Annual Reporting Requirements. So long as any Notes remain outstanding, National Rural shall provide Fxxxxx Mac with the following items within 90 days of the end of each Fiscal Year, in each case, in form and substance satisfactory to Fxxxxx Mac:
(a) the Financial Statements for such Fiscal Year;
(b) a Certificate of Pledged Collateral;
(c) a receipt from the Collateral Agent, or such other evidence as is satisfactory to Fxxxxx Mac, as to the Pledged Collateral held by the Collateral Agent at the end of such Fiscal Year; and
(d) such other information concerning National Rural as is reasonably requested by Fxxxxx Mac.
Annual Reporting Requirements.
12.1 Annual Business Plan
a. The Board will ensure that the Minister is provided annually with the LHIN’s annual business plan covering a minimum of three years from the current Fiscal Year that includes a financial budget, a risk management plan, and a communications plan for approval within the timelines established by the Minister for this purpose.
b. The Board is responsible for ensuring that the LHIN’s annual business plan meets the requirements of the AAD.
c. The Board will ensure that the business plan includes a risk assessment and risk-management plan to assist the Ministry in developing its risk-assessment and risk-management plan information in accordance with the requirement of the AAD, to assess risks, develop and maintain necessary records and report to TB/MBC.
d. The Minister will review the LHIN's annual business plan and will promptly advise the Chair whether or not he or she concurs with the directions proposed by the LHIN. The Minister may advise the Chair where and in what manner the LHIN’s plans vary from Government or Ministry policy or priorities as may be required, and the LHIN will revise its plan accordingly.
e. The Board is responsible for ensuring that the LHIN’s annual business plan includes a system of performance measures and reporting on the achievement of the objectives set out in the annual business plan. The system must include performance goals, how they will be achieved, and target results and time frames.
f. In addition, TB/MBC may require the Minister to submit the LHIN’s annual business plan to TB/MBC for review at any time.
Annual Reporting Requirements. Assistant Superintendent shall report the Assistant Superintendent’s use of sick leave and vacation days in the same manner as all other District employees.
Annual Reporting Requirements. Until the Termination Date, the Borrower shall provide the Secretary with the following items within 90 days of the end of each Fiscal Year, in each case, in form and substance satisfactory to the Secretary:
(a) the Financial Statements for such Fiscal Year;
(b) a Certificate of Pledged Collateral as of the end of such Fiscal Year;
(c) a letter substantially in the form of Annex H attached hereto, by KPMG LLP or by such other reputable, independent certified public accountants engaged by the Borrower, who in the judgment of the Secretary have the requisite skills, knowledge, reputation and experience to provide such letter, such letter to be based upon Schedule A to the applicable certificate delivered under paragraph (b) of this Section 6.1;
(d) a receipt from the Collateral Agent (as defined in the Pledge Agreement), or such other evidence as is satisfactory to the Secretary, as to the Pledged Collateral held by the Collateral Agent at the end of such Fiscal Year, such Pledged Collateral to agree with Schedule A to the applicable certificate delivered under paragraph (b) of this Section 6.1;
(e) a projection of the Borrower’s balance sheet, income statement and statement of cash flows over the ensuing five years, pro forma assuming the full principal amount of the Bond is advanced;
(f) the most recent credit assessment of the Borrower issued by a Rating Agency;
(g) the most recent Senior Secured Credit Rating issued by a Rating Agency; and
(h) such other information as is reasonably requested by the Secretary.
Annual Reporting Requirements. On each anniversary of this Agreement, the Cooperating Entity shall report on an annual basis on a monitoring form as approved by LMFB. The form shall be sent to: 1) the Director of the DSA; and (2) the Director of LMFB. For the purposes of this Agreement, the anniversary date for reporting purposes shall be the date of recording of this instrument in the applicable registry of deeds.
Annual Reporting Requirements. The Superintendent shall report to the Board in writing on an annual basis the Superintendent’s use of sick leave and other leave benefits.
Annual Reporting Requirements. Beginning with the first occupancy of any Affordable Unit, Developer shall provide an annual report (“Annual Report”) to the Agency regarding the Rental Affordable Units, which shall be submitted on each anniversary date of the Effective Date of this Covenant. The Annual Report shall include the following:
(a) the number and identification of the Rental Affordable Units, by bedroom count, that are occupied;
(b) the number and identification of the Rental Affordable Units, by bedroom count, that are vacant;
(c) for each Rental Affordable Unit that is vacant or that was vacant for a portion of the reporting period, the manner in which the Rental Affordable Unit became vacant (e.g. eviction or voluntary departure) and the progress in re-leasing that unit;
(d) for each occupied Rental Affordable Unit, the names and ages of all persons in the Household, the Household size, date of initial occupancy, and total Annual Household Income as of the date of the most recent Certification of Income;
(e) a sworn statement that, to the best of Developer’s information and knowledge, the Household occupying each Rental Affordable Unit meets the eligibility criteria of this Covenant;
(f) a copy of each new or revised Certification of Income for each Household renting a Rental Affordable Unit;
(g) a copy of each new or revised Certification of Residency for each Household renting a Rental Affordable Unit;
(h) a copy of each inspection report and Certification of Inspection for each Rental Affordable Unit; and
(i) a copy of all forms, policies, procedures, and other documents reasonably requested by the Agency related to the Rental Affordable Units. The Annual Reports shall be retained by Developer for a minimum of five (5) years after submission and shall be available, upon reasonable notice, for inspection by the Agency or its designee. Notwithstanding anything contained herein to the contrary, in the event that Developer provides a report to an agency within the District government with content substantially similar to the content of the Annual Reports described in this section, subject to the Agency’s prior written approval, then the reporting requirements under this section shall be satisfied upon Developer’s delivery of such report to the Agency. The Agency may request Developer to provide additional information in support of its Annual Report.
Annual Reporting Requirements. So long as any Bonds remain outstanding, Issuer shall provide or shall cause the REIT to provide Xxxxxx Mac with the following items within 90 days of the end of each Fiscal Year, in each case, in form and substance reasonably satisfactory to Xxxxxx Mac:
(a) the Financial Statements for such Fiscal Year;
(b) a Certificate of Pledged Collateral;
(c) an inventory from the Collateral Agent (if not Xxxxxx Mac), or such other evidence as is reasonably satisfactory to Xxxxxx Mac, as to the Qualified Collateral held by the Collateral Agent (if not Xxxxxx Mac) at the end of such Fiscal Year;
(d) the Nonperforming Asset Rate as of the last day of the end of the immediately preceding Fiscal Year; and
(e) such other information concerning Issuer, the Operating Partnership, the REIT, the Borrowers, or the Qualified Collateral as is reasonably requested by Xxxxxx Mac.
Annual Reporting Requirements. Beginning six (6) months after the Effective Date of this Compliance Agreement, and continuing annually on April 30 each year thereafter, TVA shall submit annual reports to EPA, the States, and the Citizen Plaintiffs electronically as required by Section V.I (Periodic Reporting). EPA, the States, and the Citizen Plaintiffs reserve the right to request such information in hard copy. In such annual reports, TVA shall include the following information:
A. System-Wide Annual Tonnage Limitations for NOx and SO2 TVA shall report the following information: (1) the total actual annual tons of the pollutant emitted from each Unit or, for Units sharing a common stack, the total actual annual tons of the pollutant emitted from each combined stack, within the TVA System and any New CC/CT Units during the prior calendar year; (2) the total actual annual tons of the pollutant emitted from the TVA System and any New CC/CT Units during the prior calendar year; (3) the difference, if any, between the System-Wide Annual Tonnage Limitation for the pollutant in that calendar year and the amount reported in subparagraph (2); and (4) for each pollutant, (a) the annual average emission rate, expressed as lb/mmBTU, for each Unit within the TVA System and any New CC/CT Units in the prior calendar year and (b) the annual average emission rate, expressed as lb/mmBTU, for the entire TVA System and any New CC/CT Units during the prior calendar year. Data submitted pursuant to this subsection shall be based upon CEMS pursuant to Paragraphs 85 and 101. If TVA was subject to an adjusted System-Wide Annual Tonnage Limitation specified in Paragraphs 72 and 87 in the calendar year covered by the annual report, it shall report the following: (1) the Units at which the adjusted System-Wide Annual Tonnage Limitations in Paragraphs 72 and 87 apply and (2) the adjusted aggregate System-Wide Annual Tonnage Limitation.
B. Continuous Operation of Pollution Control Technology or Combustion Controls TVA shall report the date that it commenced Continuous Operation of each SCR, FGD, PM Control Device, SNCR, LNB, OFA, and SOFA that TVA is required to Continuously Operate pursuant to this Compliance Agreement in the calendar year covered by the annual report.
