Board Level. In the event that the Union is not satisfied with the disposition of the grievance at the Mediation level, the Union may, in its sole discretion, appeal same to the Board of Education by filing a copy of the written grievance and answer by the Superintendent, along with the reasons for rejecting the Superintendent's disposal of the grievance, with the Secretary of the Board of Education not less than five (5) days prior to the next regularly scheduled board meeting. Upon receipt of the grievance by the Board of Education, the board shall, within one (1) month, schedule a hearing on the grievance with the Board Grievance Committee to hear the grievance. If disciplinary in nature, hearing before the Board Grievance Committee will be closed. Within ten (10) days, the board shall render its written decision concerning the grievance through the Superintendent and transmit it to the Union. The Union shall have the right to have its officers and grievance chairperson or Union's designee present at the hearing along with the grievant. In the event CESPA is not satisfied with the Board's response, it may submit a specific issue of dispute to the board. The Board will have thirty (30) days to respond. If the specific issue is still not resolved, it may be submitted by CESPA for binding arbitration.
Board Level. If the grievant is not satisfied with the Superintendent's or his/her designee's response, the grievant shall notify the Treasurer of the Board within ten (10) days from the Superintendent's or his/her designee's decision. Within ten
Board Level. There shall be established a Committee to be known as the Labor/Management Committee for the State and Community Colleges. The purpose of the Committee shall be to discuss matters of system-wide applicability, which are of mutual concern to the Board and the Union. Each Committee shall be comprised of six (6) members; three (3) representing the Board and three (3) representing the Union. Such representatives shall be appointed respectively by the Vice Chancellor for Employee Relations of the Board and the Union. In addition, the Vice Chancellor for Employee Relations of the Board shall designate the chairperson for management and the Union shall designate the chairperson for the Union. There shall be two meetings per year, unless mutually agreed otherwise, with the position of chairperson alternating between the Board and the Union. Both parties may submit items for the agenda to the chairperson at least two (2) weeks in advance of any scheduled meetings. The agenda shall be distributed one (1) week in advance. It is understood that said Committee shall not discuss pending grievances and shall have no power to negotiate, alter, or amend the terms of this Agreement.
Board Level. The following clause will be included in the shareholders agreement and the articles of association of the Domestic Company before the First Closing and become effective only in the event of (i) termination of the Control Documents for any reasons; or (ii) collapse of the Captive Structure. “The following key business decisions (“Key Matters”) of the Domestic Company and its subsidiaries (collectively the “Domestic Group” and each a “Domestic Group Member”) will be approved by a simple majority of the board of directors of the Domestic Company (which must include the approval of the director nominated by WP Designee):
(a) IPO of the Domestic Group;
(b) any amendment to, modification of or change in any Control Documents;
(c) any increase or deduction of the registered capital of the Domestic Company;
(d) merger, acquisition, division, reorganization, change of corporate form or other similar procedure of the Domestic Company;
(e) any amendment to the articles of association of the Domestic Company; and any amendment to the articles of association of any other Domestic Group Member to the extent such amendments could reasonably be expected to adversely affect WP Designee’ rights or privileges in relation to the onshore investment;
(f) any voluntary commencement of liquidation, dissolution or other similar procedure of the Domestic Company or any Material Domestic Group Member, and “Material Domestic Group Member” means any Domestic Group Member (other than the Domestic Company) either gross revenue or net income of which of the preceding financial year accounts for 5% or more of the total gross revenue or total net income of the Domestic Group of the preceding financial year;
Board Level. If the answer of the Superintendent, or his/her designee, does not satisfactorily resolve the grievance, the grievant and/or the Organization may within ten (10) days after receipt of the written answer from the Superintendent, or his/her designee, submit the grievance to the Board in writing, including the answer of the Superintendent, or his/her designee, and the immediate supervisor. The Board shall hear the grievant and/or the Organization and shall submit a written answer to the grievance to the grievant and/or the Organization within twenty (20) calendar days after receipt of the grievance. Winter and Spring breaks excluded.
Board Level. Within ten (10) working days after receiving the written decision of the Superintendent, a written appeal from the decision may be made to the Board. A copy of the original grievance, all prior appeals and all prior decisions, if any, and any additional material deemed necessary by the appellant shall accompany the appeal.
a. No later than ten (10) working days after receipt of the appeal, the Board shall hold a hearing on the grievance. Any hearings held under this Article shall be conducted at a time and place that will afford a fair and reasonable opportunity for all persons entitled to be present to attend.
b. Within ten (10) working days after the hearing required in Step 3.a. above, the Board shall communicate its decision, in writing, together with supporting reasons to the Principal, the Superintendent, the Union representative, the President of the Union, and to the aggrieved teacher, if any.
Board Level. After receiving the decision of the Superintendent, the Aggrieved may choose, within five (5) work days, and prior to submitting the grievance to the OAPSE Grievance Review Committee, to submit the grievance to the Board of Education. At the next meeting of the Board following such submission, the members of the Board and the aggrieved shall meet in Executive Session to openly discuss the matter of the grievance, and any possible resolutions. If no resolution is reached with in five (5) work days of the next Board meeting, the aggrieved may submit the grievance to the OAPSE Grievance Review Committee. Within ten (l0) workdays, the Review Committee shall decide whether to submit the grievance to Level Three.
Board Level. If dissatisfied with the outcome of the previously mentioned stages, any employee or an organization representing the employee may refer the grievance to the Board by arranging through the Superintendent for an appointment with the Board. The Superintendent shall prepare a review of the case for the Board. The Board shall also be given a statement from the aggrieved reviewing previous efforts to resolve the disagreements.
Board Level. Within five (5) working days after the Superintendent or his designee renders his decision, an appeal may be taken by the grievant from that decision to the Board. Within thirty (30) working days after the appeal is filed, the Board will hold a hearing on the grievance. The hearing will be informal, but the parties will be allowed to state their views fully. The parties shall be entitled to present witnesses. Within ten (10) working days after the hearings on appeal, the Board will communicate its decision in writing to the grievant.
Board Level. If the Association is not satisfied with the disposition of the grievance by the College President, the grievance shall be transmitted to the Board of Trustees. A written Notice of Appeal, setting forth the basis for the appeal, shall be filed with the Board Secretary within fourteen (14) days of receipt of the President's decision. The Board shall hear the grievance at the regular Board of Trustees meeting unless the appeal is filed within seven (7) days of the next regularly scheduled meeting, in which case the grievance shall be heard at the following regularly scheduled meeting. The grievance, together with a record of the prior proceedings, shall be presented to the Board. The Board shall have the option of considering the appeal in an open or closed hearing session. No later than fourteen (14) days after the conclusion of the hearing, the Board shall render its decision in writing to the Association, the grievant, and the President.
