ASSAULT ON TEACHERS. In the event of an assault upon a teacher by a student, the Board shall render reasonable assistance to the teacher in dealing with law enforcement authorities who may investigate such incident. Any student threatening or assaulting a teacher shall be subject to disciplinary action pursuant to Board policy, including a suspension or exclusion where appropriate.

ASSAULT ON TEACHERS. Any case of employment-related assault upon a teacher shall immediately be reported to the Board or its designated representative(s). The Board shall provide legal counsel to advise the teachers of their rights and obligations in connection with handling of the incident by law enforcement and judicial authorities.
ASSAULT ON TEACHERS. Any assault on a teacher shall be reported to the principal immediately. Teachers are expected to exert their best efforts and professional judgment to maintain discipline in the school. If circumstances warrant, a teacher may use physical restraint to stop a fight. A teacher who is absent from assigned duties as a result of personal injury caused by physical assault or other violent criminal acts committed in the course of the teacher’s employment activities shall receive workers’ compensation or comparable benefits without loss of accumulated or granted sick, personal, or professional leave. A signed statement listing the cause of the absence shall be provided by the employee on forms furnished by the director of schools and shall promptly be given to the immediate supervisor in support of all claims. A certificate from the physician on forms furnished by the director of schools may also be required to verify the extent of the injury. FRINGE BENEFITS Planning Time and Duty Free Lunch Periods In schools providing a lunch period for students, all teachers shall be provided a lunch period free of assigned duties. The lunch period for each teacher shall be at least the same amount of time as that allowed for students. The Supervisor of Instruction may examine school schedules and recommend to the administration possible solutions for providing planning periods. Individual school administration and faculties will design a schedule to permit planning time subject to the approval of the director of schools.
ASSAULT ON TEACHERS. 1. Any case of assault upon an employee by a student must be promptly reported to the principal. The District will provide legal counsel to defend the employee with respect to such assault. An employee may use reasonable force to protect himself/herself from attack or prevent injury to any individual. The definition of an assault being, causing or attempting to cause physical harm through force or violence. The accused student shall immediately be removed from that staff member’s classroom (i.e, certified staff/instructional paraprofessional) to provide all parties due process and a thorough investigation. The student committing the assault shall not return to the classroom until an investigation has been concluded by the building administrator/supervisor and the certified staff has been briefed on the outcome of the investigation.

  • Assault Leave Any employee who must be absent from his or her duties due to physical disability resulting from an assault by a student or the parent or legal guardian of a student of this system, while on duty and engaged in school- related activities, on or off school premises, before, during or after school hours, will be paid his or her full scheduled compensation for a maximum period of fifteen (15) days. Assault shall be defined as intentional physical touching. If permanently disabled, the employee must apply for disability retirement and no assault leave shall be granted after such retirement has been approved. The period of such absence, as defined in this provision, shall be termed "Assault Leave." Before Assault Leave can be approved, the employee shall furnish to the Superintendent, a written, signed statement describing the circumstances and events surrounding the assault and the cause thereof, including the location and time of the assault, name and address of victims and witnesses, and a description of the injuries sustained by each victim of the assault. If medical attention is required or sought, the employee shall also furnish to the Superintendent a statement of the nature of the disability and its duration, which has been signed by a physician licensed in the State of Ohio. Falsification of either the written signed statement of the events or circumstances surrounding the assault or the physician's statements shall be grounds for suspension or termination of employment. Assault Leave, which is approved by the Superintendent, shall not be charged against sick leave earned or earnable by the employee or any other leave to which the employee is entitled. Assault leave shall be immediately paid to the employee by the district at the employee’s current rate of pay and if Worker’s Compensation is applied for and granted, the employee shall reimburse Springfield City School District at the rate paid by Worker’s Compensation after payment is received from Worker’s Compensation. The Board may require an examination by and a certificate from a licensed physician, chosen and paid by the Board that the employee was disabled from performance of any duties which the employee is qualified to perform and the nature and duration of such disability. The employee is encouraged to file appropriate action against the person committing the assault, including criminal charges or civil action or both, in case of any assault or injuries.

  • Assaults An employee who is assaulted while in the performance of assigned duties shall promptly report the assault to the Employer. The Employer shall promptly investigate the incident and render such assistance as necessary under the circumstances, including reporting and cooperating with law enforcement authorities.

  • ON-THE-JOB INJURY (a) If an employee is injured to such an extent that they are obliged to cease work, their wages will continue for the balance of the day on which the injury occurred.
