Appeal from Discharge or Suspension. (a) A Local Union desiring to grieve the discharge or suspension of an employee shall within fourteen (14) calendar days of the receipt of the written notice of discharge or suspension, or where applica- ble the written notice of intent to discharge, advise the Employer by certified or registered mail that the discharge or suspension is protested. Failure of the Union to protest within the fourteen (14) calendar day period shall conclusively waive the right to review.

Appeal from Discharge or Suspension. A discharged or suspended employee must notify his Local Union, in writing, within three (3) days, excluding Saturdays, Sundays and holidays, after returning to his home terminal, of his desire to appeal the discharge or suspension. Notice of appeal from discharge or suspension must be made to the Employer, in writing, within ten (10) days, excluding Saturdays, Sundays and holidays, from the date of discharge and/or return to his home terminal, whichever is later. If the Employer and Union are unable to agree as to a settlement of this case, then it may be appealed to the grievance machinery as set forth in Article 7.
Appeal from Discharge or Suspension. A nurse desiring to appeal a suspension or discharge shall present a grievance in writing within (10) ten calendar days after the suspension or discharge. The grievance shall be presented directly to the Human Resources Designee. The Human Resources Designee shall meet with the grievant and an Association representative within (10) ten calendar days of the Employer’s receipt of the grievance. The Human Resources Designee shall respond in writing within (7) seven calendar days from the meeting. If the grievance is not resolved on the basis of the foregoing procedure, the Association shall notify the Employer and shall simultaneously apply directly to the Federal Mediation and Conciliation Services within (7) seven calendar days of receipt of the Human Resources Designee’s reply for a panel of seven arbitrators in the manner described in Step 4 of the grievance procedure. If the case is submitted to arbitration, then the arbitration procedure as outlined in the grievance procedure shall be followed.

If an employee who is not serving his probationary period claims to have been unjustly discharged or suspended during the life of this Agreement or any continuance thereof, to be timely his case must, STEP 1 within seven (7) days of the date of notice to the Local Union of such discharge or suspension, be referred in writing to the Mill Manager or his representative through the Local Union President or his representative.

  • DISCHARGE OR SUSPENSION The Employer shall not discharge nor suspend any employee with- out just cause, but in respect to discharge or suspension shall give at least one (1) warning notice of a complaint against such employ- ee to the employee, in writing, and a copy of the same to the Union, except that no warning notice need be given to an employee before he/she is discharged if the cause of such discharge is dishonesty, drinking alcoholic beverages or being under the influence of drugs or in illegal possession of drugs during the workday (including meal period) or drunkenness, recklessness resulting in serious acci- dent while on duty, or the carrying of unauthorized passengers while on the job or offenses of equal seriousness. Except for seri- ous accidents, a driver will not be removed from the payroll during an investigation of an accident. The driver can be assigned to non-driving work during this period. Before disciplinary action is taken, a meeting shall be held with the employee and the employee shall have the right to choose a Xxxxxxx who is readily available and on the premises. In the case of discharge for any offense other than the above mentioned, including suspension, the disciplinary action will be held in abeyance for two (2) weeks to give the Local Union the opportunity to intervene prior to the action being taken. The warning notice, suspension or discharge as herein provided shall not remain in effect for a period of more than nine (9) months from the date of said warning notice, suspension or discharge. Any disciplinary action will list the violation(s) and be by proper written notice to the employee and the Union affected. Disci- plinary letters must be issued by the Company within ten (10) working days after the incident. Any employee may request an in- vestigation as to his/her discharge or suspension. Should such in- vestigation prove that an injustice has been done an employee, he/ she shall be reinstated. The C.P.A.P.G.C. or the impartial arbitrator shall have the authority to order full, partial or no compensation for time lost. Appeal from discharge or suspension must be taken with- in ten (10) days by written notice and a decision reached within thirty (30) days from the date of suspension or discharge. An em- ployee shall be given a copy of any Company form or document signed by the employee if requested. The Company will not use absenteeism or accidents in conjunction with any other disciplinary action.

  • Unjust Suspension or Discharge Should it be found upon investigation that an employee has been unjustly suspended, discharged or disciplined, such employee shall be immediately reinstated in his/her former position, without loss of seniority, and shall be compensated for all time lost in an amount equal to his/her normal earnings plus interest, or by any other arrangement as to compensation which is just and equitable in the opinion of the parties or in the opinion of the arbitrator if the matter is referred to such arbitrator.

  • DISCHARGE, SUSPENSION AND DISCIPLINE 14.01 (a) In the event an Employee is suspended as a disciplinary measure and the Employee considers that an injustice has been done, the matter may be taken up at Step 2 of the Grievance Procedure.

  • TERMINATION OR SUSPENSION 10.1. The CONTRACTOR shall be considered in material default of this Agreement and such default will be considered cause for the CITY to terminate this Agreement, in whole or in part, as further set forth in this section, for any of the following reasons: (a) failure to begin work under the Agreement within the times specified under the Notice(s) to Proceed, or (b) failure to properly and timely perform the services to be provided hereunder or as directed by the CITY, or (c) the bankruptcy or insolvency or a general assignment for the benefit of creditors by the CONTRACTOR or by any of the CONTRACTOR's principals, officers or directors, or (d) failure to obey laws, ordinances, regulations or other codes of conduct, or (e) failure to perform or abide by the terms or spirit of this Agreement, or (f) for any other just cause. The CITY may so terminate this Agreement, in whole or in part, by giving the CONTRACTOR at least 3 calendar days’ written notice.

  • Service Termination, Cancellation, or Suspension If you wish to cancel the Service, you may contact us as set forth in Section 6 of the General Terms above. Any payment(s) that have begun processing before the requested cancellation date will be processed by us. You agree that we may terminate or suspend your use of the Service at any time and for any reason or no reason. Neither termination, cancellation nor suspension shall affect your liability or obligations under this Agreement.

  • TERMINATION OR SUSPENSION OF SERVICES Return of Data The Contractor shall return Data in a format agreed upon within the Authorized User Agreement or as agreed to with the Authorized User. This can, if specified within the Authorized User Agreement, be carried out by providing an application programmable interface or other such efficient electronic tools. The Contractor must certify that all Data has been removed from its system and removed from backups within timeframes established in the Authorized User Agreement or as agreed to with the Authorized User. Suspension of Services During any period of suspension of service, the Authorized User shall have full access to all Data at no charge. This can, if specified within the Authorized User Agreement, be carried out by providing an application programmable interface or other such efficient electronic tools. The Contractor shall not take any action to erase and/or withhold any Authorized User Data, except as directed by the Authorized User. Expiration or Termination of Services Upon expiration or termination of an Authorized User Agreement, the Authorized User shall have full access to all Data for a period of 60 calendar days. Unless noted in the original Authorized User Agreement, this period will be covered at no charge. This can, if specified within the Authorized User Agreement, be carried out by providing application programmable interface or other such efficient electronic tools. During this period, the Contractor shall not take any action to erase and/or withhold any Data, except as directed by the Authorized User. An Authorized User shall have the right to specify a period in excess of 60 calendar days in its RFQ. RESERVED RESERVED
