (ii) in the case of any Tax based upon or related to income or receipts, be deemed equal to the amount that would be payable if the relevant Tax period ended on the Closing Date. The Sellers shall pay to the Company with the payment of any taxes due hereunder, the Sellers’ Pro Rata Amount of the costs and expenses incurred by the Purchaser or the Company in the preparation and filing of the Tax Returns. Any net operating losses or credits relating to a Tax period that begins before and ends after the Closing Date shall be taken into account as though the relevant Tax period ended on the Closing Date. All determinations necessary to give effect to the foregoing allocations shall be made in a reasonable manner as agreed to by the parties.

  • Rest Interval After Overtime An employee required to work overtime adjoining his/her regularly scheduled shift shall be entitled to eight (8) clear hours between the end of the overtime work and the start of his/her next regular shift. If eight (8) clear hours are not provided, overtime rates shall apply to hours worked on the next regular shift.
