Certificate of Practical Completion. The Contractor shall not less than [4] weeks prior to the anticipated Practical Completion Date, give written notice to the Contract Administrator of the date the Contractor expects Practical Completion to take place. Following notification by the Contractor to the Employer of the Contractor’s desire to hand over the Works to the Employer on Practical Completion the Employer shall within 10 Working Days of such notification procure that the Contract Administrator shall inspect the Works and if in the Contract Administrator is of the reasonable opinion that Practical Completion has taken place the Contract Administrator will issue the Practical Completion Statement. Any dispute as to whether or not Practical Completion has taken place will be referred to adjudication in accordance with clause 13.
Certificate of Practical Completion. (a) When the Contractor considers that the Works have achieved completion sufficient to enable the successful completion of the Test on Completion pursuant to Clause 21, he may notify the Superintending Officer in writing to that effect.
(b) Within 14 Days of receipt of such notice, the Superintending Officer shall carry out an inspection of the Works and the carrying out the Test on Completion pursuant to Clause 21 and as prescribed under the Contract. Pursuant to such inspection and test the Superintending Officer shall do either one of the following:
(i) Issue to the Contractor a Certificate of Practical Completion if in his opinion the whole of the Works have achieved Practical Completion and have satisfactorily passed any Test on Completion pursuant to Clause 21 and prescribed under the Contract, subject to the Contractor giving a written undertaking to complete any minor outstanding works after issuance of Certificate of Practical Completion but within the stipulated time during the Defects Liability Period. Provided always that such ‘minor outstanding works’ shall not affect the intended use and occupation of the Works and shall be determined solely by the Superintending Officer. The Superintending Officer shall state in the said Certificate of Practical Completion the date on which the Works have achieved Practical Completion and handed over to the Employer; or
(ii) Give instructions to the Contractor specifying all the works which in his opinion are required to be completed by the Contractor before the issue of a Certificate of Practical Completion.
(c) If the Superintending Officer has given instructions pursuant to sub-clause 20.2(b)(ii), the Contractor shall not be entitled to the Certificate of Practical Completion until the works specified in the said instructions have been completed to the satisfaction of the Superintending Officer.
Certificate of Practical Completion. The Parties agree that:
6.8.1 upon the completion of an Infrastructure Project, the Owner must notify Council and any other relevant authority;
6.8.2 within 14 days of receiving notice of the completion of an Infrastructure Project from the Owner, Council will arrange for it and any other relevant authority to inspect the Infrastructure Project and determine whether Council will issue a Certificate of Practical Completion;
6.8.3 prior to Council being required to issue a Certificate of Practical Completion, the Owner must provide to Council:
(a) a copy of any maintenance information, operational manual or other material which is reasonably required for the ongoing operation and maintenance of the Infrastructure Project;
(b) a copy of any certificate, consent or approval required by any authority for the carrying out, use or occupation of the Infrastructure Project;
6.8.4 if Council is not satisfied with the Infrastructure Project, Council may refuse to issue a Certificate of Practical Completion provided Council:
(a) identifies in what manner the Infrastructure Project is not satisfactorily completed; and
(b) what must be done to satisfactorily complete the Infrastructure Project;
6.8.5 Council may, notwithstanding a minor non-compliance, determine to issue a Certificate of Practical Completion if Council is satisfied that the proper construction of the Infrastructure Project can be secured or otherwise guaranteed to its satisfaction;
6.8.6 before accessing land owned by Council or a third party for the purpose of constructing an Infrastructure Project or undertaking any maintenance or repair of defects in respect of the Infrastructure Project in accordance with this Agreement, the Owner must satisfy Council or if requested by a third party, that person, that the Owner has:
(a) consent of the owner of land to access such land;
(b) satisfied any condition of such consent;
6.8.7 the Owner must put in place all proper occupational health and safety plans as may be required under any law of the State of Victoria for that purpose;
6.8.8 subject to the Owner satisfying any conditions of consent to access land owned by Council, Council will provide all reasonable access as may be required to its land in order to enable an Infrastructure Project to be constructed and completed, maintained or repaired in accordance with this Agreement.
Certificate of Practical Completion. When the Contractor is of the opinion that Practical Completion has been reached, the Contractor shall in writing request Essential Energy’s Representative to issue a Certificate of Practical Completion. Within 14 days of the receipt of the request, Essential Energy’s Representative shall give to the Contractor and to Essential Energy a Certificate of Practical Completion certifying the Date of Practical Completion or give the Contractor in writing the reasons for not issuing the Certificate. When Essential Energy’s Representative is of the opinion that Practical Completion has been reached, Essential Energy’s Representative may issue a Certificate of Practical Completion, whether or not the Contractor has made a request for its issue.
Certificate of Practical Completion. (a) Tetra Tech must issue a certificate entitled ‘Certificate of Practical Completion’ (“Certificate of Practical Completion”) where the Contractor has submitted a Practical Completion Claim and Tetra Tech is satisfied that Practical Completion has been achieved.
(b) Where no Practical Completion Claim has been submitted, Tetra Tech may, in its sole and absolute discretion, issue the Certificate of Practical Completion.
Certificate of Practical Completion. (a) When the Landlord believes that the Landlord's Works have reached Practical Completion it must request the Landlord's Consultant to inspect the Landlord's Works and to issue a Certificate of Practical Completion.
(b) The Landlord's Works are taken to have reached Practical Completion on the date stated in the Certificate of Practical Completion.
(c) The Landlord must give the Tenant a copy of the Certificate of Practical Completion as soon as possible.
Certificate of Practical Completion. 29.1.1. The Contractor shall give the Company Representative at least 45 days written notice of the date upon which the Contractor anticipates that Practical Completion of the Works will be reached.
29.1.2. When the Contractor is of the opinion that Practical Completion has been reached, the Contractor shall in writing request the Company’s Representative to issue a Certificate of Practical Completion. The Company will then inspect the Works and conduct any tests it may require and either give the Contractor a Certificate of Practical Completion or notify the Contractor of any work under the Contract remaining to be completed.
29.1.3. If the Company Representative is of the opinion that Practical Completion has been reached, the Company Representative may issue a Certificate of Practical Completion even though the Contractor has not made a request for its issue.
29.1.4. The Certificate of Practical Completion shall specify:
(a) the date of take over of the Works;
(b) any matters, omissions or defects which the Contractor must still complete or make good (including demobilisation) in accordance with the Contract; and
(c) the date by which the Contractor must complete or make good such matters, omissions or defects and if no date is specified the Contractor shall complete or make good such matters, omissions or defects within 30 days after the date of issue of the Certificate of Practical Completion.
Certificate of Practical Completion. 6.1 CCURV is to procure that CCURV’s Representative inspects the Development Works with a view to the issue of the Certificate of Practical Completion in accordance with the terms of the Building Contract. CCURV is to give the Council’s Representative not less than ten working days’ prior written notice of the date and time, being a working day during the hours of daylight, when CCURV’s Representative will carry out this inspection.
6.2 The Council and the Council’s Representative will be entitled to accompany XXXXX’s Representative on the inspection of the Development Works and to make representations on the proposal to issue the Certificate of Practical Completion and CCURV is to procure that XXXXX’s Representative takes proper account of any representations made by them.
6.3 If there are any defects in the Development Works, other than defects in the nature of minor snagging items which would not be an impediment to the issue of the Certificate of Practical Completion in accordance with the terms of the Building Contract, CCURV is to procure that CCURV’s Representative does not issue the Certificate of Practical Completion until those defects have been made good.
6.4 Subject to paragraph 6.3, CCURV is to serve a copy of the Certificate of Practical Completion on the Council and the Council’s Representative as soon as reasonably practicable after the date of the inspection of the Development Works.
Certificate of Practical Completion. 7.1 Following completion of the Highway Works, the Developer shall apply to the Proper Officer in writing for a Certificate of Practical Completion.
7.2 Within [10] Working Days following receipt of a written application for the issue of a Certificate of Practical Completion the Proper Officer shall:
(a) inspect the Highway Works to which the application relates; and
(b) provide the Developer (where necessary) with a definitive written list of any further works required to be carried out in order to achieve Practical Completion of the Highway Works and any remedial works required as a result of the Stage 3 Safety Audit Report (Additional Works).
7.3 The Developer must carry out any Additional Works without delay and at its own cost.
7.4 The Additional Works shall be subject to the same inspection procedure set out in clause 7.2(a) until such time as the Highway Works are Practically Complete to the [reasonable] satisfaction of the Proper Officer and safe and fit for the type of traffic expected to use the Highway Works.
7.5 Within [20] Working Days of a satisfactory inspection, the Certificate of Practical Completion shall be issued to the Developer provided that the maintenance period of any sewer constructed on or under the Highway Land in accordance with a Sewer Adoption Agreement [is currently running OR has expired].
7.6 From and including the date of issue of the Certificate of Practical Completion the Highways Land (together with the Highways Works) shall be available for use by vehicles and pedestrians.
Certificate of Practical Completion. 7.1 The Tenant is to procure that the Tenant’s Representative inspects the Development Works with a view to the issue of the Certificate of Practical Completion in accordance with the terms of the Building Contract. The Tenant is to give the Landlord’s Representative not less than ten working days’ prior written notice of the date and time, being a working day during the hours of daylight, when the Tenant’s Representative will carry out this inspection.
7.2 The Landlord and the Landlord’s Representative will be entitled to accompany the Tenant’s Representative on the inspection of the Development Works and to make representations on the proposal to issue the Certificate of Practical Completion and the Tenant is to procure that the Tenant’s Representative takes proper account of any representations made by them.
7.3 Subject to paragraph 7.3, the Tenant is to serve a copy of the Certificate of Practical Completion on the Landlord and the Landlord’s Representative as soon as reasonably practicable after the date of the inspection of the Development Works.
7.4 Notwithstanding the issue of the Certificate of Practical Completion, if the Landlord is of the opinion that there are defects or other items of work outstanding in the Development Works relating to the Retained Buildings (other than minor items as referred to below), the Landlord may give notice to that effect to the Tenant within 10 working days of receipt by the Landlord of the Certificate of Practical Completion whereupon the provisions of paragraph 8 of this Schedule will apply but in default of the Landlord giving such notice the Statement of Practical Completion shall be deemed to have been issued and the provisions of paragraph 8 of this Schedule will have no further effect.
