Assault Leave Notwithstanding the provision of Section 3319.141 of the Ohio Revised Code, the employer will grant assault leave to cover employee absence due to disability resulting from assault under the following conditions. Any certified teacher who must be absent from his or her duties due to disability resulting from an assault which occurs in the course of an employee's Board employment, on or off school premises before, during or after school hours will be paid his or her full scheduled compensation for a maximum period of thirty (30) days. If permanently disabled, the teacher must apply for disability retirement and no assault leave shall be granted after such retirement has been approved. The period of such absence, as defined in this provision, shall be termed "assault leave." Before assault leave can be approved, the teacher shall furnish to the superintendent a written, signed statement describing the circumstances and events surrounding the assault, and the cause thereof, including the location and time of the assault, name and address of victims and witnesses and a description of the injuries sustained by each victim of the assault, unless physically impossible to do so. If medical attention is required or sought, the teacher shall also furnish to the Superintendent a statement of the nature of the disability and its duration, which has been signed by a physician licensed in the State of Ohio. Falsification of either the written, signed statement of the events or circumstances surrounding the assault, or the physician's statement shall be grounds for suspension or termination of employment under 3319.16 O.R.C. Assault leave, which is approved by the Superintendent, shall not be charged against sick leave earned or earnable by the teacher on leave granted under regulations adopted by the Board, pursuant to 3319.08 O.R.C. or any other leave to which the teacher is entitled. Assault leave benefits shall not be paid if Workers' Compensation benefits are paid to the teacher.
Funeral/Bereavement Leave In the event of death in the immediate family of an employee, the employee will be granted leave of absence with pay, with consideration given to travel time for the purpose of attending the funeral. The length of such absence shall be at the discretion of the Employer. The term "
Civil Leave Section 1. The Employer recognizes the responsibility of its employees to fulfill their civic duties as jurors and witnesses in court proceedings. The Employer agrees therefore to grant civil leave with pay to permanent employees:
ARTICLE BEREAVEMENT LEAVE An Employee who would otherwise have been at work shall be allowed up to three (3) days’ leave with pay in the event of the death of a member of immediate family and such leave will not be charged against the Employee’s attendance credits. For the purpose of this section, “immediate family”, shall include the Employee’s spouse, common-law spouse, mother, father, stepmother, stepfather, mother-in-law, father-in-law, son, daughter, son-in-law, daughter-in-law, stepson, stepdaughter, brother, sister, brother-in-law, sister-in-law, xxxxxx parents, legal guardians, grandchildren and the grandparents of the Employee and spouse or any relative with whom the Employee lives. Necessary travelling time in addition to the three (3) days may be granted at the discretion of the Police Chief. It is the responsibility of the Employee to request this leave from supervisor. It is the responsibility of the supervisor to obtain the decision of the Police Chief, or designate, as applicable, and for advising the Employee of the decision made.
Assault Any case of assault upon a teacher which occurs in the line of duty shall promptly be 20 rights and obligations with respect to such assault, and its legal assistance to the teacher in 21 connection with handling of the incident by law enforcement and judicial authorities. In such 22 event, the following shall apply:
Training Leave An employee appointed or elected as an accredited representative of the union shall, upon application in writing to the employer, be granted up to 5 days leave with pay each calendar year (non-cumulative) to attend appropriate courses: • Such courses shall be designed and structured with the objective of promoting good industrial relations within the building and construction industry. • Consultation may take place between the parties in the furtherance of this objective Accredited representative of the union shall mean a job xxxxxxx recognised by the employer. The following shall apply: Employees covered by Agreement Max. No. of employees to attend per year Xxx. No. of days per year Up to l5 1 5 31-50 3 15 51-100 4 20 101 and over 5 25 The application for leave shall be given to the employer at least 6 weeks in advance of the commencement of the course. The application shall contain the following details: • The name of the employee seeking leave • The period of time for which the leave is sought (including dates and daily commencing and finishing times) and • The title, general description and structure of the course to be attended and the location of where the course is to be conducted. The employer shall advise the union within seven clear working days (Monday to Friday) of receiving the application as to whether or not the application for leave has been approved. The time of taking leave shall be arranged so as to minimise any adverse effect on the employer’s operations. The onus shall rest with the employer to demonstrate an inability to grant leave when an eligible employee is otherwise entitled. An employer shall not be liable for any additional expenses associated with an employee’s attendance at a course, other than the payment of ordinary time earnings for such absence. For the purposes of this clause ordinary time earnings shall be defined as the relevant award classification rate, shift work loadings plus over-award payments. Leave rights granted in accordance with this clause will not result in additional payment for alternative time off to the extent that the course coincides with an employee’s day off in the 19 day month work cycle. An employee on request by their employer shall provide proof of their attendance at any course within 7 days. If an employee fails to provide such proof the employer may deduct any amount already paid for attendance from the week’s pay or any monies due to the employee. Where an employee is sick during a period when leave under this provision has been granted proof of attendance at the course is not required for that period and the employee shall receive payment in accordance with personal leave provisions. Leave of absence granted in accordance with this clause shall count for all purposes of employment.
Funeral and Bereavement Leave 19.01 In the event of death in the immediate family of an employee, the employee will be granted leave of absence with pay, with consideration given to travel time for attending the funeral. The length of absence shall be up to three (3) days at the discretion of the Employer. The term ‘immediate family’ shall mean: spouse, parent, child, brother, sister, step-mother, step-father, step-son, step-daughter, step-brother, step-sister, mother-in-law, father-in-law, sister-in-law, brother-in-law, daughter-in-law, son-in-law, grandmother, grandfather, and grandchildren, or any relative living in the household of the employee. In the event of the demise of an aunt or uncle, nephew or niece, an employee will be granted one (1) day leave of absence with pay to attend the funeral. In the case of death of spouse, father, mother, child, step-parent or step-child, the employee shall be entitled to, up to one (1) weeks leave of absence with pay.
Personal Illness and Injury Leave 1. Full-time employees shall be entitled to ten (10) days leave with full-time pay for each school year for purposes of personal illness or injury. Employees who work less than full-time shall be entitled to that portion of the ten (10) days leave as the number of hours per week of scheduled duty relates to the number of hours for a full-time employee in a comparable position.
Medical Leave Pursuant to applicable provisions of the Civil Service Rules, County Code, and other law, medical leaves of absence will be granted by the employee’s Department Head upon request only upon submission of a doctor’s certificate or other satisfactory medical evidence of the employee’s need for such leave.
Bereavement Leave (a) Upon the death of an employee's spouse, spouse to include same sex partner, child or stepchild, an employee shall be granted leave up to a maximum of five (5) continuous calendar days without loss of pay. One of the days of leave shall include the day of the funeral or equivalent service. Additional days off with or without pay may be granted by the Employer. Part-time employees will be credited with seniority and service for all such leave. In the event of a delayed interment or ceremony for reason of religion or other protected grounds under the Ontario Human Rights Code, an Employee may save one of the days identified above without loss of pay to attend the interment or ceremony.
